HomeMy WebLinkAbout2017ORDINANCE N0, 2017 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF C:4LIFORNIA, A "TM-2" (TIMBER MOUNTAIN) DISTRICT, PURSUANT TO CHAPTER 24-29. 1 The Board of Supervisors of the County of Butte, State of 2. .California, under and. pursuant to Chapter 24-29 of the Butte County- 3 Code of said County D0 ORDAIN as follows: 4 SECTION 1. The hereinafter described area situated in the 5 County of Butte, State of California, shall be and it is hereby g zoned as a "TM-2" (Timber Mountain} District, and such area shall 7 be subject to the restrictions and restxicted uses and regulations g hereinafter specified and provided. 9 Said area so zoned being located in the unincorporated 10 area of Butte County, Oroville, more particularly described as ll follows : i 12 Beginning at the NE corner of the S 1/2 of the NE 1/4 of the NW l/4 of Section 34 T22N, R4E, 13 MDB~M; thence S 0° 09`'~ lb" W, 435 ft.; thence N ~8° 57' W, 464 ft,; thence N 56° 50' W, 218 ft.; 14 thence N 68° 10' W, 218 ft.; thence N 5$° 50' W, 278 ft.; thence N 66° 10' W, 79 ft.; thence S 88° 15 08' 30" E, 117b.50 ft, to the point of beginning.. 16 Containing 7.1 acres, more or less, north of Oroville. 17 SECTION 2, REGULATIONS FOR A "TM-2" DISTRICT: 18 The following regulations shall apply in a "TM-2" District, 19 (A) USES PERMITTED: 20 1. Commercial boat ramps, docks and landing facilities. S. Aircraft landing facilities. 9. Disposal areas and sewage treatment facilities. 10, Public and quasi-public. uses including schools, parks, playgrounds, recreational facilities, utility system structures, meeting halls, hospitals, libraries, museu s, government offices and similar uses. 11 Private or commercial outdoor recreation facilities an sites of not less than five (5) acres, including country clubs, golf courses, riding academies and ::~ stab~.es, hunting and fishing camps and other clubs, and gun clubs and ranges. (C) Lot Area: Minimum required area of a lot per dwelling unit shall not be less than two (2) acres for "TM-2" . (D) Lot Width required: -3- i~ 1 Minimum required lot width shall not be less than ..... . 2 sixty-five {.b5) feet,_ . .. .. 3 {E) Front yard required: 4 Minimum required front building setback shall be not ~ less than fifty (50) feet from the centerline of the road, 6 except where the road is classified by the Gounty as a 7 Federal Aid Secondary Road, the minimum required front 8 building setback shall be not less than fifty-five (55) 9 feet from the centerline of the road. 10 [F) Side yard required: 11 Minimum required side building setback shall be not 12 less than five (S) feet for "TM-2". 13 (G) Rear yard required: 14 Minimum required xeax building setback shall be not 15 less than five {5) feet for "TM-2", 16 SECTION 3, All uses of Iand within the district not 17 specifically authorized and permitted are prohibited, 18 SECTION 4. In compliance with the provisions of said 19 utte County Gode, Chaptex 24, the same is hereby amended by adding 20 Ifthis Ordinance in full. 21I ~ SECTION 5. The penalties for the violation of the zoning 22 ereby imposed within the district shall be as porvided in the 23 utte County Code, Chapter 24, this Ordinance shall from and after 24 its effective date become a supplement to and part of the Butte 25 Gounty Code, Ghaptex 24. 26 SECTXQN. 6.
