County .. Code of said County DO ORDAIN as follows: SECTION 1. The hereinafter described area situated in thel County of Butte, State of California, shall be and it is hereby 'zoned as a "TA4-5" (Timber Mountain} District, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located in the unincorporated urea of Butte County, Forest Ranch, more particularly described as ~ follows That portion of the following described parcel located in the W 1/2 of Sec. 6 T23N, R3E, MDB~M: Beginning at the center of said Sec. 6 and running thence along the E and W centerline of said Sec., N 8b° 0?r W 297.00 ft.; thence S 27° 29r 30'°' W 1020.46 ft.; thence S 84° 55' E 991.55 ft. to an iron pipe; thence N 5° 29r 45" E 464.01 ft. to an iron pipe; theme S 84° 55' 05" E. 30.24 ft. to an iron pipe; thence N 12° 14r 55" E 498.00 ft. to an iron pipe~on the~_E~.:and W centerline of said Sec . 6 ; thence along said E ~, W centerline, N 86° 9?' W 401.48 ft. to the point of beginni~,g. Containing 14 acres, more or less, Forest Ranch. SECTION 2. REGULATIONS FOR A "TM-5".DISTRICT: The following regulations shall apply in a "TM-5" District. (A) USES PERMITTED: 1. Keeping and raising small animals for domestic use, including dogs, cats and household pets, poultry and other birds, bees, fish and frogs. ~4. Keeping, raising and pasturing of cattle, horses, sheep, goats, hogs or other livestock, provided that no more than two (2) such animals be kept per acre on parcels of less than five [5) acres and na more than four (4) such animals be kept per acre on parcels of five (S} acres or mare. 5. Prospecting, claiming, drilling, mining, excavating and dredging of mineral, hydrocarbon and geothermal resources,- except as limited in Section [B) below. 6. Protection df land and forests from fire, erosion, floods, slides, quakes, insects, diseases and pollutio , including arboretums and natural wilderness, experi- mental, and study areas . 7. Display and sale of products of agricultural uses and home arts and crafts produced an the premises. 8. CASE.: .............. 1. Residential uses other than one single-family dwelling per parcel or one single family dwelling per five (5) acres for "TM-5", including labor camps, commercial guest lodging, group quarters ar dwelling units at greater densities. 2. Commercial wood processing plants. 3. Commercial kennels and animal hospitals. 4. Commercial livestock feed yards. 5. Animal product processing plants. 6. Mining, quarrying and excavating activities which might be ob3ectionable by reason of noise, actor, smoke, dust, bright light, vibration, stxeam pollution or handling of explosives or dangerous materials. 7. Commercial boat ramps, docks and landing facilities. 8. Aircraft landing facilities. 9. Disposal areas and sewage treatment facilities. 10. [C) Lot .Area: _... _ Minimum required area of a lot per dwelling unit sha11 be not less than five (5] acres far "TM-5". (D) Lot Width required; Minimum required lot width sha11 not be less than sixty--five (65] feet . (E) Front yard required; Minimum required front building setback sha11 be not less than fifty (50) feet from the centerline of the road, except where the road is classified by the County as a Federal Aid Secondary Road, the minimum required front building setback shall be not less than fifty-five (55] feet from the centerline of the road. (F) Side yard required: Minimum required side building setback sha11 be not less than ten (10) feet for "TM-5". (G] Rear yard required: Minimum required rear building setback shall be not less than ten (10] feet fox "TM-5". SECTION 3. Ali uses of land within the district not specifically authorized and permitted are prohibited. SECTION 4. In compliance.. with the provisions of said Butte County Code, Chapter 24, the same is hereby .amended by adding Ilthis Ordinance in full. SECTION 5. SECTION 6. This Ordinance shall be and it is hereby declared to be in fu11 force and effect from and after thirty (30) days after the date of its passage, and before the expiration of fifteen (1~) days after its passage, this Ordinance shall be published once with the names of the members of the Board of Super- visors voting for and against it in the Chico Enterprise a newspaper published in the County of Butte, State of California.
