AN ORDINANCE ZONING A PORTION OF THE COUNTY OF
BUTTE, STATE OF CALIFORNIA, A "PA-G" (PLANNED AREA
CLUSTER} DISTRICT, PURSUANT TO GHAFTER 24-29.
1 The Board of Supervisors of the County of Butte, State of

3 Code of said County DO ORDAIN as follows:
4 SECTION 1. The hereinafter described area situated in
5 the County of Butte, State of California, sha11 be and it is hereby
6 zoned as a "PA-C" (Planned Area - Cluster) District, and such area
7 sha11 be subject to the restrictions and restricted uses and
8 regulations hereinafter specified and provided.
9 Said area sa zoned being located in the unincorporated
14 area of Butte County, Chico, more particularly described as follows:
I1. Parcel One: A parcel. of land in the Rancho Arroyo
~co, utte County, California, being a portion of
1.2 that certain tract known as "H. B. Reed Ranch", and
more particularly described as follows:

Beginning at an iron pipe in the easterly line of
1.4 the California State Highway southerly along said
highway line 1918.3 f t. from the southwesterly cox-
15 ner of the Burson Tract according to the official
map thereof on record in the office of the Recorder
16 ~ of the County of Butte, State of California, said
paint being on the southeasterly line of a 50 foot
17 road knoi,Tn as Rio Linda Ave . , as shown on 1~lap of
Ria Lindo Subdivision, recorded in the office of the
18 County Recorder of Butte County, July 26, 1946, in
tiiap Boole 14, at Page 40, running thence N 52° 43'
19 E along the southeasterly line of said 50 foot road,
540.0 feet to the true point of beginning of the
20 parcel of land herein described; 'thence from said
true point of beginning N 52° 43' E along said
21 southeasterly line of said 50 foot road, b0.0 ft.;
thence S 36° 15' E, 181.5 ft.; thence S 52° 43' W
22 60.0 ft.; thence N 36° 15' W, 181.5 ft. to said true

SECTION 2. REGULATIONS FOR A "PA-C" DISTRICT:
The follawirig_regulations shall apply in a SPA-G"
District.
(A} PURPOSE :
The '~'PA-C" zone is intended to facilitate the development
of centers of residential or light commercial activities
ar a combination thereof and related uses without regard
to the traditional limitations on lot size, road frontage,
setback, side yards and rear yards. Said zone is to be
applied only to axeas determined to be suitable for such
uses, as evidenced by a development plan to be submitted
by the applicant to the planning commission, and to be
evaluated by reference to existing and proposed land uses,
the county general plan and any applicable precise plans.
The final development plan, as approved by the Board of
Supervisors, shall be binding on the developer ar sub-
sequent owners as regulations fo,r land uses within the
zone. Deviations from the said plan (except minor
deviations which do not increase the density ar intensity
of any use, change the character of any use ar introduce
any new uses} shall require rezoning in accordance with
an amended development plan. Further, said zone should

be applied only where its pexipheral boundaries can be
2 adequately.-integrated with the surrounding public road...
3 system and surrounding zones without creating nuisances
4 from noise, fumes, congestion or other causes.
5 (B) USES PERMITTED:
g 1. Those uses which are permitted in the "C-1" (Light
7 Commercial) District without the necessity of securing
g a use permit.
g 2. Service Stations.
lp (C) USES PRCHIBIT1rD: Allother uses o£ land not specifi-
11 ca1ly authorized under Section ~4-126(A) above are pro-
12 hibited.
13 (D) Lot regulations:
14 There shall be no setback, side yard, rear yard, or
15 lot width or frontage requirements in areas zone PA-C;
16 provided, however, that where a PA-C zone abuts a single-
17 or :multiple=:family residen~fia~:.:zone, the setback require-
18 meats of the abutting residential zone in existence at the
lg time the PA-C zone application is acted upon by the
20 planning commission shall apply to that portion of the
21 - cluster zone along the boundary common to the cluster and
22 residential zone; provided further, however, that no
23 structure within a PA-C zone shall be located within ten
24 (10) feet of a common pxoperty line bet`+Teen the PA-C zone
25 and an abutting single or multiple residential zone.

Access to each lot or to the common area serving said

of Chapter 20 of the Butte County Code including the
improvement standards set forth in the resolution of
standards adopted pursuant thereto.
Vehicular and pedestrian movement in said cluster
parcel adequate for the use intended shall be evidenced
by rights-af-way or easements granted on a final sub-
division map or rights-of-way or easements granted by
separate instrument puusuant to approval of the Board of
Supervisors. Desirable minimum width o~ any such ease-
ment is twenty {20) feet.
{F) Lot coverage:
No lot (when considered together with its proportion-
ate share of any common space) shall be permitted buildin
coverage greater than that permitted in the C-1 zone for
an equal size lot used for the same purpose.
{G) Supersession:
In the event the regulations for this zone clearly
conflict with the terms of any other applicable ordinance
of t11e bounty of Butte except building, electrical,
plumbing and sewage codes, the provisions hereof shall
control. The provisions of this chapter shall be constru
ed to be in harmony with all such ordinances unless
clearly in conflict therewith. Any subdivision estab~-
fished in a cluster zone after the effective date of this

chapter shall be deemed to be an "open space subdivision"
I- - for the purposes of Section 20-30.2. of the Butte.County-
Code .
{H) Improvements:
All improvements within said zone shall meet the
requirements of Chapters l9, 2b, 27, and 28 of the Butte i
County Cade.
{I) AZinimum area:
The minimum area of any PA-C district shall be three
{3) acres .
{,I) Off-street parking:
Off-street parking shall be required pursuant to the
following formula:
a. Residential uses: Two {2} parking spaces for each
living unit.
b. Offices: One {1) parking space for each four hundred
(400) square feet of grass floor area.
c, Retail stares: One {l) parking space for each three
hundred (300) square feet of gross floor area.
Said parking area may be awned individually by the
owners of more than a~ne lot in c.ammon.
(K) Procedural:
Any application for rezoning to planned area-cluster
shall be accompanied by a preliminary development plan to
be submitted to the subdivision committee for review and
report pursuant to Section 20-13 of the Butte County Code

As to form and content, the preliminary development plan

meats of this Code for a tentative subdivision map. Upon
receipt of the recommendations of the committee , the
planning director shall set the application for hearings
as in the case of other rezoning applications.
SECTTON 3. In compliance with the provisions of said
Butte County Code, Chapter 24, the same is hereby amended by adding
this Ordinance in full.
SECTTON 4. The penalties for the violation of the zoning
hereby imposed within the district shall be as provided zn the
Butte County Code, Chapter 24, this Ordinance shall from and after
its effective date become a supplement to and part of the Butte
County Code, Chapter 24.
SECTION 5. This Ordinance shall be and it is hereby
declared to be in fu11 force and effect from and after thirty (3Q)
days after the date of its passage, and before the expiration of

fifteen (l5) days after its passage, this Ordinance shall be
published once with the names of the members of the Board of
Supervisors voting for and against it in the Chico Enterprise Re co re
a newspaper published in the County of Butte, State of California.
