HomeMy WebLinkAbout2023ORDINANCE N0. 2023 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, A "TM-S" (TIMBER MOUNTAIN) DISTRICT, PURSUANT TO CHAPTER 24-29. 1 The Board of Supervisors of the County of Butte, State of 2 California, under and pursuant to.Chapte.r.24-2.9 of the. Butte ..County, 3 Code of said County DO ORDAIN as follows: 4 SECTION 1. The hereinafter described area situated in the 5 County of Butte, State of California, shall be and it is hereby 6 zoned as a "TM-5" (Timber Mountain) Di~~trict, and such area shall be 7 subject to the restrictions and xestricted uses and regulations 8 hereinafter specified and provided. 9 Said area so zoned being located in the unincorporated 10 area of Butte Coutny, Forest Ranch, mare paxticularly described as 11 follows: 12 A1~ of parcel 16 per paxcel map of record in Map Book 67 on Page 3 of the Butte County Recorder. 13 Containing 20.07 acres, more or less, Forest Ranch 14~ 15 SECTION 2. REGULATIONS FOR A "TM-5" DISTRICT: lg ~ The following regulations sha11 apply in a "TM-5" District ~.7 (A) USES PERMITTED: 18 1. One- single-family dwelling per parcel, including 19 mobile home. 2D 2. Management, raising, harvesting and removal of trees, 21 shrubs, seedlings, flowexs, herbs and all food craps 22 for human or animal consumption. 2~ 3. Keeping and raising small. animals for domestic use, 24 including dogs, cats and household pets, poultry and 23 other birds, bees, fish and frogs. 26 4. Keeping, raising and pasturing of cattle, horses, _l_ 1 2 3 4 5 s 7 8 9 10 12. 12 13 14 15 16 17 18 is 20 21 22 23 24 25 26 sheep, goats, hogs or other livestock, provided that _. no more.than..two (2) such.an,mals_be kept per acre o.n. parcels of less than five (5} acres and no more than four (4) such animals be kept per acre on parcels of five (5} acres ox more . 5. Prospecting, claiming, drilling, mining, excavating and dredging of mineral, hydrocarbon and geothermal resources, except as limited in Section. ($) below. 6. Protection of land and forests from fire, erosion, floods, slides, quakes, insects, diseases and pollutio , including arboretums and natural wilderness, experi- mental and study areas. 7, Display and sale of products of agricultural uses and home arts and crafts produced on the pxemses. 8. Accessory uses, improvements and structures customary and pertinent to permitted uses, except as limited in Section (B} below, including guest houses, barns, shed , shops, garages and storage areas, (B) USES PERMITTED SUBJECT TO FIRST SECURING A USE PERMIT IN EACH CASE: 1. Residential uses other than- Qne single-family dwelling per parcel or one singles:family dwelling per five (5} acres for "TM-5", including labor camps, commercial guest lodging, group quarters or dwelling units at greater densities. 2. Animal product processing plants. b. Mining, quarrying and excavating activities which might be objectionab~:e by reason of noise, odor, smoke, dust, bright light, vibration, stream pollution or handling of explosives or dangerous materials. 7. Commercial boat ramps, docks and landing f acilities. 8. Aircraft landing facilities. 9. Disposal areas and sewage treatment facilities. l0. Public and quasi-public uses including schools, parks, playgrounds, recreational facilities, utility system structures, meeting halls, hospitals, libraries, museums, government offices and similar uses. 11. Private or commercial outdoor recxeation facilities on sites of not less than five [S) acres, including country clubs, golf courses, xiding academies and stables, hunting and fishing camps and other clubs, and gun clubs and ranges. (C) Lot area: Minimum required area- of a lot per dwelling unit shall be not less that five (5) acres for "TM-5". [D) Lot width required: Minimum required lot width shall be not less-than sixty-five {~i5) feet. (E) Front yard required: - -3- 1 2 .. 3 4 5 6 7 8 9 la ll 12 13 14 15 1F Minimum required front building setback shall. be not -- less-than fifty {SO) feet from the centerline o~ the road,- except where the road is classified by the County as a Federal Aid Secondary Road, the minimum required front building setback shall be not less than fifty-five (55) feet from the centerline of the road. (F) Side yard required: Minimum required side building setback shall be not less than ten {1 Q) feet for "TM-5". (G) Rear yard required: Minimum required rear building setback shall be not less than ten (1Q) feet fax "TM-5". SECTION 3. All uses of land within the district not 'specifically authorized and permitted axe prohibited. SECTION.4. In compliance with the pravisians of said Butte County Code, Chapter 24, the same is hereby amended by adding 17 this Ordinance in full. 18 SECTION 5, The penalties for the violation of the zoning 19 hereby imposed within the district shall be as provided in the 20 Butte County Gode, Chapter 24, this Ordinance shall from and after 2l its effective date became a supplement to and part of the Butte 22 Caunty Code, Chapter 24, 23 SECTION 6.
