HomeMy WebLinkAbout2031ORDINANCE N0. 2031 AN INTERIM ORDINANCE ZONING A PORTION OF THE GOUNTY OF BUTTE, STATE OF GALII"'ORNIA, AN "A-S" (AGRICULTURAL RESIDENTIAL) DISTRICT, The Board of Supervisors of the County of Butte, State of Gal ifornia, under and pursuant to Chapter. 24-30 of..the.Butte .County Code, and declaring an emergency, DO ORDAIN as follows: SECTION 1. The hereinafter described area situated in 6 7 8 9 10 11 12 13 14 15 16' 17 18 19 20 21. 22 23 24 2S 26 file County of Butte, State. of California, siYa11 be and it is hereby zoned as an "A-S" (Agricultural-Residential) .District fax a period of one hundred twenty (120) days, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located in Richvale, more ~~ particularly described as follows: A port ion of the NW: 1/4:~of the : NW~: l/4 of .-:Sec . 22, T19N R2E MDBF~M, mare particularly described as (allows Beginning at the N~V corner of said 5ectian 22; thence S $S° 17' E along the N line of said Sec. 22, being the centerline of the Richvale-Oroville Road, a distance of 463.7 ft. to a point in the westerly line of the 200 foot right-of-way of the Central Pacific Railroad; thence along said westerly line, S lS° 14' E, 325.43 ft.; thence S 67° ll' W, 72.00 f t.; thence at right angles, S 2Z° 43' E, 50.00 ft.; thence at right angles, S b7° 11' W, 162.28 ft.; thence parallel with the centerline of the Richvale-South County Road, which said centerline is identical to the W line of said Sec. 22, S 0° 33' W, 151.08 ft.; thence S 89° 42' 00" W, 354.72 ft,; to the W line of said sec. 22; thence N 00° 33' 00" along said Sec. line to the point of beginning. Containing 7.1 acres, ,mare or less, Richvale. General farming, horticulture, commercial livestock, poultry production, warehousing and storage. 3. Accessary buildings and uses pertinent to the per- mitted uses, including agricultural processing plants 4. Housing facilities (including mobile homes} to accom- modate only agricultural employees and their families employed by the owner or operator of the premises, and provided further that such housing facility shall be considered accessary to the main building and shat conform to the provisions pertaining to required yard and open space far dwellings. 5. Mobile homes to house one family when such mobile home is the only housing facility located on the pr"emises, provided the following conditions are conformed ta: a. The floor area within the mobile home sha11 not be less than five hundred {500) square feet. b. .,The parcel of land conforms to section 24 -72 {C) {minimum lot area- of five (5) acres); or a small parcel of land lawfully created. (B} THE FALLOWING USES ARE PERA4ITTED SUBJECT TO SECURTNG A USE PERMIT IN EACH CASE: 1. Golf courses and country clubs. 2. (C} MINIMUM LOT AREA REQUIRED: The requirements of Section 24 -33 of this Code not withstanding, the minimum lot area in A-S zones shalt not be Less than five (5} acres, SECTION 3. Ali uses of land within the district not specifically authorized and permitted are prohibited, SECTION 4. In compliance with the pr"ovisions of said 3utte County Code, Chapter 24, the same is hereby amended by adding this Ordinance in full. SECTION 5. The penalties for the violation of the zoning iereby imposed within the district shall be as provided in the 3utte County Code, Chapter 24, this Ordinance shall from and after its effective date become a supplement to and part of the Butte ~ounty Code, Chapter 24. SECTION G, This urgency ordinance shall take effect immediately upon its passage, and before the expiration of fifteen ~l5} days after its passage sha11 be published once with the names ~f the members of the Board of Supervisors voting for and against :he same in the Oroville Mercury, a newspaper in general cir- ;ulation in the County of Butte, State of Cal ifarnia. The facts :instituting the urgency on which this Ordinance.is based are: 1.
