The Board of Supervisors of the County of Butte DO ORDAIN
as follows:

Section 1. That Section 21-85~of the Butte County Coded '
is hereby amended to read as follows:
§21--85. Authority to fix and collect charges. The
board of supervisors may fix and collect charges far a particular
kextended service authorized pursuant to Article 7 of chapter.2.2,
title 3, division 2 of the Government Code (Government Cade
section 25210.70, et s__eg_.) in whole or in part, for the costs
thereof. The revenue obtained thereby may be in lieu of, or
supplemental to, revenue obtained by the Levy of taxes. The
charges may vary by reason of the nature of the use or the month
in which the service is rendered to correspond to the cost and
the value of the service. The charges may be determined by appor-
tioning the total cost, not otherwise offset by other available
revenue, of the extended service area to each parcel therein in
proportion to the estimated benefits from such service to be
received by each parcel. The charge may be extended over the
entire service area or a zone thereof.
Section 2. That Section 21-90 of the Butte Gounty Cade
lis hereby amended to read as follows: _
§21--90. Charges to appear as separate item on tax bill;
collection of charges. The charges set forth in the report, as
confirmed, shall appear as a separate item an the tax bill. The
charge shah be collected at the same time and in the same manner

shall be subject to the same penalties and the same procedure and
sale in case of delinquency as provided for such taxes. All laws
applicable to the levy, collection and enforcement of county ad
valorem property taxes shall be applicable to such charge, except
that if the real property to which such charge relates has been
transferred or conveyed to a bona fide purchaser for value, or if
a lien of a bona fide enc~brancer for value has been created and
attaches thereon, prior to the date on which the first installment
Iaf such taxes wauld become delinquent, then the charge,con.firmed
pursuant to this section shall not result in a lien against such
real property but instead shall be transferred to the unsecured
roll for collection.
Section 3. That this ordinance shall take effect thirty
'~{30) days after the date of its adoption, and before the expiration
of fifteen (15) days after its passage, it shall be published with
the names of the members voting for and against-the same in the
Chico Enter rise Recorc! a newspaper published in the
County of Butte, State of California.
