AN ORDINANCE ZONING A PORTION OF THE COUNTY OF
BUTTE, STATE OP CAi~IFORNIA, A "TM-5" {TIMBER
MOUNTAIN) DISTRICT, PURSUANT TO CHAPTER 24-29.
The Board of Supervisors of the County of Butte, State of
Cal-ifarnia, under and-pursuant to Chap-ter.2q..-29 of the. Butt e,.C.aunty
Code of said County DO ORDAIN as follows:
SECTION 1. The hereinafter described area situated in the
County of Butte, State of California, shall be and it is hereby
zoned as a "TM-5" {Timber Mountain - 5 acre parcels) District, and
such axea shall be subject to the restrictions and restricted uses
and regulations hereinafter specified and provided,.
Said area so zoned being located in the unincorporated
area of Butte County, Forest Ranch, more particularly described as
follows:
The SW Z/4 of the NW 1/4 of Sec. 27, T24N R3E
MI?BFM and the westerly 350 ft. of the NE l/4
of the NW 1/4 of said. Sec. 27,
EXCEPTING THEREFRO?~4 that partidn of the southerly
790 ft. of the SW l/4 of the NW 1/4 of said Sec.
27 located east of the east right-of-way line of
Garland Road.
Containing 220 acres, more or less, Forest Ranch

The fallowing regulations shall apply in a "TM-5"
District:
{A) USES PERMITTED:

4. Keeping, raising and pasturing of cattle, horses,

5. Prospecting, claiming, drilling, mining, excavating

resources, except as limited in paragraph [b) below.
6. Protection of land and forests from fire, erosion,
floods, slides, Quakes, insects, diseases and pollu-
tion, including arboretums and natural wilderness,
experimental and study areas.
7. Display and sale of products ox agricultural uses and
home arts and crafts produced on the premises.
S. Accessory uses, improvements and structures customary
and pertinent to permitted uses, except as limited in'
paragraph (b) below, including guesthouses, barns,
sheds, shops, garages and storage areas.
(B) THE FOLLOI'VING USES ARE PERMITTEJ~ SUBJECT T4 FIRST
SECURING A USE PERAIIT IN EACH CASE:
1. Residential uses other than one single-family dwelling
per parcel or one single family dwelling per five (5)
acres for TA4-5, including labor ramps, commercial
guest Lodging, group Quarters or dwelling units at
greater densities.

(E) FRONT YARD:
- Minimum required franc build.ing..setback shall be not
less than fifty (50) feet from the centerline of the road,
except where the road is classified by the county as a
Federal Aid Secondary Raad, the minimum required fxont
building setback shall be not less than fifty-five (S5)
feet from the centerline~of the road.
(F) SIDE YARD:
Minimum required side building setback shall be not
Less than ten (10)-feet for TM-5.
(G) REAR YARD:
A4inimum required building setback shall be not less
than ten (10) feet-for TM-5.
SECTION 3, All uses of land within the district not
specifically authorized and permitted axe prohibited.
SECTION 4. In compliance with the provisions of said
Butte County Gode, Chapter 24, the same is hereby amended by adding
this Ordinance in full.
SECTION S. The penalties for the violation of the zoning
hereby imposed within the district shall be as provided in'° the
Butte County Code, Chapter 24, this Ordinance shall from and after,
Tits effective date become a supplement to and part of the Butte
County Code, Chapter 24.
SECTION 6. This Ordinance sha~.l be and it is hereby
declared to be in full force and effect from and after thirty (30)
days after the date of its passage, and before the expiration of
