Chapter 24-30 of the Butte County. Code, and declaring an emergency, ~0 ORDAIN as fo~.lows: SEGTION '!. The hereinafter described area situated in the County of Butte, State of California, shall be and it is hereby zoned as an "A-5" (Agricultural - 5 acre parcels) District for a period of 8 months, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located in Chico, more parti- ocularly described as follows: A portion of Sections 6, '], 8, 17, & 18 of T21N, R2E, MDBB~''I and Sections 1 and 12 of T21N, R1E, MDB&M, more particularly described as follows: Parcel 1: -That property bounded on the W by the Midway; on the S by Oroville Chico Highway; on the N by the S line of that subdivision known as the "2nd Subdivision of the J. F. Ender Ranch" revised map thereof per map of record in Map Book 8 on Page 2 of the Butte County Recorder; and on the E by the southwesterly right-of-way line of State Highway 99 and the top of the easterly levee of Butte Creek, excepting there- from the easterly 1200' (parallel to State High- way 99}, of the parcel described as:: Commencing at the mast easterly corner of the "2nd Subdi- vi~sion of the J. F. F. Parcel. 2 That property bounded on the N by Hegan Lane, on the E by the Midway, on the S by an unnamed stream described as crossing Midway 2200 feet S of Entler Avenue and meandering southwesterly; and on the W by the E line of "Bruce Tract" per map of record in Map Book 8 on Page 15 of the Butte County Recorder and its southerly extension, ex- cepting therefrom the northerly 1900 feet (parallel; to Hegan~Lane}'of that property located E of the W line of "Skyway Homes, Unit 2" per map of record~_ in Map Book 21 on_Pages 16 and 17 of the Butte County Recorder, and its southerly extension. Containing 1.300 acres,:~.more or less, Chico. SECTION 2. REGULATIONS FOR AN "A-5" DISTRICT: The following regulations shall apply in an "A~5" District: (A} USES PERMITTED: -2- 5~ i 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 2g 2S 1. One single-family dwelling per parcel, not including _ .. .. tents,,. trailers. or .mobile ..homes.... _ 2. Accessory buildings pertinent to permitted uses. 3. Agricultural uses, except livestock subject to the following requirements: a. Exclusive of the area devoted to the residential. use, the following lot ar parcel areas shall be required for each animal raised or kept on the premises: 1. For each horse or head of cattle over one yea of age, eight thousand one hundred twenty-f iv (8,125) square feet. 2. For each head of swingy aver ten (10) weeks of age, eight thousand one hundred twenty-five (8,125) square feet.. 3. For each head of sheep or goats, two :thQUSand (2000} square feet. (B) THE FOLLOWING USES ARE SUBJECT TO SECURING A USE PERMIT IN EACH CASE: 1, Duplex dwellings and multiple-family dwellings. . 2. Golf courses, country clubs, if .permitted,°would permit accessory uses such as driving range, pro shop cocktail bar, restaurant. 3. Commercial poultry farming and livestock farming. .. 5. Veterinary clinics, outpatient.. _ _, 6. Nurseries and plant gardens. 7. Sales tract office. (C) Site requirements: The provisions of Section 24-33 shall apply. SECTION 3. All uses of land within the district not 'specifically authorized and permitted are prohibited. SECTION 4. In compliance with the provisions of said Butte County Code, Chapter 24, the same is hereby amended by adding this Ordinance in full. SECTION 5. The penalties for the violation of the zoning hereby imposed within the district shall be as prova~ded in the -Butte County Code, Chapter 24, this Ordinance shall from and after its effective date become a supplement to and part of the Butte County Code, Chapter 24. SECTION 6. Phis urgency ordinance shall take effect immediately upon its passage, and before the expiration of fifteen (15) days after its passage shall be published once with the names of the members of~the Board of Supervisors voting for and against the same in the Chico Enterprise Record, a newspaper in. general circulation in the County of Butte, State of California. The facts constituting the urgency on which this Ordinance is based are: 1.
