HomeMy WebLinkAbout2055ORDINANCE N0. 2055 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, A "TM-3" (TIMBER MOUNTAIN) DISTRICT, PURSUANT TO CRAFTER 24-Z9. 1 The Board of Supervisors of the County of Butte, State of 2 California; under and pursuant to. Chapter-24°29-of the Butte County 3 Code of said County DO ORDAIN as follows: 4 SECTION 1. The hereinafter described area situated in 5 the County of Butte, State of California, sha11 be and it as hereby 6 zoned as a "TM--3" (Timber Mountain - 3 acre parcels) Distract, and 7 such area sha11 be subject to the restrictions and restricted uses 8 and regulations hereinafter specified and provided. 9 Said area so zoned being located in the unincorporated 10 area of Butte County, Oroville, more particularly described as 11 follows: 12 parcel 1 of that parcel map recorded in Map Book 67 on Page 30 of the Butte County Recorder and 13 Parcel Z of that parcel map recorded in Map Book 46 on Page 36 of the Butte County Recorder. 14 Containing 154.3 acres, more or less, northeast of 15 Oroville. 16 SECTION 2. REGULATIONS FOR A "TM-~" DISTRICT. 17 The following regulations shall apply in a "TM-3" 18 District: 19 (A) USES PERMITTED: 20 1. One single-family dwelling per parcel, including 2Y ~ mobile homes. 22 2. Management, raising, harvesting and removal of trees, . 23 shrubs, seedlings, flowers, herbs and all food crops 24 for human or animal consumption. 28 3. Keeping and raising small animals for domestic use, 2B including dogs, cats and household pets, poultry and -1-- other birds, bees, fish and frogs, -..... - 4; Keeping; raising and pas-tuning of cattle, hose-s ,- .. sheep, goats, hogs or other livestock, provided that no more than two [2) such animals be kept per acre on parcels of less than five (5) acres and no more 6 7 9 10 11 12 13 ~.4 15 16 17 18 19 20 21~ 22 23 24 28 2B than four. (4) such animals be kept per acre on parcel of five (5) acres or more. 5. Prospecting, claiming, drilling, mining, excavating and dredging of mineral, hydrocarbon and geothermal resources except as limited in paragraph (b) below. 6. Protection of land and forests from fire, erosion, floods, slides, quakes, insects, diseases and pollu- tion, including arboretums and natural wilderness, experimental and s~.udy areas. 7. Display and sale of products of agricultural uses and home arts- and crafts produced on the premises, 8. Accessory uses, improvements and structures customary and pertinent to permitted uses, except as limited in paragraph (b) below, including guesthouses, barns, sheds, shops, garages and storage areas. Commercial kennels and animal hospitals. 4. Commercial livestock feed yards. 5. Animal product processing plants. 6. Mining, quarrying and excavating activities which might be objectionable by reason of noise,-odor, smoke, dust, bright light, vibration, stream, pollu- tion or handling of explosives ar dangerous materials. 7. Commercial boat ramps, docks and landing facilities. 8. Aircraft landing facilities. 9. D~.spasal areas and sewage treatment facilities. 10. Public and quasi public uses including schools, parks; playgrounds, recreational facilities, utility system structures, meeting ha11s, hospitals, libraries, museums, government offices and similar uses. 11. Private or commercial outdoor recreation facilities on sites of not less than five (5) acres, including country clubs, golf courses, riding academies and .stables, hunting and fishing camps and other clubs, and gun clubs and ranges. . (E) FRONT YARD REQUTRED: Minimum. required front building setback sha11 be not less than fifty (50) feet from the centerline of the road; except where the road is classified by the county as a Ee.dexal Aid Secondary Road, the minimum required front building setback shall be not less than: fifty-fa.ve '(55) -feet from .the centerline of the road. (F) SIDE YARD REQUIRED: Minimum required- side building setback-shall be not less than ten (J.0) .feet for "TM-3". (G) REAR. YARD REQUIRED: Minimum required rear building setback shall be not less than .ten (10) feet for "TM-3". SECTION 3. A11 uses of land within the district not ecifically authorized and permitted are prohibited. SECTTpN 4. In compliance with the provisions of said tte County Code, Chapter 24, the same is hereby amended by adding 21 his Ordinance in full. 22 SECTION 5.
