HomeMy WebLinkAbout2066Ordinance No . 2Q66 AN ORDINANCE AMENDING §20 OI' THE EUTTE COUNTY CODE The Board of Supervisors of the County of Butte, State of California; DO ORDAIN as follows: Section 1. That §ZO-&5 of the B~tte:County Code is 6 7 8 9 10 3.1 12 13 14 15 16 17 18 is 20 21 22 23 24 23 26 hereby amended to-:read as. follows: §20-bb. Appeals. (1) Within, fifteen (l5) days after the action by the advisory agency any interested person may appeal to the board of supervisors any finding, action or condition imposed by the advisory agency by filing a notice of appeal with the clerk of the board of supervisors. (2) The board of supervisors may sustain, modify, reject or overrule any ruling of the advisory agency and may make such findings as are not inconsistent with county ordinances or the Subdivision Map Act. (a) Upon filing an appeal, the board of super- visors s'nall set the matter for a hearing to be held within thirty (30) days of the filing of the appeal. (b) Within ten {10) days following the conclusion of the hearing the board of supervisors shall render its decision on the appeal.. (3) Notwithstanding anything herein to the contrary, an appeal to a condition{s) may be made by the applicant after the fifteen {15) day appeal period referred to in paragraph (1) of this section, and the board of supervisors may. act on such an appeal. with oz without a noticed hearing where the board of supervisors makes the following findings: 1 {a) The proposed change in the condition{s) wild. 2 not adversely affect or cause a modification of the findings and. g determinations made in the environmental review process, and 4 (b ). The proposed change in the condition(s) wil] ~ not bring about an inconsistency to the General Plan, or to the g zone or to any specific plans for the property in question, and 7 {c} The facts are presented giving good and g sufficient reason why the condition{s) in question were not g appealed within the fifteen (T5) day period. 10 (,d) The parcel map or final map has not been 11 recorded. 12 Section 2. That §2Q-155 is hereby added to the Butte 13 County Cade to read as follows: 14 §20-155. Performance Security Provided by Assessment 15 District. 16 When the required subdivision. improvements are 17 financed and installed pursuant to special assessment proceedings, 18 upon the furnishing by the contractor of the faithful performance 19 and labor and material bonds required by the special assessment 20 act being 125Ed, the improvement security of the subdivider may be 21 reduced by an amount corresponding to the amount of such bonds so 22 furnished by the contractor, upon the approval of the Director of 23 Public Works. 24 ..... 25 .,... 26 ~~ 2 . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 i9 2a 21 22 23 24 25 26 Section 3. That §20-171 of the Butte County Code is hereby amended-to read-as follows:- - - §20-I7I.. Continuation of closed hearings. Such hearings with respect to notices of violation and certificates of compliance or the Committee's deliberation on the evidence after close of such hearings may be continued from time to time, not to exceed a reasonable time. 5~ecti:on 4.
