That §25-3 of the Butte County Code is hereby amet_ded to read as follows: §2b-3. Same - Amendments, Additions and Deletions. The Uniform Building Cade as adopted by §26-1 is amended as follows: 5ectians 204 and 205 of the Uniform Building Code are hereby deleted. The local appeals board of the County which was established by Resolution No. 64-3 of the County Board of Supervisors shall hear any and all appeals regarding the applica- tion and enforcement of this chapter. Section 30l(a} of the Uniform Building Code is hereby amended by the addition of the following paragraph: No permits shall be required for any agricultural building. Agricultural building is defined as follows: i~ Agricultural building is a structure designed and constructed to house farm implements, hay, grain, poultry, livestock, or other horticultural products. This structure shall not be a place of human habitation or a place of employment where agricultural products .are processed, treated, or packaged; nor shall it be a place used by the public. This exemption shall apply to tool sheds, wood sheds, and pump houses. This exemption shall not apply to carports and garages. Section 302(d} of the Uniform Building Code is amended to read as follows: (d) Every building permit issued under the provision of this Code shall expire by limitation and become null and void I~, after one (1) year from date of issuance of said permit. if the building is under construction, before work can continue, a new permit shall be first obtained and the fee therefor shall be one- half the building permit fee for the original permit, provided no changes have been made in the original plans. Section 302 of the Uniform Building Code is amended by the addition of Paragraph (f) as follows: (f ) A bui 1 ding pex~n.it may b e transferred from. the original permittee to another person due to a change in ownership or contractor. Section 303{a) of the .Uniform Building Code is amended I to read as follows: Permit fees, plan checking fees, filing fees, and reinspection fees shall be as specified in a resolution of fees as adopted by the Butte County Board of Supervisors. 2. 1 2 3 4 fi 6' 7 8 9 10 1.1 12 13 14 15 16 17 18 19 20 21 22 23 24 23 26 Section 303(c) of the Uniform Building Code is .amended to read. as follows: (c) Expiration of plan-check. Applications for which no permit is issued within one hundred eighty (1.80) days following the date of application shall expire by limitation and plans submitted for checking may thereafter be returned to the applicant or destroyed by the building official. The building official may extend the time for action by the applicant for a period not exceeding one hundred eighty (1.80) days upon written request by the applicant showing that circumstances beyond the cantral of the applicant have prevented action from being taken. Zn order to renew action on an application after expiration, the applicant shall resubmit plans and pay a new plan-check fee. Sections~303(b), 30.3 (d) and Chapter 15 of the Uniform Building Code are hereby deleted. Section 2. That §26-~B--3 of the Butte County Cade is hereby amended to read as follows: §26--B~-3. Amendments, Additions and Deletions. The Uniform Mechanical Code a.s adopted by §2&-B-1 ~ is amended as follows: Sections 202 and 203 of the said Uniform Mechanical Code are hereby deleted. Section 30l of said Uniform Mechanical Code is hereby amended by the addition of the following paragraphs: 9. No permit shall be required for any agricultural building. No permits shall be required for detached structures which have a total net area, including additions, of not more than two hundred (200) square feet, which would have an occupancy classification of Type M as defined in the Uniform Building Code, and which would be detached a minimum of six (6) feet from any building requiring a building permit. This exemption shall apply to tool sheds, wood sheds, and pump houses. This exemption shall not apply to carports and garages. ' Section 303 (b} of the Uniform Mechanical Code is amended to read as follows: Every mechanical permit issued under the provisions of this ordinance sha11 expire by limitation and become null and void after one (1) year from the date of issuance of said permit; provided, however, if said mechanical permit is issued in conjunction with a building permit, said mechanical permit will remain active as long as the building permit is active. Section 304 of the Uniform Mechanical Code is ~ amended to read as follows: Permit fees shall be as specified in a resolution of fees as adopted by the Butte County Board of Supervisors. Se~ct~ioii 3. That §27-3 of the Butte County Code is hereby amended to read as follows: §27-3. Sane - Amendments, Additions and Deletions. The Uniform Electrical Code adopted by §27-1 is Il amended to read as follows: Sections 204, 205, 311 and 312 of the Uniform ~~ Electrical Code are hereby deleted. Section 301 of said Uniform Electrical Code is hereby amended by the insertion of the following paragraphs after subsection 4 of said Unifarm Electrical Code: 5. No permit shall be required for the installation, alteration, or repair of agricultural water pumps used solely for agricultural purposes. Section 303<d) of the Uniform Electrical Code is hereby amended to read as follows: An electric permit may be transferred from the original permittee to another person due to a change in ownership or contractor. Section 304 of the Uniform Electrical Code is hereby amended to read as follows: Permit fees shall be as specified in a resolution of~fees as adopted by the Butte County Board of Supervisors.. "S'ec'tion 4. That §28-2 of the Butte County Code is hereby amended to read as follows: §28-2. Same - Amendment, Additions and Deletions. The Uniform Plumbing Code as adopted by §28--1 of the Butte County Code is hereby amended to read as follows: C. 1 Section~20.1 - Administrative Authority and Assistant . Whenever the term.."Administrative Authority" is used " 2 3 . .. _ _ . in this Code, it shall b.e construed to mean the Director of Public 4 Works of the County of Sutte or his authorized representative. 5 Section 20.3,- Permit Issuance and Limitations. 6 The issuance or granting of a permit or approval of 7 plans and specifications shall not be deemed or construed to be g a permit for, ar an approval of, any violation of any of the g provisions of this Code. No permit presuming to give authority 10 to violate ar cancel the provisions of this Code shall be valid, 11 except insofar as the work or use which is authorized is lawful. 12 The issuance or granting of a permit or approval of 13 plans shall not prevent the Administrative Authority from 14 thereafter requiring the correction of errors in said plans and 15 specifications or from preventing construction operations being lg carried on thereunder when in violation of this Code or of any 17 other ordinance or from revoking any certificate of approval when lg issued in error, lg Section 20.5 - Work Not Requiring Permit. 20 No permit shall be required in the case of any repair 21 work as follows: The stopping of leaks in drains, soil, waste 22 or vent pipe; provided, however, that should any trap, drainpipe, 23 soil, waste, or vent pipe be or become defective and it becomes 24 necessary to remove and replace the same with new material in any 2S part or parts, the-same sha11 be considered as such new work and 26 a permit shall be procured and inspections made as hereinbefore 7. 1 3I 4 5 6 7 S 9 10 ~~ 12 ~3 I.4 15 18 3.7 18 ~s 2D 2I 22 23 24 25 provided. No permit shall be required for the clearing of -stoppage-or the-repa•i-ring of leaks in pipes ,. valves, or fixtures - when such repairs do not involve or require the replacement or rearrangement of valves,' pipes, or fixtures. No permits shall be required for any agricultural building. This ordinance shall be and it is hereby declared to be in full force and effect from and after thirty (30) days after .the date of its passage, and before the expiration of of fifteen (15) days after is passage, this ordinance shall be published once with the names of the members of the Board of Supervisors voting for and against it in the Oroville Mercury a newspaper published in the County of Butte, State of California.
