Section 1. That Section 14-48 is hereby added to the Butte County Code to read as follows: §14~-48. Commercial vehicles having a grass vehicle weight rating of 10,000 pounds or more may not be parked in a residential area, as defined in this section, between the hours of 10:00 p.m. and 8:00 a.m. Provided, however, that this prohibition shall not apply to any commercial vehicle making pickups or deliveries of goods, wares, and merchandise from or to any building or structure located in a residential area, for the purpose of delivering materials to be used in the actual and bonafide repair, alteration, remodeling, or construction of any building or structure in a residential area for which a building permit has previously been obtained. A residential area is defined as that portion of a highway and the property con- tiguous thereto other than a business district, as defined by the Vehicle Code of the State of California, upon one-.side of which highway, within a distance of one-fourth {?4) mile, the contiguous property fronting thereon is occupied by thirteen (13) or more separate dwelling houses or upon both sides of which highway, collectively, within a distance of one-fourth (a) mile, the contiguous property fronting thereon is occupied by sixteen.(1.6) or more separate dwelling houses.
