HomeMy WebLinkAbout2196i~ `~ ORDINANCE N0. 2196 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, A "PA-C" {PLANNED AREA-CLUSTER) DISTRICT, PURSI,TANT TO CHAPTER 24-29 l The Board of Superviosrs of the County of Butte, State of 2California, under and pursuant to Chapter 24-29 of the Butte County 3`Code of said County DO ORDAIN as follows: 4 SECTION 1. The hereinafter described area situated in the 5 County of Butte, State of California, shall be and it is hereby 6 zoned as a "PA-G" (Planned Area Cluster) District, and such area ~ 7 shall be subject to the restrictions, restricted uses and regulation 8 pursuant to Butte County Code Section 24-126. g Said area so zoned being located in the unincorporated 1O'area of Butte County, Chico, more particularly described as follows: Z1 A1l that certain real property situate in the County of Butte, State of California, described as follows: 12 Being a portion of Lot 1 of the Burson Tract, a , 13~ portion of Lat l of the Hobart Subdivision, and a ' portion of projected Section 15, T22N, RIE, MDBF~M, ~~ more particularly described as follows: 1~` Parcel one as shown on that certain Parcel Map filed in the office of the Recorder of the County of Butte, ~6 State of California, on April 3, 1978, in Book 6S o.f Parcel Maps, at page 60. l'7' Excepting therefrom that portion deeded to the County lg' of Butte, August 8, 1979, in Book 2311, of Official Records, at page 206. 19° Containing 14.816 acres, more or ~.ess, Chico. 2d 21 SECTION 2: The use and development of said property shall 22' be in accord with the development plan submitted by the applicant, 23 as conditioned and incorporated herein by reference. Said condition- 24' ed development plan collectively consists of the folloiring documents: 2g' {a) Development Plan [showing the location of buildings, 26 streets, parking, recreation facilities and other major features -l- i 1 ; of the project) . 2 {h) Septic tank and Leach line layout and waterline - fir 3 hydrant location plan. 4 (c) Storm drain and road template plan. 5 {d) Landscape. plan. 6 ~~ SECTION 3; Notwithstanding the provisions of Chapter 24- 712f of the Butte County Cade the following provisions shall govern 8'the use and development of said property: g (a) The dwellings as shown an the development plan sha11 lpbe limited to residential uses and activities; and Il. (b) The recreation building and facilities as spawn an the 12develapment plan shall be limited to recreation, social, maintenance 13and administrative uses and activities associated with the develop- 1¢ment, exclusively; and 15~ (c) The storage of materials and objects around the 16'residential dwellings and recreational facilities as shown on the 17 development plan sha11 be limited to those which are necessary to, lgappurtenant to and customarily associated with the residential and 19':recreational use of the development; and 20 (cl) The height of all principal structures as shown on 21,the development plan sha11 not exceed a height of two (2) stories ar 22:;35 feet; and 23 {e} The keeping of livestock including Horses and the 24 evelopment of stables shall be prohibited; and 2g {f) Signs shall be Limited to an identification o£ the 2C evelopment not to exceed two {2) in number with a maximum sate of -2- ~[ . 'I I Z 50 square feet each, except that signs advertising the development 2 and sale and/or rental of units may be permitted until 85 percent 3 of the dwellings are sold and/or rented or until a period of five 4 (5) years has elapsed which ever is first. The developer shall be 5 responsible far the removal of all signs associated with the sale g and/or rental of said property. ry SECTION 4. Tn the event the residential units axe offered 8~fox safe, the developer shall establish a homeowners association to i gbe responsible for the maintenance and upkeep of the utilities, l0 ;roads, and all other property owned in common. The developer shall -~- 1Z assume responsibility for':.-the unsold, remaining memberships until Z2'such time as the homeowners association can reasonably assume the 13'financiaT responsibilities for the maintenance and upkeep of the l4 utilities, roads and all other real property owned in common. To Z~ ensure that the homeowners associat~.on is adequately formed to meet 16these responsibilities, the developer shall submit copies of said ~7~homeowners association agreement to the Butte County Planning Depart 7~g ent for review and approval prior to the xecordation of any sub- 9 sequent map authorizing the sale of any real property in conjunction 2p with this development. 2Z SECTION 5: This Drdinance shall be and it is hereby 22 declared to be in full force and effect from and after thirty (30) 23' days after the date of its passage, and before the expiration of 24 fifteen (l5) days after its passage, this Ordinance sh~ll.be F 2g` published once with the names of the members of the Board of 26 Supexvisors voting for and against it in the Chica Enterpxise, a ..~_ newspaper published in the County of Butte, State of California.
