ORDINANCE N0. 2204 AN ORDINANCE ZONTNG A PORTION OF THE COUNTY OF BUTTE, STATE OF CALTFORNIA, A "PA-C" (PLANNED AREA CLUSTER) DISTRTCT, PURSUANT TO CHAPTER 24-29.` The Board of Supervisors of the County of Butte, Sate of Claifornia, under and pursuant to Chapter 24-29 of the Butte ;.County Code of said County DO ORAAIN as follaws:~ °~' SECTION ].. The use and development of said propertys}gal _1- 2 3 4 5 6 7 s 9 10 J~ l Z2 13 14 15 ].6 17 18 ~s 20 2Z 22 23 24 23 26 be in accord with the development plan submitted by the applicant, as conditioned and incorporated herein by reference.` Said condition- ed development plan collectively consists of the following documents: (a) Development Plan (showing the location of streets, parking, recreation- facilities, septic tank and leach line layout and waterline - fire hydrant location plan, and other major features of the project, (b ) Typical 1 of l ayouts , (c) Partial. 1,andscape ~ plan, (d) Pence plan, {e) Street lighting plan SB CTION 3: Notwithstanding the provisions of Chapter'2~1- 1Z6 of the Butte County Code the following provisions shall govern the use and development of said pxaperty: (a) The dwellings as shown on the development plan shall be limited to residential uses and activities; and {b) The recreation building and facilities as shoran on th development plan shall be limited to recreation, social, ma.intenanc~ and administrative uses and activities associated with the develop- meet, exclusively; and (c) The storage of materials and objects around the resi- dential dwellings and recreational facilities as shown on the dev- elopment plan shall be limited to these which are necessar7T to, appurtenant to and customarily associated with the residential ', and recreational use of the development; and {d) The height of alI principal structures as shown on -2- 1 2 3 4 5 6 7 8 9 to k l1 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 i , the development plan sha11 not exceed a height of two {2) stax%es a 35 feet; and {e) The keeping,Qf livestock including horses and the' development of stables shall be prohibited; and (f) Signs shall be limited to an identification of ~h'e development not to exceed two {2) in number with a maximum size of ;~ ,F , SO square feet each, except that signs advextising the development and sale and/or rental of units may be permitted until 85 percent of the dwellings are sold and/or rented or until a pexiad of five {5) yeaxs has elapsed which ever is first. The developer shall be responsible fax the removal of all sxgris associated with the s',ale 'and/ox rental, of said property, f, SE CTIQN 4: In the event the residential units are o;~ffere far sale, the developer shall establish a homeowners association to be responsible far the maintenance and upkeep of the utilities'.,: roads, and all athex property owned in common. The developer ;shall assume responsibility far the unsold, remaining memberships until such time as the homeowners association can reasonably assume :the financial responsibilities for the maintenance and upkeep of the utilities, roads and all other real property maned in common.
