HomeMy WebLinkAbout2215ORDINANCE NO. 2215 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, A rrpA~G~t (PLANNED AREAWCLUSTER) DISTRICT, PURSUANT TO CHAPTER 24.29. 1 The Board of Supervisors of the County of Butte, State of California, 2 under anal pursuant to Chapter 24ri29 of the Butte County Code of said County $ DO ORDAIN as follows: ,~ SECTION 1. The hereinafter described area situated in the County of 5 Butte4 State of California, shall be and it is hereby zoned as a 'FPA.»C'~ g (Planned Area.»Cluster) District, and such area shall be subject to the % restrictions, restricted uses and regulations pursuant to Butte County Code g Section 2412&. ~ Said area so zoned being located in the unincorporated area of 10 Butte County, Chic c, more particularly described as follows: 11 Parcels 1, 2, 3, and 4, as shown on that parcel map filed in the Office of the Butte County Recorder in Baok 70 of Parcel Maps, on 12 Page 74- 13 Containing 14.5 acres, more or less, southeast of Chico. 14 SECTION 2. The use and development of said property shall be in 1~ accord with the development plan submitted by the applicant, as conditioned 16 and incorporated herein by reference. Said conditioned development plan 17 collectively consists of the fallowing documents: ~,$ Exhibit (a) Development Plan (showing the location of buildings, i 19 streets, parking, future recreation facilities, road template and other major 20 features of the project). 27: Exhibit (b) Fire hydrant location plan, ... 22 Exhibit (c} Landscape plan. 23 SECTION 3_ Notwithstanding the provisions of Chapter 24.-126 of the 24 Butte County Code the following provisions shall govern the use and development ~' of said property: 26 (a) The dwellings as shown on the development plan shall be limited 1 2 3 4 5 B 8 9'~ 10 I1 12 13 14 15 IB 17 18 xs 20 21 22 23 24 26 28 to residential uses and activities; and (b) The storage of materials and objects around the residential dwellings and recreational facilities as shown on the development plan shall be limited to those which are necessary to, appurtenant to and customarily associated with the residential and recreational use of the development; and (c) The height of all principal structures as shown on the development plan shall not exceed a height of two (2) stories or 35 feet; and {d) The keeping of livestock including horses and the development of stables shall be prohibited; and (e} Signs shall be limited to an identification of the development not to exceed two {2) in number with a maximum size of 50 square feet each, except that signs advertising the development and sale and/or rental of units may be permitted until 85 percent of the dwellings are sold andfor rented or until a period of five (~} years has elapsed which ever is first. The develo shall be responsible far the removal of all signs associated with the sale and/or rental of said property« SECTION ~. In the event the residential units are offered for sale, the developer shall establish a homeowners association to be responsible for the maintenance and upkeep of the utilities, roads, and all other property owned in common. The developer shall assume responsibility for the unsold, remaining memberships-until such time as the homeowners association can ..reasonably assume the financial responsibilities for the maintenance and upkeep of the utilities, roads and all other real property owned in common. SECTION ~. This Qrdinance shall be and it is hereby declared to be in full force and effect from and after thirty (30) days after the date of its ',passage, and before the expiration of fifteen ('~~) days after its passage, this Ordinance shah. be published once with the names of the members of the Board of Supervisors voting for and against it in the Chico Enterprise Record, a newspaper published in the County of Butte, State of California.
