AN ORDINANCE AMENDrNG SECTION 10--9
0~' THE BUTTE COUNTY CODE
The Board of Supervisors of the County of Butte, State
of California, DO ORDAIN as follows:
SECTION 1. Section 10-9 of the Butte County Code is
hereby amended to read as follows:
Sec. 10-9. Exceptions to prohiba.tions.
Section 10-5 sha11 not apply to trees,
agricultural crops, or public utility installations,
exclusive of permanent buildings, erected under
authority of law, nor to subsurface leaching
and drainage fields of private septic systems
approved by the County Director of public Health
and County Director of Public Ulorks. Section 10-8
shall not apply to fences providing that such
fence is approved for traffic safety by the
Director of Public C~'orks. A11 or any portion
o£ any fence hereafter placed in the set back
area or zone prescribed by this article shall
.. ~ <be rem:o`v'ed, .relocated :or-modified at ahe o~~n~r's -
expense within ninety (90) days of notification ~ ~~
by mail by the Director of Public C~'orks that such
removal, relocation or modification of the fence
is necessary to maintain adequate traffic safety.
Any such required removal, relocation or

modification shall be promptly accomplished
without loss or cost to the County of Butte.
Section 10-8 shall not apply to any lawful
use which becomes nonconforming upon the
effective date of Section 10--7 as amended.
SECTION 2. This Ordinance shall be and it is hereby
declared to be in full force and effect From and after thirty
(30) days after the date of its passage, and before the expiration
of fifteen (15) days after its passage,. this Ordinance shall be
published once with the names of the members of the Board of
Supervisors voting for and against it in the oroville Mercury
a newspaper published i.n the County of Butte, State
of California.
PASSED. AND ADOPTED by the Board of Supervisors of the
County of Butte, State of California, on the lzth day of May ,
1981, by the following vote:
AYES: Superva.sors Dolan, Lemke, Saraceni and Chairman Moseley
NOES : None
ASSENT : Supervisor wheeler
NOT VOTING : None ~~
