ORDINANCE NO. 2232
~~ AN ORDINANCE ZONING A PORTION OF THE COUNTY OF
BUTTE, STATE OF CALIFORNIA, A "PA-C" (PLANNED AREA-
CLUSTER) DISTRICT, PURSUANT TO CHAPTER 24-29.
~ -The Board of Supervisors of the .County of Butte, State of
2 California, under and pursuant to Chapter 24-29 of the Butte .County
3 Code of said County DO ORDAIN as follows:
4 SECTION 1. The hereinafter described area situated in th
~ County of Butte, State of California, shall be and it is hereby
~ zaned as a "PA-C" (Planned Area-Cluster) District, and such area
7 shall be subject to the restrictions, restricted uses and regulatio s
g pursuant to Butte County Code Section 24-126.
g Said area so zaned being located in the unincorporated

10 area of Butte County, Oraville, more particularly described as

~~ SECTION 2. The use and development of said property shall
~~ be in accord with the development plan submitted by the applicant,
~g as conditioned and incorporated herein by reference. Said conditio '-
lg ed development plan collectively consists of the following document

4 SECTION 3. Notwithstanding the provisions of Chapter 24- ~

S 126 of the Butte County Code the following provisions shall govern
6 the use and development of said property:
7 {a) The dwellings as shown on the development plan shall

g be limited to residential uses and activities; and ',
g (b) The recreation building and facilities as shown on the'
Zp development plan shall be limited to recreation, social, maintenance
11 and administrative uses and activities associated with the develop-
12 ment, exclusively; and
7.3 (c) The storage of materials and objects around the
14 residential dwellings and recreational facilities as shown on the
15 development plan shall be limited to those which are necessary to,
lg appurtenant to and customarily associated with the residential and
17 recreational use of the development; and
18 (d) The height of all principal structures as shown an
~g the development plan shall not exceed a height of two (2) stories
20 or 3S feet ; and
2I (e} The keeping of livestock including horses and the
22 development of stables shall be prohibited; and
23 {f} Signs shall be limited to an identification of the

development not to exceed two {2) in number with a maximum size of
50 square feet each, except that signs advertising the development
and sale and/or rental of units may be permitted until 85 percent
of the dwellings are sold and/or rented or until a period of five
{5) years has elapsed whiche~rer.~ is first. Thee developer sfra11 be
responsible for the removal of all signs associated with the sale
and/or rental of said property.
SECTION 4. In the event the residential units are offere
for sale, the developer shall establish a homeowners association to
be responsible for the maintenance and upkeep of the utilities,
Broads, and all other property owned in common. The developer shall
assume responsibility for the unsold, remaining memberships until
such time as the homeowners association can reasonably assume the ~
financial responsibilities for the maintenance and upkeep of the
utilities, roads and all other; real property owned in common: To
ensure that the homeowners association is adequately formed to meet
these responsibilities, the developer shall submit copies of said
homeowners association agreement to the Butte County Planning nepar -
ment for review and approval prior to the retardation of any sub-
Sequent map authorizing the sale of any real property in con3unction
with `this development:
SECTI01~ 5. Phis Ordinance shall be and it is hereby
declared to be in full force and effect from and after thirty {30)
days after the date of its passage, and before the expiration of
fifteen {15) days after i,ts passage, this Ordinance shall be
published once with the names of the members of the Board of

PASSED AND ADOPTED by the Board of Supervisors of the
County of Butte, State of California, on the l~+th day of .Tuly
1981, by the following vote:
