AN ORDINANCE ZONING A PORTION OF THE COUNTY OF
BUTTE, STATE OF CALIFORNIA, A "PA-C" (PLANNED AREA-
CLUSTER) DISTRICT, PURSUANT TO CHAPTER 24-29.

The Board of Supervisors of the County of Butte, State of
;alifornia, under and pursuant to Chapter 24-29 of the Butte County
ode of said County DO ORDAIN as follows:
SECTION 1. The hereinafter described area situated in
he County of Butte, State of California, shall be and it is hereby
g zoned as a "PA-C" (Planned Area-Cluster) District, and such area

hall be subject to the restrictions and restricted uses and re-
ulations pursuant to Butte County Code Section 24--126.
Said area so zoned being located in the unincorporated
area~of Butte County, Chico, more particularly described as follows:
A11 that certain real property situate in the
County of Butte, State of California, described
as follows:
PARCEL ONE: That portion of the 'rd 1/2 of the SY~? 1/4
of Sec . 4, T22N RI E MDE~M, located south of Mud
Creek.
PARCEL TWO: Being a fractional part of the Nfi~T l/4 of
the NW 1/4 of Sec . 9 , T22N, P.IE MDBF~M, lying northwester -
ly of Sycamore Drive , and E of t he E right - of -way 1 ine of
St. Hwy. 99.
PARCEL THREE: All that portion of the S 1/2 of the
SE 1/4 of Sec. 5 lying easterly of the E right-of-way
line of St. Harry. 99, and S of Mud Creek, and all that
portion of the I~? 1/2 of the r?E 1/4 of Sec. 8, lying
easterly of the E right-of-way line of St. Hwy. 99 and
N of Sycamore Dr. , all being in TZ2N, RlE MDB€M.
Containing 43.8 acres, more or less, Chico.
SECTION 2. The use and development of said property shall
b e in accord with the development plan submitted by the applicant,
Ias conditioned and incorporated herein by reference. Said condi-
boned development plan collectively consists of the following
Ildocuments:

(a} Development Plan (showing the location of buildings,
streets, parking, recreation facilities and other major features
of the project) ,
{b} landscaping Plan.
(c) Sewage Disposal Plan.
{d) Fire Hydrant location Plan.
SECTION 3. Notwithstanding the provisions of Chapter 24-
126 of the Butte County Code the following provisions shall govern
the use and development of said property:
(a) The dwellings as shown on the development plan shall
'be Limited to residential. uses and activities; and
(b) The recreation building and facilities as shown on the
development plan shall be limited to recreation, social, maintenanceE
and administrative uses and activities associated with the development
exclusively; and
(c) The storage of materials and objects around the
esidential dwellings and recreational facilities as shown o n the
development plan shall be limited to those which are necessary to,
appurtenant to and customarily associated with the residential and
recreational use of the development; and
(d) The height of all principal structures as shown on
the development plan shall not exceed a height of two (2) stories o
X35 feet; and
{e} The keeping of liv estock including horses and the
development of stables shall be prohibited; and
{f) Signs shall be limited to an identification of the

ievelopment not to exceed two (2) in number with a maximum size of
2 IISQ square feet each, except that signs advertising the development
3 ~~and sale and/or rental of units may be permitted until 85 percent
4 of the dwellings are sold and/or rented or until a period of five
5 (5) years has elapsed whichever is first. The developer shall be
6 responsible far the removal of all signs associated with the sale
7 and/or rental of said property.
8 SPCTTON 4. Tn the event the residential units are offered
9 far sale, the developer shall establish a homeowners association to
~o be responsible far the maintenance and upkeep of the utilities,
11 roads, and all other property owned in common, The developer shall
12 assume responsibility for the unsold, remaining memberships until
z3 such time as the homeowners association can reasonably assume the
14 financial responsibilities for the maintenance and upkeep of the
~5 utilities, roads and all other real property owned in common. To
16 ensure that the homeowners association is adequately formed to meet
].7 these responsibilities, the developer sha11 submit copies of said
18 homeowners association agreement to the Butte County Planning Depart
19 ment for review and approval prior to the recordation of any sub-
20 Sequent map authorizing the sale of any real property in conjunctio
21 with this development.
22 SECTTON 5. This Oxdinanc e shall be and it is hereby
2~ declared to be in full farce and effect from and after thirty [30)
24 days after the date of its passage, and before the expiration of
2S fifteen {15) days after its passage, this Ordinance shall be
26 published once with the names of the members of the Board of

~,~Supervisors voting for and against it in the Chico Enterprise, a
2 newspaper published in the County of Butte, State of California.

4 County of Butte, State of California, on the 18th day of August
