That the Butte County Code is hereby amended ° by adding•Section ~4-1.5 to read as follows: §4-1.~. Not withstanding anything to the contrary in Section ~-1 through ~}-1.3, this section shall apply in the unincorp- orated areas of the county as described in Section ~I-1;6. Within the unincorporated areas described in Section ~-1:6, it shall be 'unlawf'ul for any person owning, possessing or having custody or control of a dog to allow or permit such dog whether licensed or unlicensed, to be or run in or upon any public or private place or premises wa.thin the county other than those of such owner or custodian, except in the following instances: {a) -Upon the private premises of another, by and with the consent of-the owner of such private premises; (b) Upon a public street, sidewalk or way while under ~~the effective control of the person who has the dog under control by a leash as defined herea.n, capable of controlling and who does • 19 . maintain effective control of such-dog at all times to the end• 20 that such dog shall not be allowed to commit any act of nuisance. 21 _. . .. . _, . __ (c) Leash ~s hereby defined as a flexible rope, strap, 22 --. _ ...... _..... _.._.. cord, or chain, not over eight feet in length, of such strength and 23 . design as to be capable of restraining the dog for which it is 24 being used t•o lead or restrain. 2~ 26 ,. . 1 2 3 4 5 7 S 9 10 II 12 ].3 14 1.5 16 1'7 1.8 I9 20 Section 2. That Section 4-1..6 be added to the Butte Coun ;ode to read as follows: §~4-1.6. The urban areas to which Section ~€-1.5 is applicable are known as Paradise Pines and more specifically ~.ccording to a map on file with the County Clerk. Section 3. What Section ~-l.~ of the Butte County Code is hereby amended to read as follows: §~-l.U. Any person violating any provision of Sections !~_.l, t~-1, 1, ~}--1.3 and ~-1.5 shall be guilty of a misdemeanor, punishable by a fine or fines of not less than Fifteen Dollars (.$15) for the fa.r.st offense occurring during any license year; of not less than Fifty Dollars ($50) for a second offense during .any license year; and of not less than One Hundred Dollars (_$104) -for a third or subsequent offense occurring in said license year. Section 4. ,That this ordinance shall be and is hereby declared to be in full force and effect from and after thirty (30) days after the date of its passage and before the expiration of fifteen :(15) days after its passage this ordinance shall be published once with the names of the members of the Board of Supervisors voting for and against it in the Paradise Post a newspaper publ,ashed In the County of Butte, State of California. 21 ~: -~. ... .
