.lanuary 30, 2011 Butte County Board of Supervisors 25 County Center Road #200 Oroville, California 95965 RE: OPPOSITION TO REZONING OF AGRICULTURE LAND TO RURAL RESIDENTIAL Deaz Supervisor Chairman Steve Lambert: On behalf of the property owners in District 4 who own land that is currently zoned "Agriculture", we aze opposed to a current proposal to change the properties to "Rural Residential". Copies of a petition that are signed by homeowners opposing this re-zoning are attached validating this opposition. This letter is being sent to you on behalf of over 150 property owners that attended a Town Hall meeting in November, 2010 who are opposed to Butte County changing 4566 acres of prime agriculture land and having it changed to Rural Residential. You will f nd the signatures of property owners attached, who attended that Town Hall meeting where their many questions for the re-zoning were not fully addressed and the reasons for the re-zoning were not answered. It is with much disbelief, that a county that has so publically stated they are pro-agriculture, would be willing to lose so many acres of prime, fertile farmland not because it is mandated and not because of any statutes, but because a government representative wants to make SOME streets "compliant" that were previously "Nan-Compliant". If a person drives through any street, in any part of Butte County, there will always be houses, buildings, driveways, something that is "non-complaint" with some ordinance or some new law. We feel we have been singled out, specifically selected for this zoning change. Our properties were purchased and owned with the proper zoning at the time they were either built or sub-divided and purchased. They were compliant to the laws at the time of their existence, some of which have been owned by the same family members for generations. In the very near future, your Board will see this issue presented to you and we want you to be aware of our position that the constituents, property owners in the streets and neighborhoods being slated far this zoning change are adamantly opposed to any zoning changes made to our properties. We are very informed and well aware of the General Plan 2030 and the 4 year process that it took to finalize the document. But the issue of re-zoning specific and selected streets in our area was only presented to the General Plan Committee in late September, 2010, at the f nal stages of the General Plan process. It came about because Supervisor Lambert drove through our neighborhood and from that quick f eld trip, made a determination that we were no longer an agriculture neighborhood, but a rural residential neighborhood full of "ranchettes". Supervisor Lambert is correct in some ways, our neighborhood does not look like any 1000 acre rice farm, in Durham and Richvale; he is correct in that we do not look like the Mariani Fazm Orchards, even though the Mariani Farm owners do actually have property within our neighborhood. But there is farming, ranching and orchards being grown on the lands in the Gridley, Biggs and Palarmo areas that are being proposed for the zoning change. There are fanners raising cattle; there are people with mature walnut orchards; there aze people raising vegetable crops that are being sold, maybe not at Safeway, but at local Farmer's Markets or food packing companies. The people in these neighborhoods being selected for re-zoning are making a living off of their land; or they are augmenting their income enough to pay their property taxes so you don't have their hawse on your foreclosure list at the Assessor's Office. Same of the homeowners have had their farms for several generations while other people have purchased the agriculture property within the last 5-X O years solely to be able to live in a farming community; and purchased the property WITH the agriculture zoning. We appreciate that the Planning Department and the General Plan Commission has been reassuring us that our uses of our land will not be affected with the zoning change. As much as we believe their efforts are genuine and sincere, we also know that the true change will be in the total dynamics of what a historical agriculture neighborhood "is" and what we live with each and every day; and what a new "residential" neighborhood will become. New "residential" homeowners will question the usage of tractors; the spraying of trees; the smell of animals; the dust being created by a tractor; the storage of chemicals or diesel fuel an property. We know that this neighborhood in Gridley and Biggs does not want the re-zoning done because a group of people went door to door and asked the property owners. At no time did anyone speak to a farnner or property owner that even knew about the proposed zoning change nor has there been one person that has stated that they were in favor of the change. We didn't drive by and look, we asked the people that live in that community! We were told at the Town Hall meeting that no matter what, Butte County property owners have a "Right to Farm" act, proving that there is support of farming. So if there is so much support, why would Butte County take away agriculture farming land; why would you hinder the right to farm by changing the climate of our neighborhood, even though publicaily you state you do support farming? In California, we are facing a proposed $12.5 billion government spending slash AND the voting results unknown at this time as to whether the off-set revenueslfees will be passed in June 2011. Why pursue a costly re-zoning venture when the property owners do not want it to happen? And is it legal to pursue the change when in fact, these properties were legal previously but deemed non-compliant, illegal by Supervisor Lambert in September, 2010? We have been entrusted by the homeowners who signed the petitions to oppose the re-zoning change at the government level and to take the necessary steps wherever it will take us; either by requesting future hearings, a request for a formal voting ballot or even to the point of litigation. We are hopeful that the Board membezs will agree with the property owners that Butte County does not need to take it upon themselves to cut out these valuable and precious X566 agriculture lands when so many other counties are fighting so hard, to keep it. Fox example, Stanislaus County where a recent California 5~' District Court of Appeal case affirmed the legality of a Stanislaus County farmland mitigation program. The ruling strengthened farmland protection from development which had been filed by California Farm Bureau Federation and Stanislaus County. We need to protect and keep agriculture alive and well in our own counties as well. Please fight to protect it! Please vote to save agriculture and oppose the re-zoning of Gridley, Biggs and Palarma.
