AS FOLLOWS:

Sec~.ion 1. The Butte County Code, Section 20-66, is hereby

amended ~o read as follows:

{a} Within ten (].0) days a~ter the action by .

to the baard of supervisors any finding, action or
g condi~z.an impased by the advisory ag~zacy by fi~ing
a notz.ce of appeal with the clerk of the boa~d af
~p supervisors.
11 (b) The board of supervisors may sustain,
modify, reject or overru~.e any ruiing o~ ~.he
12 advisory agency and may make such ~indings as are
not incansistent wi~h county ordinances or the
13 Subdivision Map Act.
~4 (1) Upon ~iling an appeal, the clerk o~
the board of supervisors sha~I set the ma~f.er
~5 ~or a hearing to be he~d within ~.hirty (30)
days of the filing of the appeaZ.

( 2) Witha.n ten (~.0 ) days following the
1~ conc].usi~on of a hear~.ng held on an
appeal. by the applicant, the baard of

(3) Within seven (7) days follawing the
20 conciusion o~ a hearing upon an appeal
by an interested person adversely
21 affected, the board of supervisors shall
render its decision on the appeal.

(c) Notwithstanding anything herein to the
23 contrary, an appea~ to the condi.tions(s) may be
made by the app~.icant after the ten-day appea3.
24 period refer~ed ~o in paragraph (a) o~ this section,
within one (1) year o~ the decision by the advisory
2~ agency; and ~.he board af supervisors may act on
such an appeal. w~.th a no~.iced heari~ng where ~he
26 board of supervisors makes the followring ~indings:

(1) The propased change in the condition(s)
wi~l nat adversely a£fect or cause a modi~ication
of the findings and de~erminations made in
the environm~ntal review process; and
(2) The proposed change in the condition(s)
wi~~ not bring abou~ an incons~stency to the
genera~ p1an, or to the zo~e or to any specific
plans for the property in question; and
(3) The fac~s a~e presented giving good
and su~ficient reason why the condition{s)
in question were not appealed with~n the
ten~day p~riod; and .
(4) The parce~ map or final map has nat
been recorded.
Section 3. This ordinance shall be publ~shed ance in the
oroville Mercuxy , a newspaper printed and published in ~.he
County o~ Butte, State o~ Cali~ornia, togethear with ~.he names of the
members of ~he Board of Supervi,sars votzng £or and against the same
prior to the expiratzon of fift~en days from passage hereof.
THE F~REGOING 4RDZNANCE was passed and adopted this ~2~~
day of ~'eb~uary , 1985, at a meeting of said Board, duly called
