The Board ot Supervisors af the County o~ ~utte, State of Californi.a,
, DO p~IATN, as follows :
SECT~pN 1. Section Z4-Z9 of the Butte County Code is hereby' amended
~to read as follows:
§24-29 Actian by the Board of Supervisors.
Upon recei.pt o~ any such recomFnendata.on from the Planning Commzssi.on
which recommends that the proposed amendment be approved, the Board of Supex-
visors shall sat the matter for public hearing and sha11 give notice of tkZe time,
date, and place of sazd heaxing at Ieast ten (10) days prior to the hearing in
the same manne:r as provided for the giving o~ natice of the hearing by the Plan-
ning Carrunission as specified by SeCtion 24~27.
In any case in which the recommendation o~ the Planning Commi.ssion is
to deny the proposed amendment, the Board of Superviso~s sha11 not ba raquired
to take any further ac~ion ~hereon unless an interas~ed party shall request such
an appeal heaxing isy filing a w~itten request therefor ~ogether with the f~e
s~t by Resolution of ~he Board of Supervisors with the Clerk of the Board not
later than 5:00 p.m. on the fi~th day fo~lowing the date the Planning Commission
~'iles its recommendat~.on with the Board; provided, ~owever, that if sai.d fifth
day fa11s an a 3.ega1 holiday, tha request for hearing may be filed by 5:00 p.m.
on the next day on which the affi.ce of the Clerk is open for business. Upan
recezpt of such a reques~ for hearing, the clerk sha17. immediately ~orward a co
of said request to the Planna.~g Commission.
The Board o~ Supervisors -~ap approve, mvd.ify or d~.sapprove the ~~cam-
I mendation of ~he Planning Commi.ssion; p~ovided that any modifica~ian of the
praposed amendmen~. by ~he Board sha1.I first be referred to the Planning Commis-
sion for repo:rt and recommendation, but the ~'lanning Commissian shall not be

requirad to hold a public hearing ~hereon. Failure of the Plann3ng Commissip~
to report within forty (40} days after ~he modification is referred ta i~, shall
be deemed to he approva~ of ~he proposed modification by the Planning Commiss~on.
Tha Baard of Supervisors may imposa conditzons to tha zonang reclassification of
the property where it finds that said condztions must ~e imposed so as not to
create pro~lems inimzcal to the public health, safety, and general welfare o~ the!

County o~ ~utte. If condi~ions are_imposed to a zoning reclassifica~ion, said
conditions sha11 run wi~h the ~and and shall not automatically b~ removed by a
subs~qusnt reclassification of fihe property.
Said condxtions shall he as set forth in an agreement entered into by
the applicant and the Coun~y.
Said conditians may be removed only by the $oard of Supervisnrs after
~
reco~nmendation by the Pianning Commission. ~
SEC~~ON 2. This Ordinance shall be and 3t as hereby declared to be in ~
£ulI force and effect from and af~er thirty (30) days after_the date af i~s
passage, and before the exp~ration of fifteen l15) days after its passage, th~s
Ordinance shall be puhlished once wxth the names of the members of the Baard of
Supervisars voting for and against ~t ~n the Oroville Mercury , a newspaper
publish~d in the County of Butte, State o~ Califo~nia.

State of California, on the 15t day of October , 1985, hy the following vot :
