AN ORDINANCE AMENI3TN~ CHAPTER 24 OF THE BiIT'~~ COUN`I'X CODE
The Board of Supervi.sors of the Co~znty of Butte, State of Cala.£arnia,
DO ORDAIN, as follows:
SECTTON I. Section 24-37.10 ot the Butte Coun~y Code is hereby added
to read as follows:
§24-37.10 Nonconforming parCels o~ record.
Excep~ as otherwis~ pravided in this Chap~er or where specifically
merged under the provisions of Section 66499.~1 et seq. of the Governrnent Cade,
any legally estai~lished parcal of land or raco~d having less than the minimum
width ar frontage required for the zone in which it is located, may be used for
a perr~itted use provided that the parcel:
(a) Meet the other area or dimensiona~. standards and requiremen~s
for tha proposed use un3~ess changed by the Planning Cammission with a variance;
and
(b) Maet the requireMents of the ~utte County Heal~.h 17~partmant for
the provisions of water antt sewag~ disposal.
Side yard satbacks on nonconforming lo~.s may be reduced by five (5)
~ foot increments untiJ. at least a 75 ft. wide building anvelope a.s achieved.
' No side yard setback requirement is to be reduc~d below ten (1Q) feet. Such
' modifica~ivn of sid~ yard setbacks is to be approved in each and evary case by
' the Planning Direc~.or or ~lEputy after finding that the subject property is a
legally created nonconforming lot.
S~CT~ON 2. 'I`hi.s Ordinance shall he and i~ is hereby declared to be in
fu11. fo:rce and effect frotn and after thirty (30) days a~ter the date of its
', passage, and before the expiration of fifteen (I5) days af'ter its passage, this
