The Board of Supervisors of the Caunty of Butte does ordain as ~ollows:
5ection T. That an amendm~nt to the contract between the Baard of
Supervisors of the County of Bu~te and the Board of Ad~inistration, California
Public Emp7oye~s' Re~~rement System is hereby authorized, a copy af said
amendment being attached hereto, marked "~xhibit W," and by such re~erence
~ade a part hereof as though h~rein set out in fu17.
S~ction 2. 7he ChaYr of ~he Board of Supervisors is hereby authorized,
empowered and directed to execute said amendmen~ for and on behalf of said
Agency.
Section 3. This ordinance sha11 take ef~ect t~irty days after the da~e
o~ its adop~ion, and prior to the exp~ration of fifteen days from the passage
thereof shall be pubiished at least once i~ the Oroviile Mercury, a newspaper
of general circulation, published and circu1ated in the Cou~ty of Bu~te and
thenceforth and therea~ter the same shall be in fuli force and effect.

effective November 22, 19$0, and hereby replaced by the foll~owing para-
graphs numbered i'chrough 13 inelusive:

• Employees' Re~zrem~nt Law sha11 have the meaning as defined therein
unless oti~e~^wise specifically prova.ded, "No~'ts-aZ retirement age"

local safety members.
2. Pu~~.ic Agency shal~ participate in ~he Pubiic ~mployees' Retirement
Systetn from and af~er April 1, 7945 making i~s employe~s as herein-~
after provided, me~tbers of said System subjeet to al]. pro~isions of
the Pub19.c Employees' Re~irement Law exeept suoh as apply only on
election of a con~racting ag~ncy and are no~ prova~ded for h~:rein and
ta aZ1 a¢~endments to said Law hereafter enaeted except thase, which by
express provisions thereof, apply on.1y on the e~.ection o~ a con~racta.ng
agency.
3. Employees of Publa.c Agenep in the following classes shall become
members af said Retirement System EXC~~ti such in each sueh elass as
are exc~uded by law or thi.s agreement:
a. Loea7. Fire Fighters (herein referred ~o as local safety members);
b. County Peace Officers {incZuded as Ioca1 sat'ety members);
c. E~pioyees o~her tnan 1oca1 safety members (herein referred 'co as
].ocaJ. miscellaneous members).
~. ~n addition to the classes of emp~oyees exc~uded from membership by
said Retirement Law, the follvwing classes of ~mployees shall not
~ecome mem~~ of safd Retirement System:

5. The fraction of fi.nal compensation to ~~~ed ~or local miscel-

the reduction provided therein for service on and after January 1,
1956 for members whose serv~ce has been ineluded i.n Federal 5ocza7.

b. The fraction of final compensation to be pravidEd for each year of
credited prior and current service as a Iocal safe~y member shaXl be
determined in accordancs with Section 21252.6 of said Re'cirement L.aw

7. The following addi'cional provisions of the Public EmplQyees'
Retirement Law, whi.ch apply only upon electzon of a con~raeting
agency, shall apply ta the Put~lic Agency and its emp].oyees:
a. 5ection 20021.7 {"County Peace Off'ieers" shall be included as
1ocal safety members). Legis~.a'tion repealed said Sec'~ion
effective January 1, 197b.
b. Sec~zQn 2D021.6 ("County Peace Offic~r'~ shall ineludc any
constable, deputy constabl.e, marshal and depU~y marshal as
described in Governmen'~ Code Sectzon 20021.b).
c. Secti.on 21222.1 (5peci.al 5~ Znerease - 1970). Legis~ation
repea].ed said.Sectian effective January i, i9$0.
d. Section 2~222.2 (Special 5~ Increase - T971}. Legisla'cion

memb~rs of said Retirement Syste~n:
(1) 0.123 pereen'~ unti.l June 30, 2000 on aecount of ~he 1ia-
bility for grior service benefits. (Subject to annual
change.)
(2) ~3.OOi percent un'ci1 June 30, 2011 on account of tk~e lia-
bili~y for currenic service benefits. {Subj~;et to annual
change.)
(3? 0.372 percent until June 30, 'Ig94 on account of ~he lia-
bility for '~he benefits provided under 5ections 21222.85 and
21222.8b of said Re~irement ~,aw. {Subject to annua7. change.)
b. With respect ~o local safety members, ~he agency sha~l contribu~e
the following percen~ag~s of salaries earned as members of said
Retirement System:
(1) 0.173 pereent un~a.~. J'une 30, 2400 on aecount of the Zia-
bility for pra.or service benefi~s. (Subjeet ~o annual
char.g~. )
(~} 18.61~F percent until June 30, 2D11 on aocoun~. of the ~ia-
bilitq for currenic serr~ice benefits. (Subjec~ to annua~.

c. A rc~asonab~e amount, as fixed by ~he Board, payable in one in-
stallmen'c within b0 days of date of contrac~ to cover the costs
of administering said System as it affeats the employees of
PubZic Agency, no~ including the costs of special valuations or
of the periodic investigation and ~valuations required by 1aw.
d. A reasonable amoUnt, as fixed by the ~oard, payable in one in~
stallment as ~he oecasions arise, to cover th~ costs of special
valua~ions on account of employees of Pub~ic Agency, and cos~s of
the periodic investigation and valuations required by law.
~ i0. Can~ributions req~ired of Pub1~c Agency and its employees sha11 be
* subjec~ to adjus~m~nt by Board on aceount of am~ndments to ~he Public
E~ployees' Re~iremen~ Law, and on accoun~ of the experience under the
Retzrement Syste~ as de~ermined by t~e periodic in~estigation and
va~uati4n requ~red by said Retirement Law.
11. Contributions required of Pubiic Agency and its emp~oyees shall be
paid by Public Ageney to the R~tirement 5ystem withzn thir~y days
after the end of the period ~o whieh said contributians refer or as
may be preseribed by Board reguZation. Tf mare or ~ess than the
correct amount of con~rzbutians is paid for any periad, proper
adjustment sha11 be made ~n connec~ion wi~h subsequen~ remzttances.
Adjustments on accoUnt of errors in contributions requzred of any
employe~ may be made by direet payments between the employee and the
~oard.

2. Two certified copi~s of Ord~nance Na. 2496 appov~ng amendment
to contract.
3. Two fulZy execute~ amend~nent ta contrac~ (Form 702) {origina~
and carbon).
~he ordinance was adopted by the Sutte County Board flf Supervisors
at their r~eet~ng held Navembe~ 5, i985. The effective date of ~he a~endment
ta the contract is December 74, ~985.
