RELA~'YVE 1"0 VESTING T~NTATIVE MAPS
The Board of Supervisars of the Coun~y of But~.e, S~ate of
Ca1i#'ornia, D~ OR~AIN, as foZlows:
5ection 1. That Article X~.s hereby added Chapter 2Q of
the Butf.e County Code ta read as follows:

§20-250. eitation and Authority.
7his ordinance is enacted pursuant ~a the
a~thority gran~ed by Chapter 4.5 (commencing wit~ Section 6b498.1)
of Di~ision 2 of Title 7 of the Governmen~. Code of the 5tate of
Califnrnia {hereinafter referred to as the Vesting TentatiWe Map
5tatute), and may be cited as t~e Vesting Ten~ative Map Ordinance.
§20--251. Pur ose and Inten~..
It is ~.he purpose of this orctinance ta
establish procedures necessary for the a.mplementation of the Vesting
Tentative Map 5tatu~e, and to s~pplement the pro~isions af the
Subdivisi.on Map Act and the Subdivision Ordinance. Except as
otherwise set forth in the provisions of this ordinance, ~he provi-
sions of the Subdi~ision €7rdinance shall a~ply to the Vesting
' Tentative Map Ordinance.
§20-252. Consistency.
No Iand shall be subdivided and developed
pursuant ta a vesting tentative map for any purpase which is

inconsis~ent with the But~e Coun~y General Plan a~d any applicab~e
specific pian or not permitted by the zoning ordinance or other
applicab~e p~ovisions of the County Code.
§25-253. Defini~ions.
(a) A"vesting tentative map" sf~all mean a"tentative map" for
a residential subdivision, as defined a.n the 5ubdivisa.on
~~dinance, that sha11 ha~e prir~ted conspicuausly on its
face the WpI'C~5 "Vesting ~entative Map" at tf~e time it is
filed in aceordance wi~.h Sectio~ 20-255 he~ein, and is there-
after processed in accordartce with the provi.sions hereof.
(~) All o~her d~fini~.inns set For~h in ~he eo~~~y 5ubdiva.s~.on
Ordinance are applicable.
(c) VeSting r.~ghts apply to parcel maps. References to "ten~ative
map" shall ine~ude.~enta~i~e parcel maps, and references to
"final maP" shall incl~de parcel maps.
(d) 7he "life" of ~.hE map is the time pera.od starting wi~,h the
approval (or canditianal apprava].) of a vesting ~e~tative map
ar~d e~di.ng wh~n a final map has to be approved.
§25-254. Applica~.ion
(a) Thi.s ordinance shal~ apply only to ~esidential developments.
WF~enever a provision o~ the Subdivision Map Act, as implemer~ted
and supp].emented by the county Subdi~is~on Ordinance,
requires the fi],ing of a f.er~tati~e map or ten~.ative parcel
r~ap far a resid~n~iai deveJ.opment, a vesting te~~ative
map may ins~ead be fii~d, in accordance with the pro~isions
hereof.

{b) If a subdi~id~r does no~ seek the righ~s conferred by ~he
Vesting Ten~a~ive Map 5~atute, the filing of a vesting ~en~a-
tive map sha~l nat be a prerequisi~e ~o any approval ~nr any
propas~d s~bdivision. permit for cons~ruc~~on, or work
preparatory ~o cons~ruction.
§20-255. ~ilinq and Processinq.
A ~est~ng tentative map shall be filed in ~he
same form and have the same contents, accompanying data and reports
and sha~l be processed in the same manner as set forth in the County
Subdivision Ordinance for a tentative map except as hereinafter
pra~ided:
A. At ~~e time a vesting tentatzve map is filed it s~all have
printed conspieuausiy on i~s face the words "Ves~ing ~entative
Map. -~
B. A~ the time a vesting ~entative map is filed a subdivider
sha11 alsa supply ~E~e foilowing informataon:
{1) Ar- erosion contra~. plan which complies wi~h the
~rosion and Sediment Con~.rol Handbook, Department of
Cor~s~rva~io~, May 1981.
(2) A geo].ogic study for a3~1 properties within five hundred
feet (50C1') of ar~ earthquake fault whe~her infe~red or
active, or wi~i~.in a speeial studies zone as shown on the
Butte County General P~ar~ Seismic 5afety Element.
(3} Fire SaFety plan (water storage, bu~.].ding eonstruc~.ion
materiais, in~erior sprink~ers, vegetatian remo~al) for
all areas ~es~.gnated as high or ex~reme hazard by the
Butte County Generai P1an Saf~ty Element.

~ (~) Biologic and botanical surveys af all drainage swales,
2 creek or river ~rantages, ~ernal pools, wetlands areas
3 (marsh, mountai~ mEadow riparian), valley oak woodlan8,
4 ar areas of special biological impor~ance as mapped by
5 the Department of ~ish and ~ame, waterfowl concentratian
6 areas, anadramous and warm water fisheries.
~ (5) F~ood hazard infnrmation for any designated Zone A flood
g boundary.
g (6) ~oise survey of immediate environment (within twa hundred
1~ feet [200'] of all property iines).
X~ (7} Lighting plan.
1~ (B} Archaeolagical survey far aIl areas designated moderate
i~ or high on Butte County maps.
~~ {9) Height of struc~ures for a~y building within clear zone
15 or approach zone of nearby airport as mapped by Airport
1~ Land ~se Commission.
~7 C. At ~he ~ime a vesting map is filed, the subdivider shall have
~g rec eived prior approval on any ~equired zoning changes.
Xg D. At the ~ime a vesting map is filed, ths subdivider ~ha11 file
~p for any necessary use p~rmit an~ the app~oval of any vesting '
~1 map is contingent upon approval of said use permit.
22 §20~256. Fees.
23 A. Upo n filing a ves~ing tentative map, the subdivider shall pay
~~ the fees as adopted by resolution fa~ the filing a~d processing
~~ af a ten~a~ive map.
2fi B. Wi~ h regard ta the paymen~ of a par~icular type of fee the map
27 app rovai may eo~~ai~ a condition that the amaunt of the fee is

af building permits, the subdivider may be required to pay any
ar all of the fa~~awing fees:
{~) School fees;
{2) Drainage and/ar flood eantrol dis~ric~ Fees;
(3) Park a~d recreational fees;
(4) Wildlzfe enhancement fees;
(5) Fire pratect~on fees;
(6) T~anspor~ation fees;
(7) Road impro~ement fees;
{8) Publie s~rvice fees;
§20-257. Expira~ion.
7he appr~val or conditionai approval of a
vesting ~enta~ive map s~ai1 expire at the end of the same time
period, and sha1~ be subject to the same extensions, established by
~he Subdivisio~ Drdina~ce for the expiration of the appro~al or
conditional approval of a tentative map.
§20~258. Vesting an Approval of Vestin~7enta~ive Ma~.
A. The approval or cond~~ional approval of a vesting tEn~ative
map shali eonfer a ~ested rig~t to proceed wi~h developme~t in
sub~~antial compliance with the ordinances, policies, and
standards described in Governm~~t Code §6b474.2.
However, if Section bb474.2 vf the Government
Code is repealed, the appro~al or conditivnal a~proval of a
Vesting Tenta~ive Map s~a11 confer a ves~ed r~ght to proceed
wit~ develop~en~ in substan~ial compliance with ~he ordinances,
palicies, and sta~da~ds in e~fect at the time ~he vesting
tenta~ive map is ap~roved or conditionally ap~ro~ed.

1 B. Nn~wzthstanding subdivision "A" herei~, a permit, approval,
~ ext ension, or en~i~lement may be made canditional ar denie~
~ if any of the following are de~e~mined:
4 (1) A failu~e to do sa would place ~he residents of ~he
5 subdivisian or the immedia~e community, or bath, in a
~ condition dangerous to their health or safe~y, or both.
~ (2} The cond~tion or denial is requ~red in order to comply
g with state or federal law.
g C. The righ~s referred to herein shall expire ~f a final map is
lp not approved prior to the expiration of the ves~ing tentative
~~ map as provided in §20W257. If ~~e finai map is appraved,
~~ ~he se r~ghts sha~l las~ for ~he Foliowi~g periods of time:
13 ~~} An ini~ia~ time periad of two years. Where s~~eral final
~4 maps are recorded an various ~hases of a praject cavered
15 by a single vesting tentati~e map, thzs ~ni~ial time
1~ period shall begin for each phase when the final map for
~7 tha~ phase is recorded.
18 {2) The ini~.ial time period set forth in "C"('f) shall be
lg automa~.ically extendad by any time used for processing a
2p complete applica~ion fa~ a grading permii~ or for design
2~ or archi~,ec~ural re~iew, if suc~ processing exceeds
22 thir~y {30) days, from the da~e a comp.lete application is
~3 filed.
hq {3) A subdivider may apply far a one-year ~xtension at any
~5 time before the initial ~ime periad set forth in "C"{1)
2~ expires. If the extension a.s denied, ~.he subdivider may
2~ appea]. that denial to ~he Board of Supervisor5 within
~g fifteen (15) days.

(4} ~f the s~hdivider submits a complete appiication far a
building per~it during the pe~iods o~ time specifi~d in
subdivisions (~) through (3) herein, ~he rights re~erred
ta herein s~all can~inue u~til the expiration o~ that
permit, ar any ex~e~sion of that permit.
§20-259. Develo ment Inconsistent With Zonin --
Condi~ional Appro~al.
A. Whenever a su~divider files a vesting te~tati~e map for a
subdivision whase intended de~elapmen~ is inconsistent wi~h
the zoni~g ardinance in existence at that time, that incon-
sistency shall be no~ed on the map. Th~ Coun~y may deny such
a ves~ing te~tati~e map or approve it condit~onsd on ~he
subdivider, or his or her designee, abtazning the necessary
change in the zoning ordinance to eiiminate the incons~steney.
IF the change in the zoning ordinanee is obtained, the
approved or condi~ionally approved vesting ~entative map
shall, no~withstanding §2~-258, eonfer the vested right to
proeeed with the developmen~ in substsntial compliance with
~he change i~ the zaning Qrdinance and the map, as approved.
B. 7he rights conferred by this section sha11 be for the time
periods set forth in §2Q-258.
§20-260. Applica~ions Inconsisten~ wzt~ Curren~ Polxcies.
Notwi~hstanding any provision of ~his ardi~ance,
a property owner or his or her designee may seek ap~rovals or permits
for developmen~ which depart from the ordinances, policies, and
standards descri~ed in §2Q~258 and 2Q~254, and local agencies may
grant the5e approvals ar issue these permits to the extent that the
departures are authorized under applicable law.

Sec~ion 2. This ordinance is here~y and it is decla•red to
be in fu~l force and effect from and after thirty (3~) days after
~he date of its passage, a~d before t~e ~xpiration of fifteen (95}
days after its passage, this ardinance shall be published ance
wi~h the names of the members of the Board o~ Supervisors ~o~ing
for and against it in ~he Gf~ico EntErprise Record , a
newspaper published in the County of Su~te, S~ate of Californ~.a.
