This Chapter is enacted pu.rsuanl ~o authori~y con~~erred ~y Sec~ions 476, 510~ 252$3. arid 252~37 of the Health and Safe~y Code of th~ Sta-~e a~ Ca1.i~arnia: Sec. 37-3. :~indings. Sec. 37-5. Citi~s,~. The provis~.ons of this Chapter may apply withir~ any city in ~he Coun~y whez-~. the Governinc~ Baard thereaf consents to County health administ~ation for that city pursuant to Sectian 476 of the Hea7.th and Safety Cade of the State of Califo~nia; and the schedule of fees authorized by this Chapter shall be applicable in the area in which thc: Health Officer of this Co~nty en~orces a~V sta~ute, ordcx~ q~arantine, rule, o~ rec~ulatian p~escribed by a S~.ate Hea~.th Off.~cer or departmen-t rel.atinc~ to ~ub~~c health. Sec. 37 -5. Pe~n~ts Requ~~ed. A. No person shall operate a faci~ity within Butte County ~~r the undergrou~d storage of any hazardaus s~bstance, unl.ess by authori'ty of a va~.~.d, unexpired, and unrevoked Permit to Operate issued to the owner purs~ant to the provisions o~ ~~c. 37-8 or 37-9. B. A person aperates a~acili~y in v'io~.atian of ~this sec~ion if the person, ~aithout a required Permit ta Operate in e~~eat, supervises, inspec-~s, directs, o~ganizes, rnanages, or controls, or i.s in any way ~esponsible ~or or ~.n cha.~ge af the facility for which th~ permit z.s requ~red. C. Compl.iance wa.th ~he provisions o~ this Chapte~ does not consta.tute or excuse co~npliance with any a~her provision of law app~icable to installation., maintenance, or operata~on o.f a facility, or to the use ~or which the undergraund storage tank or ~acil~ty is installed, aperated, a~ maintained. Sec. 37-8. Permits To Operate New Facili~ies. No underground storage tank o~ facil~ty shall b~ ~.nstal.led after Janua~y ~., 1986, t~nless a Permit ~o Operate is first obtained ~rom the Health Off~cer. A Perznit to Opera~e shall not be issued f~or any underground storage tank or faci.lity insta~led a~ter ~Tanuary 1, ~986, unless the tan.k or facili~y meets the require- ments identi~ied in Sec~ion 25291 o~'-~he Health and Safety Code. Sec. 37 -9. Permi-ts to Operate ~xis~.a.ng Facil.ities. A. For every underground stora~e tank installed on or be~o~e January i, 1986, and u5ed for the storage of hazardous substances, all of the r~aui~ements identified in Sc~ction 25292 of the Health and Saf_ety Code m~s~ be met prior ~o the issuance of the Permit to Operate. Sec. 37-10. App~ication Contents. An appli.cation for a Permit to Operate shall be ~i1ed with ~he Health D~partment or~ a fo~n p~escribed by the Health O~f_icer, and shall be acco~npaniecl by any fee set by the 3oard o~ Supervisors. Sec. 37-11 Issuance. The Health Office~ shall act upon the appl.ication not later than 90 days after ~he date it is accepted as complete, unless (1} thE ap~licant has filed with the Health Off_icer ~„r~itten notice of a reauest and received writ-ten appxaval for extension of time w.ithin which action is taken an the ~7round5 tha~ additional time is requix'ed -~o prepare or presen.t plans or other infarmation, obtaan zoning varianc~s a~ other pe~ni.ts, ar znake other corrections remedying inconsistencies wi~h the p~ovisions o~ this Chapter; or (2) the Health Of~ic~~ has on file a written notice fron~ a public agency showing jus~t cause for an exten.sion af tzme, and has anproved an ex~ension o~ time pursuant th~reto. Sec. 37-~12. Term. The ~erm of the Permit to Operate shall be fi~cre vears, at which time ~the permitte~ ~nay apply for reissuance pursuant to Sections 37 --7 and 37 -~.1. - ~ - Sec. 37-13. The Perm~t ~a Operate sha~~ contain a comp~ete description of the ente~~ris~ fo~ which it is issued, ~he date of issuance and date o~ expira~ion, a de5cription o~ the me~hod of monitor~ng, and a~~ condi~ians upon wl~ich the permit has been issued. A cony of ~h~ p~rmit sha11 be kept on the premises and shal~ be made available to the ~~ealth Offic~r upon demand. B. As a~andition of any Permit ta Operate, the permi~tee shall comPlete and ~i1~ ~aith the Health Officer an annual report which details any changes in the usage of any underqround storage tanks, ~ncluding the s~orage o~ n~w hazardous substances, cl~an~es in ~onitorin~ ~rocedu~es, and unau~harized release occurrences. Sec. 37~I~. Fees. Each appl~ca~ian shall be accom- panied by the .fees n~~sc~ibed by resolution of the noa~d o~ Supervisors. No permit shall be granted or renewed unless the applica~~ pays said fees. The total ~ee shall i~clude a S~ate surcharqe, the amount o~ which shall be de~err.~ined b_y the Le~islature annuall_y, to cover the costs of the State ~M1Jater Resources Cont~o~ Boaxd zn carrying ou~ its responsibilities under Chapter 6.7 of the Hea~~h and Safety Cade. Sec. 37-15. Trans~erability. A. Every operator of an undergraund storage ~acility shall manitor the facil.ity; ~sing the method specified on the per- mit for the £acilit~~. Records shal~. be kept in sufficient detail. to enable the Hea.~-~h O~f~cer to determine ~.hat the ape~-a-~ar has under~aken aY1 mani-toring ac~ivities required by the Permit to ppera~e. B. If the o~erator is not the owner, the owne~ shall provide a copy af the permit ~o the aperator, en,te~ into a written contract with the aperator which requires ~he operator to monitor the ~acili~ty as set ~'orth ~.n the permit, and provide the operat~r wath a copy o~ ,Section 25299 of the Heal-~h and Safe~y Code. The awne~ shall noti~y the Fiealth 0£~icer of any change af operator. Sec. 37 -~-7. Inspecta~ons. rn accordan.ce with Sections 25?_88 and 25289 0~ ~he Health and Safety Code, the Health Offkcer sha~.l inspect every underground storage tank ar facility at least once every three yc~ars. The Health Officer May r~q~ire ~he perfnattee to em~loy, periodically, sp~c~.al inspectors ~o conduct an audit or assessment of the permittee's ~aci~.ity ta determine compl.iance with -this Chapter and the ~rovision o~ Chapter 6.7 of the Health and Safety Code. Sec. 37-~.8. U~authorized Release. Any unautho~ized release shall be recorded and reported in, accardance.with Sectians 25294, 25?.95, and 25~296 of the Health an.d Sa~e-ty Code o~ Cal~.:~ornia. _ ~i -- ~ Sec. 37-19. Cleanup. Cleanup of unautho~ized 2 releases sha11 be in accordance with Section 25297 of the Hea~th 3 and Safety Code. _ ~ 5ec. 37-20. Repai~s. Any physical modification~ includ s inc~ ~ep~acemen~ of an underqround storage tank or fac~.li~y, sha~1 g be unde~taken in compl.iance ~ai.th ~his Chapter and al~ provisions 7 0~' ~.aw applicable to the use for which -~he unde~gr~~nd starage g tank o~ ~acility is installed, opera~ed, or maintained. g Sec. 37 -2~. Revoca-~ion. ~p A. An.y Permit to OPerate issued pursuant to this I1 Chatate~ may be revaked during its te~ upon one or mo~e of the ~2 .fol~.ow~.ng grounds : 13 l. An unautharized release sub~ect to Sec~ion 25Z95 ~.e~ af_ the Health and Safety Code. 15 2. Madi~ica-~~on.s have been ~nade to the underg~aund 18 storage tank or facility in va.olation af the ~,~' Permit to Ope~a~e. 18 3. The nermi~-~ee has vialatcd one o~ more ~9 condi~ions u~o~. which -~he pc~rmit has been issued. 20 S. The Health c~f_ficer may revoke a Permi~ -ta Ope~ate 21 by issuina and serving u.~on. a perzna.ttee a written notice of 22 r~voca-~ion. The no~ice sha3.~. state the reasan (s} ~or revocation 23 and a copy o~ this Chapter sha11, be appended ta it. The revoca- 2~ tion becomes ef_fective 15 days after the date of_ sc~~vice, unless ~g the permittee files an appeal within. ~he time and zn accordance 2~ w~.th the p~avis~ons establ~shed by the County. Sec. 37-22. Abanda~me~t. No person shall abandan an underground storage tank or clase or tempo~arily cease oneratinc~ an underground storage tank except as provided in. Secta.on 2529~ of the Health and 5a~ety Code. Sec. 37-23. Viola~ions. A viola~ion a£ any of the p~ovisions o~ this Chapter or failure to camply wi.th any of ~he rec~ulato~`y recruirements .of_ this Chapt~~ is punishable in accor- d~nce with the provisian of Sect~on 25299 o~'-~he Heal.th and Sa~ety Code. Sec. 37-24. Admin~.s~ration. The Health Off_icer is charrted with ~riinary responsibility for the admina.stration o~ thi.s Chanter and znay develop thos~ forms, Pxacedures, and repor~s reasanably necessar1 to administer this Chapter to achieve its purnoses. Sec. 37-25. Sus~ension af Chapter, I~ a ci~.y, pursuant to H~alth and Safety Code Sect~.on 25283, adopts an ardinance by which the city assumes r~sponsibi~.ity for .imple- rner~tinc~ Chap-~er 6.7 (commencznc~ with 5ection 2528Q) of Division 20 of the I3ealth and Safety Code, the provisions o~ this Chaz~ter sha~.l be suspen.ded as ~o that city and as to all undercrround storage faci~ities for hazardous substances located within the jurisdictiona3. limi~s o~ the citv for so iang as the city's ordinance is in ef:~ec~. - 3 - i 2 I 3 4 5 6 7 8 9 10 31' 12 13 14 z5 18 17 18 19 2a 2I 22 23 24 25 28 5ec~ion 2.
