AN QRDINANCE OF THE BOARD ~F SUPERVISORS OF THE COUNTY
OF BUTTE, STATE OF CALZFORNIA, CALLING AND PROVTDING
FOR A SPEC~AL C~UNTY CHARTER ELECTION FOR THE PURPOSE
OF SUBMITTING TO THE QUAL~FIED ELECTORS OF SAID
COUNTY THE PROPOSITION OF WHETHER OR NOT AN AMENDMENT
TQ THE CHARTER OF THE COUNTY OF BUTT~ SH~ULD BE
APPROVED; FIXZNG THE DATE OF SAID ELECTION AND THE
MANNER OF HOLD~NG THE SAME .AND T~E PROCEDURE FOR
V~TING FOR OR AGAINST SAID AMENDMENTS; PROVIDING FOR
NOTICE OF SAID ~LECTION; AND CONSOLIDATING SAID
SPECTAL C~UNTY CHARTER AMENDMENT ELECTTON WITH ~HE
GENERAI~ ELECTTON TO BE HELD QN NOVEMBER 4, 198b
The Board of Super~isors of the County of Butte, State of
Cali~orn~a, DO ORDAIN, as follows:
Section 1(a}, A special eL~ctian is he~eby called to be
held and consalidated with the General Election on Novemb~r 4, 1986,
~or the purpose o~ submitting ta ~he quali~ied voters of the Caunty,
~he proposition o~ amending th~ Charter o~ the Caunty of Butt~ as
fo~lows:
That Section 9 of Article IV of the Bu~te County
Charter be amended to read as £allows:
"Section 9. Vacancy ~n elective county o~~ice.
(a) W'henever a vacancy occ~rs in an e~ective
eoun~y or tawnship off~ce ather than the Board
of Supervisors or offiee o£ the County Sup~r-
intendent of Schools, said Baard shall fill
such vacancy in the manner provided by general
law."
This amendmer~t sha].1 become effective at Noon on January 6, 1987.
Section 1(b). At sa~.d e~ection, said proposition shall be
submitted to the qualified voters of ~he County in the form of the
foll.owing county measure, to ~nrit:

Section 1(c}~ A special elec~a.an is hereby further called

1986, for the purpose of submitting to the quali~ied vo~ers of the
County, the propositian o~ arnending the Charter a~' the County of
Butte as fa1.l.ows :
That st~bsect~.on {b) ~s hereby added to ~ection 9 of
Artic~e IV of ~he Butte County Charter to read as
foZlows:
"Section 9. Vacancy in elective county affice.
(b) Whenever a vacancy occurs during ~he term
of office o~ ~he Coun~.y Superin~.enden~ of
Schoals, th~ Coun~.y Board of Educatioza shall
~il~. such vacan.cy in the manner provided by
law.'~

Section 1(d). At said elec~ian, sa~d proposition shall be
submitted to the qualified voters af the Caunty in the form of the
fol7.o~nring county measure, ta wit :
"Shall the Butte County Charter lae amended
to provide that the county board of educa~ian Y~S
rnay ~iil a vaca~cy that occ~rs during the
term of office of the county superintendent
of schaols? NO

1 Section 2(a). This Board does hereby submit to the
2 qualified electors of ~he County at the spec~a~ caunty charter
3 a~endment election amendments to ~he Charter af ~he County of
~ Butte, and hereby designates and refers to said measures in the
~ ~orm se~ ~arth in Section 1(b) and Section ~{d) here~na~ter pre-
g scr~bed for use at the special county charter amendment election.
~ Section 2(b). The speeial county charter amendment
g election is con~olida~ed with the General E~ection and shall be
g held and co~ducted, and the vates thereat received and canvassed,
1~ and the results thereo£ made and the ~esuLts thareaf ascertained
~1 and determined as herein provided, said eleetion sha~l be held as
j2 nearly as prac~icabZ~ in can~ormity with ~he electian laws of the
X3 State of Cai~ornia and only qualified voters of the County may
X4 vote thereat.
ir~ Section 2(c}. The specia~ county charter amendment
1~ election hereby called shal~ be and is hereby consolidated with
I7 the Generai Election ta be held thraughout the County on
i8 Novemb~r 4, 1986, all as required by and pursuant tv 1aw; and the
iQ elect~on precincts, polling places and voting boaths shall in
20 every case be the same and there shall be only one set of e1.~ction
21 officErs .in each of said precincts. The e~ectior~ prec~.ncts,
22 ballots and absentee bal7.ots, polling pl.ac~s and afficers of
23 E~C-~Ct.l~Il for ~.his special county charter amendm~nt election shall.
24 be as estab~.ished ~o~ the General Election.
25 Sectian. 2(d). The provisians of Article 3 of Chapter 2
26 of D~.vision 4 0~ the Elections Code shall apply to said special
27 county charter amertdment election and the County Counsel shall

~ prepare an analysis of said county measure ~n the manne~ provided
2 in Electians Cade Sect~on 3781.
3 Sect~on 2{e). The returns of said elec~ion shall be made
4 out ana signed by the electian of~icers and shall be by them
5 dep~sited with the County Clerk, together with the ba~lats cast at
6 said election and the said returns shaii b~ canva~sed or caused ta
7 be canvassed in the same manner as provided by law for General
$ Elections.
9 S~ction 3. Pursuan~ ~o Government C~de Sections 23722
10 and 237a9, the Clerk is hereby ordered to have the proposed charter
11 amend~ent, as contained in Section 1(a) o~ this ordinance, published
12 ten (10) times on ten (10) di~ferent days in the fallowing named
13 newspape~, ~o w~t: Chi.co Enterprise Record ,
i4 which the Soard hereby ~inds and declares to be a daily newspaper
X~ of general circulatian printed, published and circulated in the
lfi County. The first such publication shali be as soan after the
17 adoptian of this ordinance as is poss~ble and in no eve~t later
18 than the 15th day after the ~nactment af this ordinance. The
19 last s~ch pub~icatian sha11 occur no later than seven~y-four (74)
20 days prior to the election.
21 Pursuant to Government Code Sectin 2373~,
22 the C~erk is hereby ordered to have this ardinance published fiae
23 (5) di£ferent days, prior to the herein se~ election, in the
24 following named newspaper, to wit: Chi f
2~ wh~ch the Board hereby £inds and dee~ares to be a daily newspaper
2~ of general circulation printed, published and circulated in the
27 County.
