The Board of Supervisors of the Coun~y of Butte, State ofl

Code o~ said County DO ORDAIN as follows:
SECTION l. The hereinafter described area si~uated in I
the County of Bu~.te, State o~ California, shall be and it a.s ~,
hereby zoned as an PUp (Planned Unit Deve~.opment) ~istri.ct, and '
such area shall. b~ subjec~ to -the rest~ic~ions, restricted uses, '
and ~eg~latinns pu~suant ~.o Bu~~e County Code 5ection 24-~126.

SECT~ON 3. Notwithstanding ~he provisions of Chapter
24-126 0~ the Butte County Code the following pxovisions shall
gavern the use and development af sazd property:
(a} Lots 1~7 ~s shown on the development plan shall be
limited to single-family residen~ial uses and activities; and
(b) Th~ sto~age af materials and abjects a~ound
j~esidential dwell~ngs to be located on ~o~s 1-7 as shown the the
develapment p3~an shall be limited to thase which a~e necessary to,
appux'tez~.ant to and custamari~y associated with th~ residentia~. use
of the developmen~; ancl
(c} The height o~ all principal st~uctures to be
lncated on lats 1-7 as shown on the bevelopment ~lan shal~ not
exaeed a height o£ two (2) stories o~ 35 feet; and
(d) The keeping o~ up to 28 horses and the developrnent
a~ private stab~.es sha~l be a perma.tted use on the common a~ea
pa~cel; and
(.e) The kaep~.ng of livestock andl or horses on lots
1-~7 shall be p~ohi~bited; and
(f) Signs shall be limited to an identificati~n of the
development not to exceed tc+ro {2) in number with a maximum size of
50 square feet each, except that sa.gns advertising ~he deve~.oprnen~

SECTTON 5. In the event the residenti.al lots a~e
offered ~o~ sale, the developer shall establish a homeowne~s
association ta be responsible ~or ~he main~kenance and upkeep o~
the util.ities, raads, and a~.~ other p~operty awned in com~non. The
developer sha1~. assuzne xespansibzlity for the unsol.d, remaining
memberships until such time as the homeowne~s association can
reasonab~.y assume the financial responsibi~.ities far the ~naintenancE
and upkeep of ~he uti~.i~~.es, roads, and a~~ other real property
owned i.n coznmon. To ensure that the homeowners association is
adequately formed to meet these rasponsibilities. ~he developer
sha~l sub~nit copies of said homeowne~s association agrc~ement to
the B~tte County Planning Departrnent for rc:view and approval p~ior
to the recordation of any subsequen.t map autho~izing the sale o~
any real property in con3unction with this develop~nent.
SECT~ON 6. This Ordinance shal.~. be and it is h~reby
declarecl to be in ~ull force and effect from af~ter -~hirty {30)
