In the event the residenti.al lots a~e offered ~o~ sale, the developer shall establish a homeowne~s association ta be responsible ~or ~he main~kenance and upkeep o~ the util.ities, raads, and a~.~ other p~operty awned in com~non. The developer sha1~. assuzne xespansibzlity for the unsol.d, remaining memberships until such time as the homeowne~s association can reasonab~.y assume the financial responsibi~.ities far the ~naintenancE and upkeep of ~he uti~.i~~.es, roads, and a~~ other real property owned i.n coznmon. To ensure that the homeowners association is adequately formed to meet these rasponsibilities. ~he developer sha~l sub~nit copies of said homeowne~s association agrc~ement to the B~tte County Planning Departrnent for rc:view and approval p~ior to the recordation of any subsequen.t map autho~izing the sale o~ any real property in con3unction with this develop~nent. SECT~ON 6.
