The Board of Supervisors of the County of Butte, State ot
Califarnia under and pursuant to Chapter 24-29 of the Sutte County
Cade of said County DO ORDAZN as follows:
SECTZON 1. The hereina~ter descr3bed area sa.tuafi.ed in
the County of Butte, State of Cali~arnia, shall be and it i~ here:
zaned as a PUD (Plann~d Uni.t Deve~apment) District, and such area
sha11 be subject to the restrictions, rest~icted us~s and ~egula-
tions pursuant to Bu~.te Caunty Code Sectian 24-126.
Said area sa zoned be3ng 1.acated in the unincorparated

12 SECTTON 3. Notwzthstanding the provisions of Chapter
~3 24-126 of the Butte County Code the ~ollowing prov~sions shall.

~~ be limited to residential uses and activitzes; and
~~ (b) The storage of materials and objects around the

(d} The keeping of Iivestock including horses and th~
development of stables shal~. be prahibz~.~d; and
(e} Signs shall be limit~d to an identi~ication o~ th~
develapr3nent not to exceed two ( 2) in nurnber w~th a maximum size of
50 square f~et eaCh, except that signs advertising th~ development
and sale and/or rental of un~ts may be permitted until 85 percent
o~ ~.he dwel~.ings a~e sald and/or rented or until a pe~iod of five
{5) years has ~lapsed, whichever is first. The develope~ shall be
responsib~.e ~or the removal. of a11 sa.gns assoc.~ated with the sale
and/or rental o~ said property.
SECTTON 4. In the event the residential units are
o~~ered fo~ sale, th~ developer shall estab3.ish a homeowners' asso-
ciation to be ~esponsib~e for the maintenance and upkeep o~ the
utili~.ies, roads, and all other property owned in common. The
developer shall. assume responsibility fo~ the unsold, remaining
memberships until such time as the hor~eowners' association can
~easonably assume the financial responsibilities ~or the main~.e-
nance and upkeep ot ~.he utilities, raads and a11 other real.
property in cammon. To ensure tha~. the homeowners' associ~ation is
adequately formed to meet these responsibi~ities, the developer
shall submi~. copies of sazd homeowners' association agreement to
the Bu~te County Planning Department for review and approval prior
to the recorda~ion af any subsequent map authorizing th~ sale af
any real p~operty in conjunction with th~s development.
SECTION 5. This Ordinance shall be and it is he~eby
declared ta be i~n fu].~ force and effect from and after thirty ( 30 )

days after the date of its passag~, and before the expi~ation of
fi~teen (15} days afte~ its passage, this Ordinance shall be
published once w~th the names of ~he members ot the Board af
Superviso~s vot~ng tor and against it ~n the Chico Enterpr~se, a
n~w~paper pub~ished in the Coun~y of Butt~, State of Cali~brnia.
PASSED AND ADOPTED by the Board of Supervisors of the
County of Butte, S~ate af Ca~ifornia, on the 7th day o~ October,
~986, by the fol~ow~ng vote:
