AN ORDINANCE AMENDiNG SECTION 24-29
OF THE BUTTE COUNTY CODE
The Board o~ Superv~sors o~ the County o~ Butte, Sta~e of
Cali~ornia, DO ORDA~N, as ~o~~ows;
Section X. That Sec~ion 24T29 0~ the But~e County Cod~
is hereby amended to read as fol~ows:
Sec.24-29. Action by ~he board o~ supervisors.
Upon receip~ of any such recommendation ~rom the planning
comnaiss~on which recommends that the proposed amendmen~ be
approved, the clerk o~ the board of supervxsors shall set the
matter ~or publ~c heari~g and shall give not~ce o~ the time,
date and p~ac~ o~ said hearing at least ~en (~0) days prior to
the hearing ~n the same manner as provided ~ar ~he giving of
notice o~ ~he hearxng by the planning commiss~on as spec~~ied
by sectio~ 24-27.
In any case in which the recammendat~on of ~he planning
commission is to deny ~he propased a~e~dment, the board o~ super-
v~sors sha~l not be requ~red to take any ~ur~her action thereon
unless an interested party sha~~ request such a hearing by ~iling
a written reques~ ther~~or w~th ~he clerk o~ the board not later
than 5:00 p.m. on the f~~th day ~ol~owing the da~e the planning
comm~ssion ~iles its recommendation with the board; provided,
however, ~hat if said fifth day fa~~s on a Iega~ holiday, the
request for hearing may b~ filed by 5:00 p.~. on the nex~ day on
which ~he o~~ice o~ ~he clerk is open for bus~~ess. Upon rec~ipt
of such a requ~st for h~aring, the c~erk sha11 immediately ~orward

a copy o~ said request to the planning commission.
The board o~ supervisors shall take action upon the
proposed amendment wi~hin ninety (90} days from the da~e of receipt
o~ ~he planning commission's init~a~ recom~nendation. If no actio~
is ~ake~ within said n~nety (90} days, the proposed a~endmen~ sha11
~ be deemed den~ed.
The boa~d of superv~sors may approve, madi~y or disap-
prove the recommendation o~ the plann~ng com~ission; provided ~hat
any modifica~ion of the proposed amendment by the board shall first
be re~erred ~o the pla~ning commissian ~or report and recammendation,
but the pla~~~ng commission shall not be required to hold a p~bl~c
hear~ng th~reon. Fa~l~re o~ the p~anning comm~ssion ~o report
wi~hin ~or~y (40) days a~~er the mod~fication is re~erred ~o ~t,
shaii be deemed to be approval o~ the proposed modi~~cation by the
planning commiss~on. The board o~ superviso~s may impose condi~ions
to the zaning reclass~~~cation o~ the property where it ~1AdS that
said conditions mus~ be imposed so as nat ~o c~ea~e problems in~mical
~o ~he public health, safe~y and gene~al weZfare o~ ~he County of
Bu~te. I~ conditions are imposed to a zoning reclassificatio~, said
condi~ions sha~l r~n with the land and shall no~ a~~omat~cally be
removed by a subsequent reclassif~ca~ion o~ the property.
Said co~di~ions shall be as set for~h in an agreemen~ en~ered
into by the app~~can~ and the county.
Sa~d conditions may be removed only by the board o~ supervisors
a~ter recom~.endation by ~he plann~n~ co~mzssion.
Section 2. Th~s o~dinance is hereby and it is declared ta
be in ~u~l ~orce and e~fec~ from and af~er thirty days after the
da~e o~ ~ts passage, and b~~ore the e~piration a~ ~i~teen days
