AN ORDINANCE AMENDTNG SECTTON 24-48
OF THE SUTTE COUNTY CODE
The Board o~ Supervisors o~ the County o~ But~e, Sta~~ o~
Cali~ornia, DO ORDATN, as ~o~.l.ows:
Sec~ion 1. That Section 24-48 of the Butte Ca~nty Code
is hereby a.mended to read as follows:
Sec. 24--~8. [Sale--Right a~ appeal upon denial;
procedure.~
The determi.na~ion of the pla~.n~.ng commission shall
be ~inal unless a written appea~ z.s ~iled wi~h the c~.erk o~
~he board o~ supervisors by 5:00 p.m. on ~he eigh~h eal.endar
day ~ollowing the date of ~he determination; provided, that
i~ said eigh~h day falls on a Iegal holiday, the appeal may
be f~ied by 5:0~ p.m. on th~ next day which the o~fice o~
the clerk is open ~or business. The c~.erk shall immediately
~o~rward a capy of said appeal to the planning co~nmission.
No use perm~.t may be issu~d until sa~.d t~me ~or appea3. has
expired, nor may such pe~mi~ be issusd in the event an
appea.l is ~~led, un~i~ the board o~ supervisors acts on
said appeal. Within ~en (10) days o~ the date of filing a~
an appeal, the clerk o~ the board o~ supervisors shall set
a date for a hearxng. Sa~d hearing shall be advertised and
noticed pursuant to secti.on 24-46. The board af supervisors
sha~~. decide such appea].s maki.ng the f indings required i~a
section 24--~7 above. The board o~ supervisors h~aring sha].J.

o~ supervisors. The decision of -~he board of supervi.sors
shal~ be final and not subject ~o review except by a court
of competent juxisdiction.
Section 2. Th~.s ordinance is hereby and it is decl.ared
to be a.n full faree and effect from and a~ter thirty days a~ter
~he date o~ ~.ts passage, and be~ore th~ expiratiorz o~ fifteen
days a~~er its passage, this ordinance shall be published an,ce
with the names of the members o~ ~he Board o~ Supervisors
va~ing fox a~.d against it in the Orovi 1 Ze Mercur
newspaper published a.n the Cov.n~y a~ Butte, S~a~e o~ Cal.iforni.a..
