AN ORD~NANCE AMEN~~NG SECTION 24-52
OF TH~ BUTTE COUNTY CODE
The Board o~ Supervisors o~f the County o~ Butte, State o~
Cal.ifornxa, DO ORDAZN, as ~07.l.ows :
Section ~. That Sectzon 24-52 of the Bu~~te Coun~y Code
is hereby amended ~o read as ~allows:
5ec. 24-52. [Appeal.]
The determination of the planni.ng commission shall
be ~~.nal unless a written appeal is filed with ~he clerk of
~he board o~ supervisors by 5:00 p.m, an ~the e~.ghth calendar
day ~o1~.owing tha da~e o~ the det~rminati.on; provided, that
if sa~.d eigh~h day ~alls on a~egal ho~.iday, the appeal may
be ~iJ.ed by 5: d0 p.m. an the next day which ~he o~~i.ce of
the clerk is ope~ ~or bt~.siness. The clerk shall immedia~el~r
~orward a copy of sa~.d app~al to the p~anning commission.
No variance may be iss~ted until said time ~or appea]. has
expzred, nor may such variance be xssued in the event an
appeaY ~.s ~iled, unti~ ~he board o~ supervisors acts on
said appea].. W~.~hin ~en (l~) days o£ the date o~ ~i~.ing o~
an appeal, ~he clerk of t~e baaxd af supervisors shall set
a date for a hearing. Sa~d hearing shall be adverta.sed and
noticed pursuant ~o sec~ion 24-51(b) herei.n. The board of
supervisors sha].]. decide such appeals on the grounds set ~.n
section 24--49 above. The board hear~.ng sha~~ be conducted
de novo provided that a11 appl~cations, papers, maps, ex-
hibits and staff recommendations made or presen.ted ~o ~he

planning commissio~ may be considered by the board o~
supervisors. The deciszon of the board of superv~sors
sha~~ be ~inal and not sub~ect ~o review except by a court
o~ compe~en~ jurisdiction.
Section 2. This ordinance is hereby and i~ is declared
~o be in ~ull force and effect ~rom and a~~er th~r~y days after
the date o~ its passage, and before the expira~ion o~ ~if~een
days af~er i~s passage, this ord~nance shall be pub~ished once
w~~h the na~es o~ the members o~ the Board a~ S~pervisors
votz.ng ~o~ and aga~.nst i~ in the Orovi7le P'lercury
newspaper published in the County o~ Butte, ~tate of Ca7.i~arnia.
