That S~c~ion 2~-22 0~ the Butte County Code is hereby amended ta read as ~ollaws: Sec. 26-22. [Permits.] {a} Perma.ts required. Wi~hin ~one A an ~he offa.cial map, separate develapmen~ permits are requzred for aJ.l new construct~.on, substantial improven:~ents a~d other deve~opments, including the placement of mar~ufactured horr~es. {b) Applicati.an. To obtaa.n a permzt, the applicant shall f~rs~ fi~.e an application the~ef ore in writing on a forrr~ ~'urnished ~'or tha~ purpose by ~he department of pub~ic woxks. Every s~ch application shall: (~. ) Iden~if~r and describe the work ~o be covered b,y the permi~ ~or which application is made. (?) Describe the ~and on which ~he propased work is to be done by Yo~, block, tract and house and st~eet address, or similar descra.ption that wi11 readily identify and d~finitely loca~te the proposed bua.~ding or work. (5) Be signed by the permit~ee ar h~s authorized agent who may be required to submit ev~dence to indica~e such authori~y. (6) Within desagna~ed flood plane areas, be accompan~ed by elevat~ons o~ ~he lowest floor or in th~ case of ~loodproofed nonresidential s~ructures, the elevation ~o which it has been ~loodproofed. (7) Give s~ch other informatian as reasonab~y may be required b~ the public wo~ks department. (Ord. No. 2343, §~, 3-18-83). Sec~ion 2. That Section 26-24 of the Butte County Code is hereby amended to read as ~ollows: Sec. 26-?4. [Same~Criteria ~or evalua~ion.] The public ~orks departmen~, in reviewing a~~ applications for ~~w construc~ion, substantial improvemen~s, pxefabrica~ed buildings, placement o~ manu~actured homes and ather development(s) (as defined in section 26-29 of this article) will: (A) Obtain, rev~ew and reasonably u~i~ize, i~ a~ai~able, any regulatory flood elevation data f~am federal, state or other sources, until such other data is provided by ~he Federal Tnsurance Admin~stration ~n a~lood insurance s~udy; and require, w~thin areas des~gnated as Zone A on the o~fic~al map, that the ~ollowing performance -2- 1 2 3 4 5 6 7 $ 9 10 11 12 I3 14 15 16 17 : 18 19 20 21 22 23 24 25 26 27 28 standards are met: (1) The lowest ~irst elevation (to incl~de basement) o~ ~ew residen~ial structur~s, be eleva~ed to or abo~e the r~gulatory flood elevation. {2) The ~owest eleva~ion (to include basement o~ nonresidential structures} be eYeva~ed or ~~ood-proofed ~o or above th~ xegula~ory ~~ood el~vation; [or together with attendant utility and sanitaxy facili~ies, shal~: (i) be floadproo~ed so that below ~he base flood elevatian ~h~ structure is watertigh~ with walls substantially impermeab~e ~o the passage o~ wa~er; {ii) have structural components capable o~ xesisting hydrostatic and hydrodynamic loads and effects o~ buoyancy; and (iii) be certa~ied by a registered pro~essiona,l enga.neer or archi~ec~ ~hat the d~sign. and me~hods o~ constructa.on are in accordance with accepted s~andards o~ prac~ice for meeta.ng ~he prova.sions of this paragxaph. (D} Be designed or anchored to p~event the f~o~a~io~, collapse or lateral movement of the structure o~ portions o~ ~he struc~u~e due ~o f~aoding. (E} Assure that in regard ~o manufac~ured homes, speci~ic anchoring r~q~iremen~s are: (1) All manufactured homes a~d add~tio~s to manu~actured homes shall be anchored to res~st ~~otation, collapse, or la~eral mov~ment by one { 1. ) o~ ~he following r~e~hods : (a) By providing an. anchax~i.ng system designed ~o withstand horizontal forces o~ ~zfteen (15) pounds p~r square foot and uplift ~orces o~ na.ne ( 9) pounds per squ~.re ~oot; or (b) By the anchoring o~ the unit's system, desa.gned to be in compli.ance to the d~partment o~ housing and deve~apment manu#'actured home construc~ion and sa~e~y standards. (Ord. No. 2343, §1,3-1.8-83). (F) Assure el~c~rical, heating, ven~iJ.ation, p~umbing, and air condi~ioning equipment and other service faci3.ities shal.l designed andJor located so as to prevent wat~r ~rom en~ering or accumula~ing within the components during condztions o~ flooding. -4- 1 2 3 4 5 6 7 8 9 za lI 12 13 I4 15 16 ~7 1$ I9 20 21 22 23 24 25 26 27 28 {G) Assure encroachments, zncluding fill, new construc~ion, subs~antial improvements, and other development sha~~ be prohibited in any floodway unless a technical evalua~io~ demanstrates that ~he encraachme~ts wi11 not result in any increase in flood 1eve~s during the occ~rrence o~ the base f~ood discharge. Sect~on 3. That Section 26-29 0~ the But~e Caunty Code is hereby amended ~o read as fol~ows: Sec. 26-29. Definitions. Unless spec~fically de~ined below, words or phrases ~sed in this article sha~l be in~erpreted so as ta g~ve ~hem the same meani~gs as they have ~n co~nmon usage and so as to give this ar~icle i~s most reasonable app~ications: (1) Areas of special flood hazard: The land within a community subject to a one (1) per cent or greater chance of ~~oodang in any given year. This Iand is identified as Zone ~ on the o~~ic~al map . (2} Development: Any man-mad~ cha~zge to improved or unimproved real es~ate, including but no~ l.imited to buildi.ngs or ather s~tructures, mining, dredging, filling, grad~ng paving, e~cavata.on or dr~~.lang operat~.ons. {3} Flood: A temporary rise in stream's f1.ow or state that res~~.ts in water over~Iowing its banks and inundating areas adjacent to ~he chann~~, or -5- 1 2 3 4 5 6 7 $ 9 10' Il 12 I3 14 15 16 ~7 I$' 19 2[~ 2I 22 23 24 25 26 27 28 an un~sual and rapid accumulatio~ o~ runo~f or sur~ace waters ~rom any source. (4} F~oodproofing: Any co~binat~on o~ s~ructural and nonstruc~ura~ additions, chang~s or adjustments ta structures, including utizaty and san~tary facili~ies, which would pr~c~ude the ent~y o~ wate~. S~ructural componen~s shall have the capabi~ity af resasting hyd~ostatic and hydrodynamic loads and the ef~ect o~ buoyancy. (5) Lowest Floor: The lowest floor of the lowest enclosed area(~ncluding basement). An un~inished or ~lood resista~t enclosur~, usab~e sole~.y for pa,rking a~ vehicYes, buil.dzng access ar storage, ~n an area other than a basemen.t area, is nat coz~sidered a building's lowest fl.oar, provided ~that such e~closure is not bui1~ so as to render the structure in vi.ala~tion of thc applicable non-elevation design requirer~ents of this ordinance. (6) Manufact~red home: A structure, transpor-~able a.n one or more sections, whicYa is bui~~ on a permanen~ chassis and designed to be used wa.th or wi~hout a permanent foundation when connec~ed to the required uti~.ita.es. Tt does not ~nclude recreational. vehicles or travel traa.lers on site far more than 180 days. (7) Manu~ac~ured home pa~k (subdivision): "Manu~actured home subdivis~.on" means a --6- 1 2 3 4 5 6 7 8 9 10 1~ 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 parcel {or con~iguous parc~ls} of ~and which has b~~n div~ded into t~o (2) ar more lo~s ~ar rent or sale and the placement of manu~actured homes. {S) Regu~atory fload eleva~io~: The water surface elevation af ~he one hundred-year flood. (9) Structur~: ~ walled and roofed str~cture, inc~uding a gas or Isquid storage tank tha~ is principa~~y above the ground, ~ncluding but without lim~tation to buildings, f actories, sheds, cabins, manuf actured homes and other s~milar uses. (~0) Substan~ia~ zmprovement: "Substantial improvemen~" means any repair, reconstruc~ian ar ~mpro^~er3ner~t of a str~xcture, the cos~ of which equals or exceed fi~ty (50} per cent of the market value of the structure either: {a} Be~ore the improvement is star~ed; ar (b) If ~he struc~ure has been damag~d and zs being restored before the damage occurred. For ~he purposes of this defi.ni~ion "subs~antial improvement" is considered to occur when the first alteration of any wal1, ceila.ng, floor or other st~ucturaJ. part of the build~ng comm~nces, whether or nat that a~tera,tion a~~ects ~he externa~. d~.mensions of the s~ructure. (11) One hundred-year ~lood: The condition of fYaoding having a one (1) per cent chance af annual occuxrence. {Ord. No. 2343, §1, 3-18-83) Section 4. This ordinance is h~reby and i~ is declar~d to b~ in ~ull force a~d e~fect from and after thirty (30) days after the da~e o~ its passage, and be~ore the exp~ration o~ ~ifteen (15) days after its passage, th~s ardinance sha1~ be published one with the names a~ ~he members of the Board of Supervisors voting ~or and against i~ in the Orov-~lle Merccary-Regis~er , a newspaper published in the Coun~y o~ Butte, State o~ Cali~orn~.a.
