3 DO ORDAZN as follows:
4 5ECTION 1. That the Development Agreement with Mathews Readymix Inc.
5 in the form attached herto as Exhibit ",A" and incorporated herein by this
6 reference is approved, this Board having found that the provisions of the agree-
'~ ent are consistent with the Butte County General P1an.
8 SECTION 2. The Chairman is authorized to axecute the Development
9 greement in the form attached.
10 SECTIOI3 3. Following complete execution of the Development.Agreement,
11 the Clerk of the Board of Supervisors sha11 cause a copy thereof to be xecorded
lz ith the Butte County Recorder.
].3 SECTION 4. This Ordinance shall be and it is hereby declared to be ln

are i~regu~.ar in detail, and low poin~s a~e commonly accupzed
by epheuterai ponds that ~ontain a highly plastic sticky clay.
These pQnd areas are the locations of the app~oximately 15% o~
the area that is covered wi.th vegetatian as mezzti.oned above in
"~NV~RONM$NTAi, ZMPACTS".
The area surrounding the pro~ecC site varies cons3derably.
The property due east of the project site to St. Hwy. 70 is
farm land ~rith no s~ructures. The land due north is an area
that was~dredger ~ailings and was simi~.ar to ~he said projec~
site before the materiai was removed for fill rnaterial for the
earth filled dam kmocan as the Oxovi.IZe bam. The area due west
is a river of ~rater ~omm.only known as the Feather River. Tha
average e~.evation of the project site is ~.ZO feet above sea
1 eve 1 .
The species o~ wildlife which inhabit or freq~uen~. ~he
project site are ~hpse which are typical ~.o the rnck piles,
such as several varities of ducks, rabbits and various rodents,
