AN ORDiNANCE ADD~NG CHAPTER 19A TO THE
BUTTE COUNTY CODE DECLARING A MORATORIUM ON
ISSUANCE OF ON-SITE SEWAGE DISPOSAL PERMITS IN
THE VILLA VERONA AREA OF BIITTE COUNTY
The Board of Sup~rvisors o~ the County of Butte, S~ate o~
California, DO ORDA~N, as ~o~lows:
Section 1. That Chapter 19A ~s hereby added ~o the Butte
Caunty Code to read as follows:
CHAPTER 19A
MORATOR~A
ART~CLE I - Vi.l~a Verona
§19A-1. Sewage Disposa~. Pe~mi.ts
No on--site sewage disposal permits shall be issued for
n~w cons~ruction within the boundaries o~ the ~il1a Verona area
located in ~he unincorpora~ed territo~ry o~ Butte County as shown
on the map at~ached here~o as Exhibi~ "A" (hereina.~ter :referred
to as the ("MORATORIUM AREA"),
§19A-2. Exemptions
The mora~orium upon the issuance o~ On-Site Sewage
Disposal Permi.ts declared in Sectian 19A-~. sha].]. not prohi.bit the
• issuance o~ a permit to recons~ruct, repair, abandon or opera~e
an existing sys~em. This exemption does not permit expans~on ~or
ex~sta.mg systems to ~.ccommodate more intense use. Final
I authority for approval o~ any ex~mptions from the moratorium is
~ereby de].egated to the State af California Re~iona7. ~Pater
Qua~Yty Control Board.

No new building permits shall be issued for projects

§19A-4. Urgency Fac~s
This ordinance is an urgency ordinance far the
immed~a~e preservation o~ the public p~ace, health, and safe~y,
and sha~l ~ake effect immedia~ely in accordance w~th Sec~ion
25123 of the Government Code o~ ~he State af Cali~ornia. The
~acts constitu~ing such urgency ar~:
A. The shallow groundwat~r and clay soils in the
MORATORIUM AREA pr~vent the proper operation of
~eaching and percolation spstems for on~site s~wage
disposal.
B. A Iarge number o~ on-si~e sewage disposa~ systems
in the MORATORYUM AREA a~e failing and e~posing the
publ~c to human fecal ma~ter.
C, Dense soil, high w~nter groundwater, sma11 lots and
poor sur~ace drainage make ~he MORATORIUM AREA
unsuY~able £or deve~opment ut~lizing on-si~e sewage
disposa~ systems.
D. Con~inued ~nstallatio~ and use a~ on-s~~e sewage
d~sposal systems in the M~RATOR~UM AREA wi~~ increase
the threat ~o publ~c health and may unreasonably impair
future water quality.
§19A-5, Conf~~c~ Ordina~ces
A11 ordinances or parts of ord~nances or resalutions
~n conflict herewi~h are hereby repealed ~o the extent o~ such
con~~ict and no further.

5 §19A-7. R~peal Tntentions
~ ~t is ~he ~n~ent of the Soard o~ 5uperv~sors ~o repeal
~ ~his moratorium when co~lection and treatm~nt works which
g el~mzna~e the existing or po~en~ial heal~h hazard in the
g MORATORIUM AREA are co~struc~ed and in operation.
10 ~ection 2. This ordinance shall ~ake e~~ect imm~dia~ely,
11 and before the e~piration of ~ifteen {~5) days after ~ts passage,
12 this ordinance sha~l be ~ublished once with the names o~ the
~3 members of the Board of Superv~sors voting ~or and agains~ i~ in
