Section 24-303 of the Butte Coun~y Code ~s heraby a~ended I i ~ to read as frallows: 6 §24-303 FIND~NGS AND INTENT 7 The Baard of Supervisors has found that for the health, safety and g welfare ofc tha peopl.e of the County tlzat it has o~ten become necessary, for the g car~ of persons who by r~:ason of oxd age, disease (ea.ther men~a~ or plzysical), 14 infirma.ty or othe~ causa, are unable, unassisted, properly to manage and take !i x~ care af themselves o~ would bene~it from familial assistance, to allow mobile ~2 homes to be pl.aced on smal.ler parcels than present Countv codes or orclinances lg permit so that such persons wi11 not inave ta be institut9.onalized, but ra~her 14 ~an reside n~ar their close relatives who can he1.p cara for them. Tha ab~li~y ~5 to care for one~s close relative wi.l~ not only resu~.t in better care for citizens 16 but wi11 aiso negate in many situations the necessity foz public assistance ~7 which many citizens #~ind degrading and damaging to the pride of the persons con- ~$ cerned and thair immediate re~atives. This wi11 also provide pxivacy and digni.~y 1~ far the zelative as weli as andependence, af w~ici~ these people axe deserv'ing. 20 Section 2. ~ection 24-344 of the Sutte County Code is hereby amended 21 to read as fo3.Xaws: 22 §24-304 PROVISIONS FOR TEMPORARY MOBI~E HOMES 23 No~withstanding any provision to the contrary in this chapter, a second 24 unit, a mobile hozne certified under the Nationa~ Mobile Home Cons~ructian and 25 Safety Standards Act o~ 1974, may' be placed on any ~.egal lot i.n ALL residential ~6 zones subject to ~.ha fal~owing condita.ons: _~_ Z ! 2 3 41 I 5 6 7 8 9 ~Q I1~ 12 13 ~,4 15 16 i~ 18 19 20 2Z 22 23 24 25 28 (a) Condit~ons: l. A usa permi~ has been approved ~y the B~tte County Plann~ng Comm~ssion or Butte County Board of Supervisors in accordance with Butte County Code Sections 24-43 thraugh 24-48 inclus~ve. 2. Occupancy oF the ~obile ~s limited to a close friend, or a re~ative by blaod or marriage and affidavit attest~ng to the relataonship of ~he involved parties shall be submitted wi~h tha use p~rmit application. 3. No rent is charged to the accupant of the mobila home. 4. The mobi~e home may be owned by either the ownez of the pxoperty on which it is placed, or by the person rasiding therein. 5. ~he site shall e~ther be sarved by sanztary sewers o~ af sufficien~ a~ea and dimension to provide for the prope~ installatian, ma~ntanance and expan- sion of a septic tank system of sufficient size and design ta serve both dwe~lang~ I units . 6. The placernent of the mobile hame shal.l not be subject to the additi.pnal site requi~ements of the residential zoning district. 7. The mobile home is a tempora~y use on tha property, accessory to I the primary res~.dence and shal.3. not be placed on a permanent foundation. (b) The use pezmi~ granted her~under shall be for the term of two ,years. The PXanning Commission upon appl~cation o~ the property owner and w'ithou~ a p~b~ic hearing, may' grant an extension of such use permit for periods not exceeding one year. In the event that the applicant who ~.s xesiding within tlze mobile home or the convantianal residence for any reason moves to another 7.oca~~.on or is deceaseci, then s.n that ~vant the use permit granted herein automatical.lq expires and the mobile home skzal~ be remaved wzthin one hund~ed twenty (120) days. ~n ~he event the mabile home is not removed within one -z- ~ 2~ 3~ 4 5 6 7 $ 9 ~0 ~.1 12 3.3 14 ~5 1$ i~ 18 19 20 21 22 23 24 25 26 hundred twen~y (120} days pursuant to ~he terms af the use permit the Caunty shall remove said mobile home and store it at the owner's exp~nse. The County may require either a depasxt or bond sufficient to cover the removal expense at the ~zme the application for the use permxt is approved. ~'he amoun~ of such deposit ox ~o~d shall be determin~d at the ~ime of the hear~ng for the use permit ~ha request fox tha use permit sha11 be signed by both the applican~ and the relative or other pezson to receive or rende~ assistance, and shall provide that Butte County is givan a right to entzy on the p~opezty for the removal of (and ~ the right to remova} the mobile home, an~ store same at the sole cost and expense' ~o~ th~ applicant. '~he use permit may' be revoked i~ any af the terms or conditions of such permit are vio].ated or if any' acts or omissi.ons of the permittee in con- nection with the use authorized by said permittee cons~.itute a public nuisance. 5ectaon 3. Section 24-304.1 of the $utte County Cpde is hereby de~eted in its entirety. 5ection 4. This Ordinance sha1~. be and it is hezeby declared to be in fu~.l force and ef~ect fram and after th~rty (30) days after the date of its passage, and before the expiration of ~ifteen {15) days a~rter its passage, this Ordinance sha11 be published once with the namas of the membars of the Board of Supervisors voting ~ror and agains~ it in tha Qro~ille Mercury , a newspapex pub~.ished in the County o~r Butte, State of Ca~ifarnia.
