AN O~DIN.ANC~ AMENDING CHAPTER 24 OF THE BUT2E COUN'I`Y COD~
The Boa~d of Supervisors o~ the Coun~y of Butte, Sta~e of
California, under and pursuant ta Chapter 24-29 of the Butta County Code of
said County, DO ORDAIN, as follows:
SECTION 1. Section 24-I96 0~ the Butte County Code is hereby
added to read as follows:
§24-136 "W~"' Watershad Protection
Purpose and ~ntent
'~his district classi~ication is intended to be utiJ.9.zed as an
overlay zone wha.ch shall be overlaid onto other zoning distric~s to
estabJ.ish tlze boundaries of a watershed, and ~or the followir~g purposes:
1. To protect the County's surface and ground water resources.
2. To reduce future goverr~mental costs by preserving public
water supplies.
3. '~o recognize the essentially publac nature of the land and
water resources of a watershed, and that their con~inued vitality is
di~ect~.y zelated ta the socia~ and economic wel~rare of the County and its
communities.
4. To protect the public hea~.th, safety and welfare by requiring
such addi.~.ional restrictions upon the use of 1.an.d as are necessa~y to retain
the natural baXance and integrity p~ a watershed.
'~I 5. To recognize the uniqueness o~ each watershed by' basing tha
selection a~ the most effec~ive measures for their protection upon an
evaluat~.on of the soils, climata.c conditions, topography, vegetation,
drainage patters, and any ather specific condz~a.ons unique to the vratershed.

6. To allow the County or its ci.tizenry to identify watersheds
wh~~e a natural or man-inducecl imbalance in the enva.~ronr~ental system occuzs
and provide a means for repairing ar restoring the natura~. ~unctions of
these watersheds.
Adoptian of Pola.ca.es, Procedures and_Standards
1. In zecognition ofr the unique Characteristics o~ each
watershed and the need tor individ~xa~. evaluation, the pa~icies, proceduzes
and standards for each watexshed shall be adop~ed on an indivi.dual basis by
' reso~ution of the Board of Supervisors follow~.ng the adoption of an
ordinance es~ablishing the "W~" zone for a watarshed.
2. At such time as the Planning Commission holds a public
hearing in accordance with the provi.sions of Section 24-27 of this Chaptar
for the purpvses of establishing a"WP" Zone, the proposed resol~tion
establishing pol.ici.es, procedures and standards shall be attached as an
exhibi~ to the request to astablish the zone. The resol~tion sha11 be
subject to the same notice and hearing rec~uzremen~s as the zoning amendment,
including the requ~.remant ~or a deposit to cover the estimated publishing
fee for the resolution, a.~ required.
3. At such time as the Plannizzg Com~nission shall render its
decision in the form o~r a written recommendation to tk~e Board of Supervi.sors
in accordance with the provisions of ~ection 24-28 of this Chapter on the
establishment of a"WP" zone, thEy shall also render their recommendation on
the contant of the resolution and may recommend the inc~usion, deletion o:r
any change whatsoever in the cnntents of the resolution.
4. At their ~earing he~d in accordance with Section 24-29 of
this Chapter, the Board o~ Supervisars shall set and heaz both the

~. establis~nent of the "W~'" zoning distri.ct an~ the resoluta.on. The
2 provisions of Section 24-29 as they relate to ~he establishment o~ t~e
3 zoning district, including raferral back to the P1annS.ng Comrr~ission, shal~
4 also ~elate to the adoption of the resolution establishing polic~.es,
5 procedures and s~.andards.
6 5. Fo1.lawing the Boa~d of Supervisors' approval of the "WP" zone
7 and the ~~solutian Establishing po~.a.cies, procedu~es and standards, a
8 certified copy af sai~ resol.utzon shall be a~.tached as an exhibit to the
9 ordinance creating the "WP" district.
7.4 Appli.cation
1~ l. The "W1'" appearing after a zoning designation on the
12 Comprehensive Zoning Plans inc~icates that the propex~.y so classified is
~3 subject to the provisions of this Article an addit~on to ~.hose o~ the
~.4 under~ying district anto which it is overlaid.
15 2. The regulations af the "WP" district specified within the
~.6 Article and as specified in a resalution o~ the Board aft Superviso~s
~,7 adopting policies, procedures and standa~ds shall prevai~ over any
~,$ confl.icting reguiations ot any dist~ict onto which the "WP" district is
~g overla~d..
2p SECTION 2. The hereina~ter described area situate in the County
2]. of Butte, 5tate of Califo~nia, s~al~ be and it is hereby zoned as an overlay
~2 WP {Watershed Protection} zone, and such area shall be subject to the
23 restricti.ons and restricted uses and re:gulations pursuant to Butte County
24 Code Section 24-196.

membars of the Board of Supervisars voting ~or and against ~t in the Enterprise
Record , a newspaper published in the Caunty of Butta, State of
Ca~ifornia.
