AN ORDINANCE AMEND~NG CHAPTER 19A T~ THE
BUTTE C4UNTY CODE DECLARTNG A MORATORIUM ON
ISSUANCE OF ON-SITE SEWAGE D~SPOSAL PERMZTS IN
THE VILLA ~TER4NA AREA OF BUTTE CDUNTY
The Board o~ Supervisors o~ the County of Butte, Sta~e o~
Ca~.a.fornia, D4 OR-AIN, as ~a1].ows:
Section 1. That Sec~ion 19A-1 of Chapter 19A o~ the But~e
County Cod~ is hereby araended to read as follows:
§~9A--1. Sewage Dxsposal Permits
No on-~s~te sewage disposa~. permits sha].l be issued ~or
new cons~ructa.on within the boundar~es o~ the Vi11a Verona area
located in the unincorporated territory o~ Butte County as shown
on the map attached hereto as Exhibit "A" {hereina~ter re~erred
to as the ("AMENDED MORATORTUM AREA") and as more part~uclarly
described i.n Exhfbit "B" at~ached hereto.
Section 2. That Section 19A--4 0~ Chapter ~9A o~ the But~e
Coun~y Code is hereby amended to read as follows:
§19A-4. U~gency Facts
Thxs ord~,nance is an t~~gency ordina.nce for the
immediate preservati.on o~ the public p~ace, health, and sa~ety,
and shall ~ake s~fect i.mmediately in accordance with Section
25~23 0~ the Gavernm~nt Code o~ ~he State of Ca~i~ornia. The
~acts constituting such urgency are:
A. The sha~.low g~a~undwater and clay sozls in. the
AMENDED MORATOR~UM AREA preven~ ~he proper operation o~
leaching and percolati.on systems for on-site sewage
disposal.
B. A~arge number of on-site sewage dispasal sys~ems

in the AMENDED MORAT~R~UM AREA are faiX~ng and exposi~g
~he public to human ~ecal ma~ter.
C. Dense soil, high winter groundwa~er, small lots and
poor sur~ace drainage make the AMENDED MORATORIUM AREA
unsuitabXe for development utilizing an-site sewage
disposal sys~ems.
D. Continued ins~alla~xon and use o~ on-site sewage
dxsposal systems ~n the AMENDED MORATORIUM AREA wil~
increase the threat to public heal~h and may
unreasonably impair ~u~ure water quali~y.
Section 3. This ordi.nance shall take ~~~ect ~mmediately,
and be~ore the e~pi~at~.on o~ ~if~een (15} days a~ter its passage,
this ord~nance shall be pub7.ished once with the names o~ the
members o~ the Board of Supervisors vating ~or and agaxns~ i~ in
~he Oravi~le Merc~r _ , newspaper
published. in the County of BL1ttE~ State o~ Ca~.ifornia.
