Section 2b-3.1 of Artacle T of Chapter 26 of the Butte 4 County Code is hereby amended ~o xead as ~o~lows: ~ "Section 26-3.I. Additions and Deletions. 6 Sectiion 301(h} o~' ~h.e Uniform Bui~ding Code {"UBC") is hereby '] amended by the add.ition of the following paragraph 12: 8 12. Agr~.cu7.tux'a~ bui~di~gs as defined in section 4~42. of the UBC. 9 Before construction of an agr~.cu~.~ura1. bu~ld~.ng, ~he property 10 owner sha~.l ob~aa.n an agr~cultural building exemption permit from the I1 bu~.~.ding of £a.cial . 1~ ~'his exer~ption permit sha11 descr~.be ~he s~ze and ~ype of ~3 canstruction of ~he proposed building, its use, occupancy, estimated cos~ 14 and location on the property. Before issuance, the building off~cial sha1~ 15 determine tha~ ~he proposed building is an exempt agricultural building 16 and the proposed location ~is ~.n .confarmance w~~k~ zoning and se~back 17 requirements. 18 ~f, in ~l~e ~u~ure, any change in c~se or occupancy of the 1~ agricultural building is made, building permits and approval of ~he bux~.ding 24 official shal]. be xequa.red. . _ 2I -Section 303{d) "of the UBC is l~ereby amended - _ .. _ . _ . . 22 ~o read as fol.l.ows: 23 (d) Expiration. Every pex'ma.~ ~ssued by the build.ing official ~ under the provisions of this code sha11 expire ~y limi.tation and become ~. nuZl and voa.d a£~ex one qear from the date of issuance of such permit. 2$ Pro~rided, however, that if the bua.ld~.ng or work authorized by such permit 1 was comtnenced prior to such expiration and no changes ~ave been made or 2 wi11 be made in the or~gina~ glans and specifications for such building 3 or work, a renewal permit may be applied £ar within 30 days of the original 4 permit expiration .date. i~ application for a rEnewal permi~ has nat been 5 made wi~hin said 30 days or if work was not com~nenced pursuant ~a fihe 6 original permit, a new permit application and fees wi~~ be required. 7 Section 303 of the UBC is hereby amended by ~he addition of 8 paragrag~ (f) as ~o~~ows: 9 (f) A permit may be transferr~d from ~he original permittee to 30 ana~~er person due to change in ownership or contractor. I1 ~ection 304(a} of the UBC ~s hereby amended to r~ad as follows: 12 Permit ~ees, plan ch~cking £ees, filing fees, and reanspec~io~ 13 fees and refunds sha~1 be as spec~fied and adopted by ~he Butte County Board 14 of Supervisars. i~ Sec~ion 3Q4(b),(c),(e), and (f) of ~he UBC are hereby deleted." 18 Section 2. Sec~~on 26-6, of Artic~e :~ of Chap~ er 2b of the Butte ~7 County Code is hereby amended to read as ~O~~OWS: 1$ "S~ction 2b-6. Violations and Pena~~ies. Record.s; Notice of Water Course Alteration. 1. The Depar~r~en~ of Public [dorks (DPW) will maintain a record of elevation information required hy Section 26-22(b)6. 2. The DPW wiil notify, in riverine situations, adjac~nt communities and the Departmen~ of Water Resources (DWR) prio~ to any altEration or relocation of a wa~er course, and wi11 submi~ capies o~ such noti~ication to The Federal Insurance Administra~ion. 3. The DPW wi11 assnre that the flood carrying capacity w~thin any alt~r~d or rElocatEd portion of any wa~ercou~'se is main~ained." Section 4. This ordinance shall he and ~.~ a.s hereby decl.ared ~o be a.n ~'u11 ~'orce and e~fect from and after thirty (30} days after the date of its passaga, and be~ore ~he expiration o~ fifteen {15) days after its passage, this ordinance shall be pub3~ished once with the names of ~he members o~ tne Baard af Sugerviso~s voting for and against it in the Oroville Mercury __.__, a newspaper publxshed iz~ the County of Butte, State of Cali.forn~.a.
