I Sec.13-6. Permit Applicat~an.
2 (a} Application ~or Permit. Each applica~ion for a

~ by the proper~y owner or his author~zed agen~ to the
~ Director on a form furnished ~or ~hat purpose sha11

$ by an appl~ca~ion ~or env~ronmen~al review and ~he
g ~ees wh~ch are required by the But~e Cauntp

Engineexing p~ans and specificaicaons, when requ~red
puxsuant ico See~ ian 13-6 {b }(10 ), shal~. be drawn ico
sca~.e upon reproducib~e paper or mylar and sha~.I be o~
su~~ic3.ent clarity to fndicate ~he na~cure and exl~ent of
the work proposed and show ~.n detai~. ~hat it w~.1I con~orm
to the provisions of thxs Aricie~e and a~.1 r~levanic laws,
ord~.nances, xules and regu~a~ions. The ~irst sheet of
each set o~ plans sha11 give the 1oca~ion of lche work and
~he name and address o~ ~he owner and the person by whom
~hey wer~ prepared.

Sec.13-14. Engineering Geolog Re ort.
The eng~neer~ng geology report, when required pursuant ~o
Section 13-6(b)(10), sha11 ~nc~ude an adequate descr~ption
o~ the geolagy of ~he sit~, conclusaons and
recommendat~ons regarding ~he e~f ect o~ geologic
conditions on ~he proposed grading, and
opanions and recommenda~ions coner~ng the adequacy of
sites to be developed by ~he proposed gradang.
Recommenda~ions i~cl~ded ~n the repor~ shall be
incorporated in the grad~ng plan or spec~~ications.
Sec.13~1~. Erosion and Sediment Control P1an
The erosion and sediment con~rol plan, when r~quired
pursua~~ ~o Sec~ion 13-6(b}(~0), sha~l con~orm to the
standards o~ this Ar~ic~e and shall con~ain ~easures to be
incorporated ~nto ~h~ proposed work. The plan shalt
con~ain a description of temparary and permanen~ measures
for:
(~.} Protection o~ na~ive and naturalitied vegetataon.
(2) Minimi~ing disturbance or removal o~ vegei~~.~ion.
{ ~) Revege~aic3.on o~ disturbed areas.
(4) Drainageway protec~ion.

(a) General.
When a permit is requ~red pursuant ~o this Ar~icle,
~he grading plan and erosion controX p~an applicable
to the pro~ect sha11 conform to the standards set
forth herein.
{b) Sedimen~ Con~rol.
(1) Sedrment caused by ~he grading project sha~l be
re~ained on the si~e to the greates~ e~~ent
~easible. The maximum permanent rate o~
sediment loss a~~er complet~on of ~he project
sho~ld no~ exceed ~he na~ural eros3on rate which
occurred pr3or ta ~he grad~ng prajec~. I~, ~n
~he opinion of ~he Direc~or, excessive erosion
occurs ~rom the project, ~rosion and sed~men~
con~roX measures sha11 be zmmedia~ely
implemented ~o reduce eroszon to a~lowable
lev~~s.
{2) ~f requ~red by the D~rec~or, sedimen~ basins,
s~diment traps, or similar sed~men~ con~rol
measures, temparary ar permanent, sha~l be
ins~al~ed pr~or ~o c~earang and grad~ng
opexa~ions. Upon complet~on of construction and
stab~lizat~on o~ so~~s, a11 ~emporary erosion
control facilities shall be removed from ~h~

Sec.13-17. Violations.
(a) Revoca~~on o~ Perm~~. Whenever any alleged vzo~at~on
o~ the terms of a grading permi~ is brough~ to ~he
a~tention of the Director, he shal3, after
determinang ~hat a vio~ation does exis~, g~ve the
permattee a wr~~ten no~ice to comply w~th~n five (5)
days. Said noticE sha11 be sen~ by regis~ered ma31,
re~urn receip~ request, and ~he ~~ve~day period sha11
commence wath the date o~ ~he ma~ling of ~he notice.
I~ th~ permi~~ee does not comply w~thin ~he ~ive-day
period, the Director sha11 r~quest the question of
the revocation o~ ~he grading permit ~o b~ placed on
~he agenda o~ the next r~gu~ar Planning Commiss~on
meeting. Any grading permit may be revoked by ~he
PXann~ng Cammiss~on in the same manner as speci~ied
for use perm~ts ~n Sect~on 24~62 0~ this Code.
(b) Public Nuisance. Any grading, clear~ng or tree
removal in v~ola~ion o~ the terms af th~s Ar~icle or
any perma~ issued hereunder is hereby declared ~o be
a publYC nu3sance and may be abated ~n the manner
provzded by law.
{c) Remed3es Cumu~atxve. The remedies provided ~n this
Artic~e are cumulative and not exclusive. No~hing 3n
this Ar~icle bars any 1egaX, equi~ab~e,

Sec.13-18. Special Res~rict3ons and E~ce ~~ons.
{a) Grading shall be prohibited duri~g ~he per~od from
Oc~ober 10 through Apri~ 10 unless, in the op~n~on

sua~able, and adequate and efficient erosaon con~rol
measures have been installed. The Direc~ox may
require complete winteriza~ion o~ ~he project by
Oc~ober 15.
{b) In ~he even~ a~l per~anent erosxon and sedimen~
contro~ measures for ~he project have ~ot been
instal~ed pr~or to Sep~ember ~5, the perm~~~ee shall
submit plans ~or ~emporary erosion a~d sed~men~
con~rox measures for review and appraval by the
D~rector. The ~empo~ary control plan shall b~
subm~t~ed by Sept~mber 15 ~o allow for completion of
activitaes prior ~o October 15.
(c} Clearxng o~ vegetation, tree removal, grad3ng or
