OF CAI~IFORI~iIA, PURSCJANT TO CHAPTER 24-29.
`~he Board of Superva.sors of tha County of Butte, Sta~e of
California, under and pu~suant to Chapter 24-29 of the Butte County' Code of
said County, DO ORDAII3, as follo^ws :
SECT~ON 1. Section 24-149.5 of the Butte County Code is hereby
added to read as fo~lows:
24-1.49.5 Residential-Pro~essiana3. Office District
(A) Purpose and Intent
It a.s tha puxpose o~ the Rasidential-Professional Offica or R-P
zone to allow development of professional o~rfices in the vici.nity of
coznznercial zones, multiple-family resident~al zones, and along major
thoroughfares, and to pxeserve ~he desirable chaxacteristics of ~he
zesidentia~ environment inso~ar as possible whzle permit~.ing selec~ed, non-
reszdential uses.
(B} Fexmitted Uses.
'~he ~rallowa.ng are the principa~ permitted uses in the R-P Zone:
(1) Uses perrnitted in an R-1 District as set aut zz~ Section 24-
13Q. ]..
(2} Offices occupied by accountants, architects, den~.ists,
physicians, engineers, attozneys, drugless practitioners,
electro~ogists, geologi.sts, optometrists and psychologists.
(3) No prov~.si.on of thzs section shall be construed as permitting
tha starage of comsnercial vehicles in excess of one and ane-
half ton ca~ry~ng capacity, exc~pt priva~.e passeng~r--type
vehicles.
(C) Accessory Uses.

The following are the accessory uses permit~ed in an R°P ~one:
(1) Accessory usas as set out in Section 24-130.2 fox R-1
distric~s, when the primaxy land use is s~ngle-family
resident~al.
(Z} Non-co~nmercial s~orage azeas not to Exceed 15% ot the gross
~loar area o~ the office or residential st~ucture.
(D) Conditional ~ses.
The following uses are permit~ed in the R-P Zone subject to
obtaining a~se Permit in each case:
(1) Uses permitted in an R-2 Zone as set out in Section 24-130.1.
(2) Offices for other professinns the ~lanning Commissian
determines are simi~ar to thase enumErated in Section B{2).
(E) Development 5tandards.
The fol.lowing minimum requzrements sha11 be observed, except whexe
specifically' modified for conditzonai uses.
{1} A~ea Requirements. Tha bui~.ding site area requi~rements in
the k2-P Zone are as ~o~.lows:
(a) Minimum lot width for all lots except corner lats,
sixty-~ive (65) feet at the setback 3.9.ne.
(b) Minimum lot area, six thousand five hundred (6500)
square feet for aIi lots, except corner lots.
~ (c) Minimum corner l,ot width, seventy {70) feet at the
setback l~.ne.
(d} Minimtxm corner 1.at area, seven thousand {7000) square
feet .

(e) Maximum aggrega~e building coverage, twen~y-fiv~ percent
(257,) on i~dividual parcels o~ up to two (2) acres,
fifty percent (507) coverage on parcels of two (2) acres
o~ more.
(2) Haight Requirements. The maximvsn heigh~ requirem~nts in ~he
R-P Zone are as follows:
(a) Fo~ main bu~ldings, ~hir~y-~ive (35} feet.
(b) ~or accessory buildings, twenty-five (25} feet.
(3) Yard Requirements. The following yards are required in the
R-P Zone:
(a) Front Yazd - Professional Use. The minimum required
front yard shall be twenty (20) feet f~nm the property
Iine, but in no case Iess than fifty-five (S5) feet ~rom
the centerline of the adjacent road.
(b) Front Yard - Residential Use. The minimum requirad
front yard shall be twenty (20) feet from th~ proper~y
line, but in no case less than sixty-five (65) feat from
the centerline a~ the adjacent road.
(c) Side and Rear Yards. The minimum side and ~ear yards
sha~1 be five (5) feet. In the event the parcel abuts a
residential zone or cons~ructian will exceed twenty (20}
feet in height, side and rear yard setbacks sha~i be ten
(~p} feet.
(d) Specia~ Yards and Distances $etween Bui~dangs.

(4} O~f~Street Parking. Off-street parking shall be provided in
an amount no~ Iess than that se~ forth in ~he regulations of
Section 2~-35. Des~gn and location of all off-stxee~ parking
areas shall be approved by the Planning Depar~ment in
advance. Parking lots shall be des~gned so ~hat vehicles do
no~ exit by back~ng out onta the adjacent roadway.
(5) Access.
(a) R-P uses sha11 have frontage on a public street.
(b} R-P uses on parcels of less than two acres wi11 ba
served by one encroachment, ona curb cut per street
fran~age.
(c) R-P uses on pa~cels of ~wo acres ar more may be serv~d
by rnore than one encroachment and curb cufi per frpntage.
(d) Access from the public rzght-of-way to the parking area
serving an R-P use shall be a minimum of 12 feet paved
width.
{F) Othe~ Standa~ds and Requirements.
(1) Fences, shrubs, plantings. The rEquirements for ~~nces,
shruhs, screen p~antings, etc., in the R-P Zone ar~ as
pro~ided in Sectian Z~-130.2 0~ this code. If the praper~y
abuts a residential district, a s~x-and-one-half (6.5) foot
sight-obscuring waXl or fence shall be constructed along the
common line in compliance with the setbacks.
(2) Public Zmprovemen~s. Existing structures converting to

5 (3) Signs.

9 (35) square feet of aggregate area par stree~ frontage.
ld (b) Subject ta a CErtificate of Condi~.ional Use: Any

~4 {c) Subjec~. to a Use Permit: Any sign excesding the size

(a) A ten-pe~cent (10~) reduction ~n parking spaces
atherwise zequired by the Zoning Ordinance.
(b) Maximum aggregate hu~lding coverage ratios as enumerated
in Section E wi1X be waived wherE sewage and dra~nage
flows can be mat.
{c) Sign area may be increased from ~hirty-five (35) square
fee~ to a ma~imum of seventy (70) square ~eat.
(d) ~hase incentives may not be used in conjunction wath any
other incentive.
(6) Coordination with Specific Plans. Any building pexmit
app~ication. for deve~apment of an R-P use or conversion of an
exis~ing structure sha11 not be apprav'~d if inconsisten~ with
an appli.cable specific pl.an.
(7) Bui].ding Pe~rmit Applications with~.n a specific pl.an area
sha11 include:
(a} Proo~ that required infrastructure improvemants have
been ins~alled or ]~onded.
(b) Planning Comrnissian approval of the site ~ayout.
SEC TION 2. The hareinafter describec~ a~ea situated in ~he Coun~y
of Bu~te, State of Ca~.i~rornia, shall be and it is hereby zoned an R-P
(Residential Professiona~) District, and such azea sha1.1. be subject to the
res~rictions and res~.ricted uses and regula~.ions pursuant to S~tte County
