AN ORDINANC~ AMEND~NG SECTION 24-304 OF THE BUTTE COUNTY CODE
REGARDING TEMPORARY MOBILE HOMES
The Board of Supervisors af the County o~ Butte, State of
Caii~ornia, DO ORDA~N, as foZlows:
Sect~on ~, S~ction 24-304 0~ ~he Butte County Code is hereby
amended to read as foZ~ows:
Section 24-344. Provisa.ons for tempora~y mobi.le hames.
Notwithstanding any provision to ~he contrary in ~his chapter,
a secand unit, a mobile hozne cer~ified unde~ the National Mobile
Home Constructi.on and Safety Standards Act af 1974, may be placed
on any Iega3. lot i.n all residential zones subject to the
following canditions:
(a) Con,da.tions:
(1) A use permit has been approved by the But~e
County Planning Cammission or Butte County Board af
Supervisors in accordance wi~h Butte Coun~y Code
sections 24-43 through 24-48 inclus~ve.
( 2) Occ~zpancy o~ the mobile hozn.e is Iimited tv a
close friend, or a rela~ive by blood o~ marriage,
and an affidavit at~esting to the relationship of
~h~ involved parties shall be submitted wi~h ~.he use
permit applicat~on. ,
43) No rent is charged to the aec~pant o£ th~
mobile home.
( 4) The mobile home ~nay be owrned by either the
awner of the property on ~rhich it is pl.aeed, or by
the person residing ~herein.

(5} The 9~~e site shall either be served by
sanitary sewers e~ or have sufficien~ area and
dimension to provide ~o~ the praper installation,
maintenance and expans~.vn of a septic tank sys~em of
su£fica.ent s~ze and design to serve both dr~relling
units.
{6) The placement of the ~ob~.~e hame sha~~ not be
subjec~ to the additiona~ site requirements of ~he
resid~n~ia1 zoning district.
(7) The mobile home a.s a temporary use on the
praperty, accessory ~o the primary residence, and
shall not be placed an a p~rmanent ~oundation.
(b) The use pern~it granted hereunder shall be for the
term af two {2) years. The planning com~nission, upon
application of the property owner and without a public
hearing, may grant an extension of s~ch use permit for
periods not exceeding one (1) year. In the event tha~
th~ applicant who i.s residing within the mobile home or
the conventional reszdence fox any reason ~noves to
another location or is deceased, then in that event the
use permit granted herein au~oma~ical.ly expir~s and the
mobile hame sha11 be reEnoved with~,n one hundred twenty
f120) days. In ~he event the mobile home is n.ot removed
wi~hin one hundred twenty (I20) days pursuant to the
te~s of the use parmit, the county shall remave said
mabile hoine and sto~e it at the owner's expense. The
county may requi.re either a deposit ar bond sufficien~t to

~ cover the remova~ expense at the time the app~~cation for
2 the us~ permit is approved. The amount of such deposit
~ ar bond shall be determined at ~he time of the hearing
~ for the use permit. The request for the use pern~it shall
5 be signed by both the applicant and the relative or other
~ person to receive or render assis~anc~, and shall provide
7 tha~ But~e County is given a right ta e~~~~~-e~ enter
$ the property for the remaval of (and the right to remov~)
~ the mobile home, and s~ore same at the sole cost and
ifl expense of the applicant.
~l The use permit may b~ revoked if any o~ the terms or
12 conditions of such pe~mit are violated or if any acts or
~3 omissions af th~ permittee in connection with the use authorized
14 by said-ge~~t~ee ep rmit constitute a public nuisance.
~5 5ection 2.
~~ This Ordinance shall be and ~t is herehy declared to be in
~7 fu~~ ~orce and effect £rom and after thirty (30) days after the
~8 date of its passage, and b~fore the expiration of fifteen {15)
1~ days after its passage, th~s O~dinance sha~l be pub~ished once
2~ wi~h the names of the ~embers of the Board of Supervisors voting
2~ ~ for and against i.t in th~ OroVi31~ Mercury , a newspaper pub~ished
22 in the Coun~y of But~.e, Sta~e of CaZifor~ia.
