GRADING ~~ S~c.13-1. PurPose. ~1 The Gradi.ng Zone is an area including unique reso~rces. It is ~2 no~ed for its scenic natural beauty, for its streams, cr~eks, and 13 vernal pools, for its diversity of vegetation including rare and 14 endangered plant species, for i~s fish and ather wildlifa, and for its ~5 sources of water. X~ All of the said resources are sub~ec~ to serious damage by ~7 improper and uncontrolled grading, including, buf no~ limit~d ~o, ~g ~rosion and siltat~.on jeapardizing or destroying fish and other ~~ w~ldli~~ and the disruption ar contamina~ion of sources of water being 2~ used for dom~stic and other purposes. 21 ~ The purpose of this Art~cle is the control af erosion and 22 siltation, the enhancement o~' slope stabiZity, the protectio~a of said 23 resources and fhe prevention of related environmental. damage by 24 es~.ablishing standards and requiring permits ~or grading. ~~ Sec.13-2. Di,rector -~ The Director af the D~partment of ~ublic Works or his duly authorized designee. Drainage - The remaval. of exeess surface or groundwater from land by means af surface or subsu~face drains. Erosion - The wearing away of ~he land su~face by water or wind. Gradin~c. - Any earth movement, including excavation and fil~ing, or any cambination thereo~. Grading zone - Tha~ area of the Caun~y of Butte which ~.ies eas~ a~ Highway 7'0 from the southern boundary of the County north to the intersection a£ Ha.ghway 70 and Highway 149, east o~ Highway 149 ~rann said intersection nar~.h to the intersectzon of H~ghway 149 and Highway 99, and east of Highw~ay 99 from said intersection north to the northern boundary o~ the Cou~ty, and which is at an elevat~on of 300 or more feet above mean sea level. Sec.13-3. Pex~mit Required. Except as otherwise proycrided herein, i.t shall be unlawfuZ ~or any person to commence or pe~form any grada.ng in, the grading zone j~withaut having first ob~ained and complied with ~h~ conda.ti~ns and requirements o~ a grad~ng permi~. Sec.13~-4. Ef~ect o~ Pendin Pro'ect A 7.~.ca~ion. A grading permit sha1.1. not be approved, for a project which requi~es a zoning change, subdivision, parcel map or use permi~, parior tQ the final approval of said zoning change, subdivisioxa.r parcel map or use permit. / / / _2~- i ~ Sec.~.3-5. Permit A ~ication. - pP --- 12 (a) Application far Permit. 13 ~~ch appl,ication for a permit that i.s required by this A~ticl.e ~4 sha~l be mad~ by the property owner or his authorized agent to the 15 D~rector on a form £ux~nished for ~hat purpose and sha].1 be accompanied 16 by a permit application fee of $233.00. Provided however, ~hat if a 1~ detail~d engineering plan and specifications, soils engineering report 1$ and erosian and sedianent control p].an. are required pursuan~ ~to 1~ Subsection (b)(10) be~.ow, the application fee shall be $633. The 20 application shal~. also be accornpanied by an application ~or 2~ ~environmental. review and the fees which are required by ~he But~e 22 County Environmen~al Reva.ew Guidelines. 23 (b) Application Content. (4) The location af~ al.~ drainage to and from the si~e and the location of culverts and natural watercourses. (5} A relocation plan for existing wafi.erway or drainage facili.ties proposed tv be al~~red. (6) Detail~ of propos~d drai.~age structures. (7) A d~scription a~ the methods to be used ~.o cantrol erosian. {S) The ~ocations of anticipated sfockpile areas. (9} O~.her pertinent informatian, as requested by the Director. (1p} When the total excavation plus the to~al ~ill exceeds 10,000 cubic yards, a detail.ed enqineering plan and sp~cifications, soils engi.neering repor~, and erosion and sed~ment control planr prepa~ed and si.gned by a licensed Ci.vil E~gineer, wil~ be submitted per~aining to appZicatians involving one or more of the fo1].owing: (i) Cuts or fil-~s exceeding ~i.f'teen (15) ~eet in height. Environmenta~ Review. Perznit applica~ians shall be r~ferred ta the Planning Department ~or review pursuant to the Bt~tte County Enviran.mental Review Guidelines and the CaZiforni.a Environinental Qual.ity Act. Sec.13-8. En ineera.n Plans and S ecificatians. Engineering plans and speci.~ications, when required pursuant to Section i3-6(b)(10), shail be drawn ta scale upon reproducib~e paper or myI.ar and shall be af sufticien.t clarity to indicate the nature a~d extent o~ the work praposed and show in detazl tha~ it wil~ conform to the provisions of th,~s ArticZe a~d alI reievant laws, ordinances, rules and regu~a~ions. The first sheet of each set of plans shall give the loca~ion o~ th~ work and the name and address of the owner and the persan by whom they w~re prepared. The plans shall include the folZowing infarmatian: (1} General vi.cinity of th~ proposed si.te. (2) Prope~~y 1.imits and accurate contours o~ existing graund and d~~ai~s of terrain and area drainage. i3) L.imiting dimensions, elevations or finish contours ~o be achieved by the grading, and proposed d~ainage channels and relat~d constructzon. (4) Detaiied p7.ans and/or specifications af alI surface and subsurface drainage devices, wa11s, cribbing, dams and other pratecti.ve devices to be constructed with, or as a par~ of, ~he proposed wark, toge~her wi~h a map showing the drainage area and the caZculated runoff of the area served by any drain~. (7) Oth~r pertinent infarma~ion as reque5ted by the Director. Sec.13-9. Sails Engineering Report. The soi~.s engineering repo~t, when required p~zrsuant to Section ~3-6 (b) (3.0} , sha3.1 anclude data regarding the nature, distrib~tion and strength of existing soiZs, conclusions and reco~n~nendations for grading procedures and design criteria ~or corrective measur~s, wh~n necessary, and recommendations covering adequacy of sites to be developed by the propased grading. Reco~nmendations included in ~he report ShaII be incorpora~ed in the grading plans or specifications, which sha~l be subject to reviera and approva~ by the Di~ec~or. n .. ,. The erosion and sedimen~ control p~an, when required ~pur~uant to Section 13-6(b}(10), shal.l conform to the standards of this Article and shal~ contain meas~zres to be incorporated into ~he proposed work. The plan sha~.1 contain a description af tempara~y and permanent measures ~'or: (1) Protection o~ n.ative and naturalized vegeta~.ion. (2) Minimizing disturbance or removal of vegetation. (3) Revegetatian of dis~urbed areas. (4) Drainageway protec~ion. ~.. ~ .. I ~ 1 (5) Sediment detention. 2 (6) Fil~ slope protection. 3 (7) Cut slope protection. ~ (8} Disposal o~ spail material. 5 (9) Pratection of stackpile material. ~ (10) Dust cantrol. 7 ~31) Othe~ pertinent in~ormation as requested by the $ Director. g Sec.Z3-11. Standards. 1~ (a) Genexal. 1~ When a permit i.s required pursuant to this Artic7.e, 12 the grading plan and erosion control glan app~.acab~.e to ~he X3 projec~ shaZl conf~rm to the s~andards set forth herein. ~~ (b) Sediment Control. 1~ (1) Sediment caused by the grading project shal.l be 1~ reta~.ned on the site to the greates~ extent feasible. The 17 ra~.e a~ eros~.an a~ter coinpletion of the proj ect should no~ ~$ exce~d ~he natural. erosi.on rat~ which occt~rred prior to the ~g grading project. If erosion exceed~ ~he na~ural rate, ~~ eroszon and sediment cantrol measures shall be immediately ~1 ~ implemented ta reduce erosion to al.lowable ~.evels. 22 (2) Where prac~ical and feasible, sediment basins, 23 sediment ~raps, or similar sediment control measures, 24 ~~~nporary or pe~manent, shal~ be installed grior to grading 25 operations. Upon completian of construction and ~~ stab~.Iization o~ soils, a7.3. ~emporary era~ion control 2~ ~ac~.lities sha~l be removed from the sif.e. 28 / I I -8- 1 (c) Native Vegetation. ~ {1) Native vegetation shall be r~tained and 3 protected, wherever possi.ble, unless reanaval is ~equired 4 ~or publ.ic health a~d safety. 5 {2) When vegetation must be removed, the ~nethod shall 6 be one that wi13. m~.nimize the erosive effects from the ~ removal. 8 (3) Exposure of soil. to erosion by removing 9 vegetation shall be l~.mited to ~he area required for ~~ immediate c~nstructian aperations. 1~ (d} Gradin Prac~ices and Setbacks. ~2 {1) Grading operations shall be canduc~ed so as to 13 controi sediment productian and dust on the project site ~4 and ather properties. 15 (2) The setbacks spec~~'ied by ~.his section are ~~ minimum requirements and may be increased by the Director ~7 or by the recommendation of a ca.vil engineer, soils 18 en.gineer or engineerinq geologist, zf necessary for sa~e~y ~g and stabi~.~ty, or to prevent damage to o~her properties 2~ fr~m deposition or erosion, or to provide access for slope 2~ ' nnaintenance and drainage. (e) Cantrol o~ Runof~f. (1} Each plan which changes surface water run,off or drainage shall be requir~d to: a. Make provision to handle upstream o~f-s~te runo~f through ~.he pro~ect site, based on projected storm runof~ from the watershed. b. Provide and install, at the owner's expex~:se, per~inent drainage, e~osion and sediment control s~.ructures . c. Retain sediment being transported by runof~ water on-si~e through the use af sediment basins, silt '~raps, or similar con~rol s~ructures. (2) R~lease of concentrated sur~ace water runo~f sha11 only be di~ected inta existing drainage facilities, swa~es or wate~courses, at velocities which will not cause the natt~ral erosion rate ta b~ exceeded. (f} Slo e Construction. (1) 5lapes sha].l not be steepe~ than one-to-ane (1:1) ~or cuts and one and one-half~to-one (1 1/2:Z? for fills, --10- 1 unless a steeper slope is determined suitabZe by geoiagica~ 2 and soiZs engineering analysis. Erosion control measures 3 sha11 be incl~ded in th~ plans and specifications. ~ {2) Slopes shall not be construct~d so as ta endanger 5 ar disturb ad7oining p~operty. ~ {g) Revegetation and Slo e Surface Stabilization. 7 (1} Mu~ching, seeding, the pZanting of shrubs and $ trees, or other suitable s~abilization measures shall be 9 used to protect exposed slopes as necessary to control 1~ erosion, s~dimentation and slope stability. Preference 11 shall be given ta using native or lacally adapt~d gxasses, 12 shrubs and woady vegetation. X3 (2) Earth or paved int~rcep~ors and diversions shal~ ~~ b~ instal~ed at the tap o~ cut or fi1l slopes where the~e 1~ is a poten~ial ~or erasive surface runo~~. l~ (3) Revegetation shall be main~ained by the owner ~7 until permanent establishment is achieved. ~8 (h) G~'ading. ~g (3.) (j) Dis osal of Cleared Ve etation. Vegetation removed during clea~ing opera~ians shall be disposed of by one or more af the ~ollawing methods: (1} Chipping alI or some of the c~.~ared vegetation far use as znulch or co~npast on the site. (2) Burning all or some o~ the cleared vegetation. Material ta be burned shalJ. be piled in a manner and in such I.acatians as wi1]. cause the 3.east ~ire risk and least damage to adjacent trees. Burning shall be tharaugh, so that the ma~e~ials are reduced ~o ashes. No logs, branches or large charred pieces shall be permitted to remain. Burning shall comply wi~h Butte County Air Pol~Iution Con~rol Dis~rict and local ~ire department or district regulations. (3) Disposing of the balance ot the material in a manner and at a locatio~ approved by the Director. (k) Excava~.ed and F~ii Materials. E~cavated material. removed during grading operations and ~imported fi1L material sha11 be handled in accardance with the I following methods: ~1) Stockpiling sufficient topsoil on the site if necessary for use on areas to be revegetated. (2} Lacating ~tackpiZed soil so ~ha~ it will nat become a source for off-site sediinent damage. (3) Promptly back~illing and compacting stockpzZed soil into ~.renches and pits to reduce the risk of erosion. ~-12- i (4) App~ying mulch or ather protective coverings on ~ stockpi~ed material which wi11 be exposed th~ough the 3 wint~r season. 4 {5) Excavated material nat to be used at the si~e 5 shail be disposed a~ in a manner and at a location approved 6 by the Dixector. 7 (6) Excavated ma~erial and imported materia~ placed $ in permanent fill shall be compacted in accordance w~th ~ Section 19 ~f th~ State of Ca~ifornia D~partment of ~4 Transportation Standard Specifications dated January 1988. 1~ Sec.13-12. Banding• 12 The Di~ec~or shall recommend financ~a~ assurances in such 13 ~orm and amounts as may be deemed necessary to assure that the ~~ permi~~ed work, i~ not complet~d in accordance with the approved 1~ plans and specifications, will b~ corrected ta eliminate l~ hazardous conditions or to mitigate environmental ~mpact. ~7 Sec.13~13. Director's RePort- lg Upon receipt of a camplet~ application ~or a grading permit lg by ~he Dir~ctor, completion o~ an environmental review pursuant 2~ to Sec.13~7 and the Director's cons~deration thereo~, the 2~ ~Dir~ctar shall submit a repart inc~uding his recom~nendations to 22 the Planning Commission together with a request that the matter ~3 be set for h~aring by the Planning Co~nmission. 2~ Sec.13-14. Hearin . 25 Upon receipt o~ ~he Director's repor~, the Planning 2~ C~mmission shall., in ~he same ~-anner as prov~ded ~o~ in Sec~ion 27 24-46 0~ Chapter 24 of this Code, schedule a public hearing to be 2~ held within 45 days. The dete~mina~ion o~ the Planning Commission sha1.1 be final unless a written appeal is filed in the same manner as p~ovided in Section 24-48 of chapter 24 of this Code. Sec.13-15. Snspec~ion:. The Directar shall conduct such inspections as are cleemed necessary to insure compiiance v~rith ~.he appraved pZans and specifica~ion~ and aonditions of the permit. The Director shal~ have the right of entry upon the project premis~s to conduct such inspections and ~o clear out ox open up the obstruction o~ any drainage facil.ity deemed cantrary ta the provisions of the permit or this Article. Sec.13-~6. Viola~ions. (a) Revoca~ion of_Permit. Whenever any a1.legecl vialatian of the terms of a grading pexmit is ]arought to the attention of the Direc~.or, he shaZl, after determining tha~ a violatian daes exis~, ~i~her give the perrnittee a written noti.ce ~o comply within ~ive (5) days, or, where cantinuation of ~he vio~ation may adversely affect the public heal~h, safety or welfare, give the permittee wri~ten notice of suspension of the permit and operations thereunder. Said notices sha1Z be personaily ~erved or sen~ by registered mai1, return receipt requested, and shall be effec~ive on the date o£ the personal service or mail.ing thereof. If the permittee does not comply with such a no~ice ~o comply within the ~iv~-day period, or if the p~rmittee has been given a notice of suspen~sion, the Directar sha1Z request the question of the revoca~ion of -14~- ~ the grading permit ta be placed on th~ agenda of the next 2 regu~ar Planning Commission meeting. Any grading permit 3 may be r~vaked or madified by the Planning Commission in 4 the same manner as specified ~or use p~rmits ~n Section 24- 5 62 of this Code. 6 (b) Public Nuisance. Any grading in violatian of ~ the terms o~ this Ar~icle or any permit issued hereunder is 8 hereby declar~d to be a public nuisance and may be abated g in ~he manner provided by law. 1~ (c} Remedies Cumulat~ve. The remedies provided in ~~ this ArticZe are cumulative and no~ exclusive. No~h~ng in 1~ this Article bars any legal, equitable, administrative or 13 summary remedy to which any aggrieved pub~ic agency, X4 person, firm, corporation ar partnership may o~herwise be ~5 en~itled. ~6 Section 2: Section 4~-1 0~ the Butte County Code is hereby am~nded i~ to read as ~ollows: 1$ "Section 4~.-1.
