Section 24-1.01.1 of the Butte County Code a.s g hereby added to read as fo~.lows: g Seetian 2~-101.1 Purpose ~p It is hereby dec~.ared that the purpose and intent o~' ~his ~Z o~rd~.nance is to ~'urthe~ the publi.c int~r~st and aeronau~ical ~2 progress by provzding protection, promot~on, and deve~opment of ~3 aeronaut~.cs so as to grant to the Planning Cornmission such ~,~ powers and impos~ upon it such duties that th~ Cornmission may 1~ properly perform it~ functions ~e~.ative to aeronautics and ~6 effectivel.y exercise its j~risdiction aver persons and property ~7 associated wi~h aeronautic activities and land uses; and by 1~ providing for ~ooperat~on with federal an~ state a~thorities in ~~ the development of a~.ational. and s~ate system of civil aviat~on 20 and for coordination of aeronautical ac~ivities of those 21 authnrities by eliminating costly and unn~cessary land use 22 regulations and eliminating cost~.y and unnecessary land use 2~ regulations ana controls. 24 SECT~ON 3. Section 24-~101.2 of the B~tte Caunty Code is 2~ 26 _i_ Z 2 3 4 5 6 7 8 9 ~0 ~1 12 13 14 15 ~6 17 ~8 19 20 21 22 23 24 ''' 2~ 26 hereby added to read as follows: For the purpose of this Section, the follawxng wo~ds and phrases shall have the mean~ngs respectively ascribed to them: a) The term "ae~onautics" means the art and science of flight of airc~aft of al~ types; aviation; the opera~ion, navigation, maintenance, construction of aircraft and all component pa~ts thereof; and includ~s air navigatxon a~ds, such as lighting, markings, radio, ground to aircraft, ai~c~a~~ ~o ground, aircraft to aircraft, and related cammunications; navigation and pi~oting; and air crew and ai~ passenger faciliti~s; and also includes airparts and a~rstrips and ~he design, constructian, repair o~ mainte~ance of all or any part thereof and imprvvemen~s ~hereto; and the ~issemination of information and instruction pertaining to all of the foregoing. b) The term "airpo~t" means any area of land or water, whether of public or private owner~hip, designed and set aside far the landing and taking o~f of a~rcraft and utilized or ta be utilized in the in~er~st of the public for such purposes. c) Th~ term "airc~af~" means any cont~ivance now known or herea~t~r invented which is intended, used o~ designed for flight in the a~~. d) The term "compatib~e land use" means a use of land that does not endanger the health, satety, or w~lfare of the iowners, occupants, or users of the iand because of levels of noise or v~brations or because of the risk of personal injuzy or pzoperty damage created by the operatians of the airpo~~, incl.uding the taking o£f and landing of aircraft. _~- i ~ ~ SECTION 4. Sectian 2~-i01.4 af the Butte Co~nty Code is hezeby add~d to read as follows: Sect~an 24-101.4 Uses requi~ing Use Permit. The follawing uses are permitted subject to f~rst securing a use permi~ in each case: 1. Commerc~al and Professional Offices. 2. Retail commercial. 3. Restaurants, hatels, mot~ls, ba~ber shaps, recreational faci~ities and any other cammodities, services or laccommodations made available to the general public. 4. Utility buildings no~ directly associated with aeronautical act~.v.~ties. 5. Banking service centers. 6. Manufacturing and light industrial. 7. Warehousing, mini storage, and distrib~xtian ' ,~ facili~ies. 8. Other compatible 1.and uses as approved by the P1.annxng Commission. 9. Crop c3usting. 10. Sche~uled air cargo carri~rs and facilit~es. SECTION 6. Section 24-101.5 of the Butt~ County Cade is he~eby added to read as follows: Section 2~-101.5 Development Standards. Unless othe~w~se specified in an approvea Us~ Permit the following m~nimum development standards shal~ be as follows: l. Operating Performance Standards. Performance standa~ds prohibiting nuisance on account o£ fire, no~se, vibrat~on, shock, explasives, heat, glare, smoke, dust, adar, 'wastes, ~l~ctronic ~nterferences ana ~he ~ike shall app~y to all conditional us~s. 2. Lighting. The design and lacation of exterior lighti.ng should be required to comply in all respects to standards established by the Federal Avia~ion Administration, or the California Department of Transpartation, Divis.ion of Aeronautics wi~h respect to height, type, and place~nent of lighting s~andards an the airport. 3. ~igns. S~gns sha1.]. be limited to those identifying uses conducted on the ai~port site. Ou~door ac7vertising signs, bi1.l.boarc7s , o~ flashing lighting signs shall be prohibited within the ai~po~t zone. 4. Automobil~ Parking. AII au~omobile parking shall be requir~d to be off street. Off-street parking provi,sions of W~_ !j , ~' ~ I, ~ Butte Cous~.ty Code Section 24-35 shal~. apply. All off-s~reet ~ ~i ~Iparking areas sha~~ be paved. 2 5. Bu~.lding and Deve~apment Standards. A~.~. buildings 3 shall be constructed and designed in such a manner to restrict 4 the ~.ndoor no~se 1.evels ~o less than 45 c~ecibe~.s during aircraft 5 operation. 6 6. S~orage. All storage, except for automobiles and 7 a~.rcraft, shall be required to be within buildings or wi~hin 8 enclosures. Starage of a~rcraft parts, service equ~.pmen~, or 9 simila~ i~ems shal.~, be expressl.y p~oh~.bited outside the ~a bui~c]ing~ o~ sto~age enclosure. 1Z 7.
