The Board of Supervisors of the County of Butte ordains as fo3lows; Section 1.. Article IV is her~by added to Chapter 16 of ~he Butte County Code, entitled "Parks and Recrea~ion", to read as foll.ows: ARTICLE IV PARK FACILITY FEES IN THE CHICO URBAN AREA S~CTI4N 16-~26. Purpose. This Art~.cle is enacted pursuant ta Article ~, Section 1 0~ the Butte Co~nty Charte~ and Art~.cle XI, section 7 0~ the California Constitution ~or the purpose af authorizing a park facility fee to be assessed and levied upon any owner of real property located in ~he unincorporated area of the Coun~.y of Butte withi~ the Chico Urban Area adding one or more dwe~.~.ing units to such proper~y. Said fee i5 to be in an amount determzned necessa~y to fund the acquisition and development of park facilities required to serv~ the cumulative recreatiana~. needs of ~.hose p~~sons residing in such dw~l~ing units. SECTION 16--27. Findings. The Board o~ Supex~visors mak~s the foll.owing fa~nd~.ngs and dete~minati.on~ required by S~ction 66001 of the Cali~ornia Government Code in r~gard to the park faci~ity fees assessed and levied pursuant to the provisions of this Artic~e. A. ~znportance o~ arks; increased need resulting from new residential deve~.o~ment. The pr~sence o~ park facilities w~.fhin tha Chico Urban Ar~a contributes significant~y to ~he beauty and ambience o~ said area together with the physical health and emotional we1.~. b~ing o~ its residents. New residential deve7.opment -~ I - ` ~ 1 occurring within said area wili create a need for the acquiszt~on 2 and developmen~ o~ additionaZ park facilities within said a~ea in 3 that the ex~sting park ~acilities, including Bidwell Park, are 4 insuf~icient in number, szze, ~acation, and the kinds of 5 recreational opportunit~es which they presen~ ~o meet the park and 6 recreational needs o~ both the existing residents of said area plus 7 those additional residents who wi~l eventual~y inhabit such new 8 residential development. Based on th~ genera~ plans of the City a~ 9 Chico and ~he County of Butte as well as the Park and Recreation IO P1an prepared for the Chico Area Recreation a~d Park D~strict, new lI residential development occurring within said area will create the 12 need for at leas~ three and one-hal~ (305} acres a~ neighborhood and 13 community park ~acilities, deveiaped primarily for ac~~ve I4 recreational pursui~s, ~or every one thousand (1,Q00) new residents 15 who eventua~ly inhabit such n~w residential development. By reason 16 of ~he foregoing, the Board of Supervisors determines that there is ~7 a reasonabZe relatianship b~tween the need for the park facili~ies 18 to be f~nded with ~.he park facility fees provided far by ~his I9 Articl.~ and the residential development upon which such ~ees are 20 imposed. 21 B. Us~ of revenues from ~ees to meet park needs. A~.l revenues 22 ~rom the paxk facili~y fees assessed and levied on new residential 23 development pursuant to the pravisions of thi~ Article wi].I be used 24 for ~.he acquisition and dev~lopment of additional park facilities 25 within the Chico Urban Area which will meet the need for such 2fi facilities caused by such new residential development. In 27 accordance wi~h the provisions o~ this Articl.e, all such r~venues 28 must be depa~ited in a park fund and ther~after appropriated by the -2- 1 Boa~d o~ Directors o~ Chico Area Recreation and Park District for 2 the acqu~sition and development of park tacilities o~ benefit ~o the 3 persons residing in the residential development upon wh~ch the ~ees 4 are imposed. By reason of the forega~ng, the Boaxd of Supervisors 5 determines that there is a r~asonable re~ationship between the use ~ o~ the park facility ~ees provided ~o~ by this Article and the 7 residential development upon which such fees are imposed. 8 C. Fees do no~ exceed 1eve1 necessary to meet need. The paxk 9 facility fees assessed and lev~ed on new residen~ial d~velopment 10 pursuant ta th~ provisions of this Ar~icle wi~I no~ exceed that 11 which i~ necessary to fund the park facil~ties attrib~tab~e to the 12 residential development upan rahich such fees are imposed. In 13 particular, the park facility fees assess~d and lev'ied on new 14 residen~ial development wi1l be equal to that necessary ~.o fund th~ i5 three and one-half (3.5) acres of neighborhood and community park 16 facilities heretofor~ ~ound to be necessary for every one ~housand I7 {1,000) new residents wha eventually inhabit such new deveiopm~nt. J.$ By reason of the foregoing, ~.he Board of Superv~.sors determines that 19 there is a reasonab~e relationship be~raeen the amaunt a~ ~he park 20 facility fees provided for by this Artiel.e and the cost o~ ~he park 2i facil.ities attributab~e to the new residential dev~lopment upon 22 which the ~ees are imposed. 23 5ECTION 16-28. De~~.nitions. Un~ess the contra~y is stated or 24 cl.eariy appears from the context, the following definitions sha1.~ 25 govern th~ const~uc~ion of the words and phrases used in ~.his 26 Article: 27 A. Bidwell Fark. Bidwell pu~suant to that certain deed dated Jul.y 10, 19~5, together with any additians made thereto. B. Chico Urban Area. The term "Chico Urban Area" shall m~an the area descr~bed on Exhibit A which is at~ached hereto and incorpora~.ed herein by this reference. Said area is substantial~y the sa~e as but not identical wxth tha~. area depic~ed within the "Urban Growth Boundary° on the map of the Chico Area Recreation and Park District Comprehensive Paark and Recreation P1an. C. Communit~ ~ark Facilities. The term "communzty park facilities" shall mean any park facilities, other than B~.dwe11 Park, which are intended to serve the recreational needs o~ all o~ the res~.dents and ather inhabi~ants af ~he Chico Urban Area, The t~rm "communi~y park facility" sha3.Z inc3~ude creekside gre~nways, trail systems, and other lineal paxk ~acilities. D. Con re ate Housing and Care. The term "cong~egate ho~sinq and care" sha11. mean housing which provides living quarters for persar~s who are 55 year~ of age or older, and , a,n. addition thereto as a par~ of the lease, r~n~.a~ or purchase agreement, or other ~erms or condi.tions o~ occupancy, aZso pxovides, or offers ta provide, comman recreational ~aci~.ities or services. E. Dw~~Zing Unit. The term "dwe~7.ing unit" shal.~ mean any building or mobil.~home~ or portion thereo~, used oar designed ~or use as a residence by an indiv~.d~a1. or any group of individual.s 1iv~.ng together as a ~azni.~y. F. Nei hborhood Park Facil.ities. Park Facil~t~es. The term "park facilities" or "park ~ac~lity" shall mean parkland and a11 improvem~nts to such Iand and the adjoining rights of way which are determined necessary for the d~velopment and use o~ the iand for pa~k and recreationa~ purposes. SECTI~N ~6-29. Imposition of ~ark facility ~ees. A park faci~ity f~e sha~x be assessed and levied upon any owner af real property locat~d in the unincorporated a~ea o~ the Chiao Urban Area adding one or more new dwelling uni~s ta such property incident to the constructzon of a new building on the property, the installatian o~ a mobzlehome on the praperty or connection thereof to utilit~es, th~ alteration or construction o~ an a.ddition to an existing building or mobilehame on the property, or ~he change zn use of a nonresidential. bui~ding or znobilehome o~z the proper~y to a residential use. Fees assessed and Ievied hereun.der as to the ins~allation of a mobilehome or the connection of a mobilehome to utilities sha11 only be assessed and levi~d a~. the initial l.ocation of sai.d mobilehome ~.n the Chica Urban Area and a.f such locatian ~.s on a space, site or other property on which no other mobilehome was previo~zsly ].ocated. SECTION ~.6-30. Amount o~ ~ark ~ac~li~ fees. The amount of ~he basic park ~aci~ity fee assessed and levied pursuant to the provisions of this Article shall be ~qual to the tatal numbe~ of dwelling units be~ng added to the property multiplied by the park faci.~ity ~ee per dwel~ing unit establ~,shed by resolution of the Baard o~ 5upervisors based on the foll.owing: 1. The est~.mated cost per pe~son of developing a thre~ and oneMhalf (3.5} acre park facility for every one thousand / / / _~.. 1 2 3 4 5 6 7 $ 9 10 11 12 13 14 15 16 i7 X$ 19 20 21 22 23 24 (~,000) new reszdents in the Chico Urban Area, as det~rmined, whenever possible, from the most recent park facili~ies acquired and d~veloped ~n the Chico Urban Area eithe~ by the Co~nty o~ Butte, th~ City af Chico or the Chico Area Recreatian and Park D~strict, multiplied by; 2. The average number of residents per.dwelling uni~ within the Chico U~ban Area, as determined by the most recent federa~ c~nsus or a census taken by the City of Chico pursuant to th~ provisians of Title 4, Division 3, Part 2, Chapter 17, of the California Government Code (co~enc~ng wi~h Section 40200}. SECTION ~.5-3~. Credit ~or park facility fees paid to Cit~ of Chico.. Where park facility fees have previousl.y been paa.d to the City af Chico as to the rea~. property upon which the dwell.ing units are to be added, the owner a~ said rea1. proper~y sha~l be entitlecl to a cred~t in the amount thereof against ~he ~ees owing pursuant ta this Article. SECTION 15-32. Exen~pt~ons from park f~aciZi.ty fees. Notwithstanding any provision.s of this Artzcl.e to the contrary, a park ~acility fee shail not be assessed and levied upon an owner of real property lacated ~.n the Chico Urban Area addi.ng one or more dwelling units to such property under the folZowing circumstances: A.) Where the dwell.ing unit is wi.thin a building owned by a governmental agency. B.) Where the dwellz.ng unit is within a building which is bei~.g reconstructed following damage or destruct~.on by fire of other ca:sua~.ty, ar the voluntary demolition the~eof, -6- 1 2 3 4 5 6 7 $ 9 10 11 12 13 14 15 16 17 18 19 2(1 21 22 23 24 provxded that the number of dwe~~ing unzts in s~ch r~constructed building is no greater ~han the numbe~ of dwelling units in the building prior ta such damage, destruction, o~ demo~it~on. C. ) Where the dwe~l.ing ~nit is W1.thZAi a part o~, or af ~iZiated with a facil.ity u sed primarily ~or th~ congregate hausing and eare o~ persons who are 55 years of age ar ol.der . SECTTON 16-33. .Annual Adjustment to ~axk faci~.ity fees. If on July I, 1990, or on July 1st of any year thereaf~er, the Chico Area Recreation and Park Distric~ subm~.ts docu.mentation substantia~ing that there has been an i.ncreasa in the cost o~ acqua,ring and/or developing park facilities within the Chico Urban Area, and ~eques~ing an incr~as~ in the park facility fees assessed and 3.evi~d pursuant ~o the provisians of the Ax~t~cle, the Board o~ Supe~visors may increase such fee, in an arnount propo~ta.onal to the increase in. such costs. The determinata.on of whether th~re has beezz an increase in the cost of acquiring and/or developing such park facilities and the amount of the increase in the park facility fe~ which i.s proportiona7. to the increase in such costs, sha11. be made by the Board o£ Supervisors based on the following: A. I~~ormation re Increase in the cost o£ acguiring ~he developing park faci3.ities (other than the cost of aaquiring ~arkl.and) The net percen~ag~ increase in the Engineering News Record cast index for San Francisco {based on ].9I3 U.S. average = 100) as las~ publzshed in the Engin~ering News Record McGraw Hill Canstruction Weekly betwee~ the date of such increase and ~he effective date o~ this section or any -7- 1 priar increase in the park facility fees made pursuant to ~ the provisians a£ this section. 3 B. Information r~ Tncrease in the cost of acquirin~ 4 arkland. The best available data pertaining ~a increases in ~ the price o~ land in the Chico Urban Area between the date ~ of such increasa and ~he ef~ective date of this sect~on or ~ any przor increase in the park facility ~~es made pursua~t $ to the prov~sions of this section. 9 SECTION 16-34. Payinent o~ Park Fac~Zi~y Fees. X~ A. Time of Payment. ~1 Th~ park faciZity ~ees assessed and Lev~ed pursuant to the 12 provisions of the Article shall be due and payabl.e pr~or to: the ~3 issuan.ce of a bui~ding permit for the construction of any new 14 bui~ding in which such dw~Zling ~nit is to be located or ~ar the 15 ~,~,~~~ation or cons~ruation o~ an addition to any exist~ng buildi.ng ~~ or mobilehome i.n which such dwel3.ing unit is ta be Iocated, or for ~7 th~ change in use of a nonresidential buil.ding o~ mobilehome ta a ~g residential use; the issuance o£ an install.ation or utility ~~ connection permit ~or a mobilehome in wha.ch such drael~ing unit is ta 2~ be Iocated; or the occupation of such dwe~ling uni.t. 21 ' B. D~posit of park faaility fee revenues in ~ark ~aeility fund. ~ AIl revenues from the park faci~ities fees assessed and levied pursuant to ~he provisions of this A~ticle shall, when received by the Chico Area Recreation and Park District, be deposited in a separa~e park fund, and thereafter appropxiated and used on~y ~or ~he acquisition and/or development o~ either communi~y park ~aci~ities or neighborhood park faci~ities in ~h~ manner hereina~ter provided by this Article. SECTION 16-36 Appropriat~on of Park Facility Fee Rev~nues for the Aaquisition and Deve~apm~nt o~ Park Faci~ities. All rev~nues ~rom the park faci~ity fees assessed and levied pur~uant to the provisions of the Article and rece~ved by Chico Area Recreation and Park Distric~ and deposited in a separate park fund sha~l be appropriated by the Chico Area Recreation and Park Distric~ Board of Directors in a manner consistent with the comprehensive Park and Recrea~ion Plan o~ the Chico A~ea Recreation and Park District and only for th~ acq~is~tion and/or development of; 1) Neighborhoad pa~k faci~ities whieh are determined by said Board to be o~ benefit to all persons residing wi~hin the zone of b~nefi~ estab~ished ~or the neighborhood pa~k ~or whi,ch fees were paid. Use o~ Park Facility Fees for the Ac uis~tion and/or D~ve~opment ot Park Fac~lities owned ~ the C.ity of Chico and Operated ~ Chico Area Recreation and Park Dzstrict. AZI or any part o~ the revenues from the park ~acility fees assessed and levied pursuant to the provisions of this Article may be appropriated in the manner hereinbefore provid~d by this Articl~ ~or the purpose of acquiring and/or developing community or neighborhoad park faci~ities wh~ch are owned by the City of Chico and are or wil~. be operated by the Chico Area Recreation and Park Distric~ pursuant to the terms and condit~.ons of a 1Ease or other operating agreement b~tween sai.d District and the City o~ Chico i.~, at the time o~' maka.ng such appropriat~.on, the Board of Directors of Chico Area Recreafion and Park District has deter~nined that ~.he use of such revenues for such purpose will serv~ the best interests o~' the ~esidents o~ the unincorporated area of ~he Chico Urban Area. SECTION 16-38 R~eport re ~isposition o~ Park FaciZity Fee Revenues; Acti~on re Unappropra.ated Revenues. A. R~part ~ the Chico Area Recreat~,on and Park District. Com~nencing Ju1y 1, 1990, and on Ju1y lst of each y~ar thereafter, the Chico Area R~c~eation and Park Dist~ict shal.l. pravide the Board of Supervisors with a report which sets forth the total arnount of all park faci2ity fee revenues that were ~eceived and deposited in the park fund in each fiscal year prior to the date o~ such report, the disbursements ~rofn said fund and th~ amount which remains unappropriated as of the dat~ of the ~eport. B. Action ~ the Board o~ Supervisors. Com~enci.r~g with ~he fourth fiscal year following the first year of recexp~ of any revenues from park ~acility fees assessed and -~0- 1 2 3 4 5 ~~vied pursuant ta the provisions of the Article, and in each fisca~ year thereaf~er, the Board of Supervisors, following receipt o~ ~he Chico Area Recxeation and Park District's report, shaZ1 take one af the following ac~ions with respec~ to any unappropria~ed park faeil~ty fee revenu~s in the park fund which were received and deposited in such fund ~our or more years prior to ~he date of such 7 report: 8 9 10 11 12 I3 14 15 16 X7 18 19 20 21 22 23 24 25 26 27 28 1. Order the appropriation of a11 ar any part of such unappropr~ated park fac~~ity fea rev~nues for tha acquisition and/or development of community pa~k facilities and/or neighborhood park ~acilities in ~he manner here~nbefoxe provided by this Article; 2. Make a finding with resp~ct to all or any part of such unappropria~ed park ~acility f ee revenues whzch identifies the purpose to which ~he revenues are to be put and which demanstrat~s a reasonable relationship between the fees ~rom which the revenues are derived and the purpose for which they were charged; or 3. Order the refund of a~l or any part of s~ch unappropriated park faci~ity ~ee rev~nues, together wi~h any interest accrued fhereon, to th~ current owner of any property fo~ which ~ees were pa~d; provided, however, that if the admznistrative costs of r~f~nding such park facility fee revenues exceed the amount to be refunded, the Board of Supervisors, after considering ~he matter a~ a pub~ic hearing, notice a~ which is given in the manner provided for the Section 66001(e) of the California Governm~n~ Code, may order the appropriat~on of such ~evenues ~or any other -11- l facility or improvement for which development fees are 2 charged or otherwise imposed pursuant to thi.s cod~ and which 3 the Board of Superv~sors determines wi11 benefi~ the 4 properties for which the park facility fees were paid. 5 Section 2. Severability. I~ any part of this ord~nance sha11 be 6 held void by a court of competent jurisdiction, such part sha~~ be 7 dee~ed sev~rable, and the invalidity therea~ shall not affect the 8 remaining parts of this ordinance. 9 Section 3. This Ordinance shall b~ and ~t is hereby declared ta be Xd in ~ull force and effect from and after ~hirty (30} days a~ter the lI date of its passage, and before the expiration o~ fifteen {15) days 12 af~~~ its passage, this Ordinance sha11 be publish~d once with the 13 names of the members of the Board of Supervisars vating for and 14 agaz~nst it in ~he Chico Enterpri5e Record, a newspaper published in the X5 County of Bu~te, S~af.e o~ Ca~ifornia.
