Chapter 28A is hereby added to the But~e Cou~ty Code to g read as follows: 1~ "CHAPTER 28A MOBILEHOME AND MOBIL~H~ME LOT STANDARDS 1~ Sec~ian 28A-1 Mobi~ehome and Mobiiehome Lot Standards ado ted b ~2 refer~nce. 13 In order to provide minimum standards tor the construction, l~ use, znaxntenance and occupancy of mobilehome ~ots and mobil.ehomes and ~~ installations for s~pplying ~uel gas, water, and elec~ric~.ty thereto ~6 and the disposal of sewage therefrom, Subchapter 1, con~menci.ng with 1~ Section 1000, a~ Chapter 2, entit3.ed Mobilehame Parks Act, of Tit~e 25 18 of the Ca].ifornia Code of Reg~xlations is hereby adopted, incorparated Z~ and made a part of this Chapter by re~erence, witho~at further 2~ pubZieation, as though s~t forth at length h~rein. This Chapter sha1.1. 21 'apply ~o and govern al~l mobilehomes, manufactured homes, travel ~2 trailers and recreational vehicles, and accessory structures, and all 2~ such uta.lity instal~ations, ~ocat~d outside of mobil.ehame parks in the 24 unincorporated areas of the County. ~5 Section 28A-2 Violations and Penalties. ~~' It sha~1 be unZawf~zl for any person ~o viol.at~ any provision 27 or to fail to comply with any requirement of this Chapter." 28 Section 2. In order to provide minimum s~andards for the proper regul.ation of ex~st~.ng re~idential buildings, Articles 5 and 6, o~ Chapter 1. af Title 25 af the California Code o~ Regula~ions is hereby adopted, incorporated and mad~ a part of this Chapter by refer~nce without further pubiications as though set forth at length herein a~d sha17. apply to and gavern a1.~ exi.sting hou~ing in the unincorporated areas o~ the County. Section 28B-2 Vio~ations and PEnalt~es, (a) ~t sha~l be unlawful for any person to vioZate any prov~sion or to fail to comply with any requirement of this Chapter," Section 3. Sectio~ 41--1 of the Butte County Code is hereby amended fi.o read as ~ollows: " Section 41--1, Pur ose . The fal~.owing po~icies and procedures are adopted to innplement a pragraz~ of enforcement of Butte County's zoning, buiiding~ sanitation and o~her ordinances contained in the ~ollowing Ghap~ers Q~ this Gode: Chapter 10, Ha.ghways and Streets; Chapter 1~., Junk Dea3.ers, Pawnbrokers and Secondhand Dea~.ers; Chapter 13, Grading and Mining; Chapter 1.4, Motor Vehicles and Traf~ic; Chapter 19, Sewage Disposal; Chapter 23 B, Water We11s; Chap~er 24, Zoning; Chapter 26, Buil.dings; Chap~er 26A, Underground Utility Dist~icts; Chapter 26B, Mechanical Gode; Chapter 27, Electricity; Chapter 28, P~umbing; Chapter 28A, Mabilehome and Mobil.ehonle Lot Standards; Chapter 28B, State Housing Law Requi.remen~s; Chapter 31, Refus~ Col~ection and Removal; Chapter 32, Naming of 5treets and H~.ghways; Numberi~g -2- 1 ~ Propertie~ and Principal Buildings; Chap~er 33, Groundwater 2 Conservatian; and Ghapter 37, Undezgro~nd Ha2ardous 5ubstance Storage 3 Facilities. 4 It is ~he policy of Butte Coun~y to seek valuntary 5 compliance with these provisions but to pravide an ef~ective ~ means of enfarcement if such comp~iance is not obtained. 7 Section 4. Subsection c o~ Section 41-2 a~ the Butte Caunty Code $ entitied "Warning Notices" is hereby amended to r~ad as follows: ~ 4~-2(c) Exceptions. Notwithstandzng th~ provisions of 1~ subsectians (a) and {b} above, na notice ne~d to .be given, and a 11 County Code Enforcement Officer ~nay imm~diately issue a citation, upon ~2 the raquest o~ the aff~cted Department and when there is a reasonab~e 13 basis fo believe that: the violatian constitutes a threat to ~he ~~ health and safety of any perso~: or persons, inclucling that of the ~5 a~leged violatar, or to property; or the violator may not remain iri 16 the County or ntay atherwis~ be difficu~.t to l.ocate at a~ater time." ~7 Section 5. Section 41-~ of the Butte Co~nty Code is hereby amended to 18 read as foiiow~: ~~ "Section 41-5. Violati.on; Penal.ties. 2~ (a) Vial.atians Char ed and Punished as Tn~ractions. 21 ' Notwiths~anda.ng any provision of ~his Code to the ~2 contrary in Chapter 1Q, 11, 13, 14, 19, 23B, 24, 26. 26A, 26B, 27, 28, 23 28A, 28B, 31., 32, 33, 37, and 41, whenever any provision in any of ~4 said Ghap~ers pro~crides that any act is prohibited o~ made or d~c~.ared ~5 to be unlawful or a misdemeanor or an infraction, or requires the ~~' doa.ng of any act or dea~a~es the failure to do any a:ct unl.awfu7. or a ~7 misdemeanor or an in~raction, the vio~ation o~ such pravision may be 2$ charged as an infraction punishable by i~pasit~.an of the following -3- ~ f~nes: 2 1. Upon a~irst conviction, a fine of $~00; 3 2. Upon a second convict~on of violating the same 4 Chapter o~ this Code with~n the 12 month ~ period ~mmediate~y preceding the commission ~ of the current viola~~on, a~ine of $204; ~ 3. Upon a third conviction of violating the same S Chapter of this Code wi~hin a 12 month period 9 immediately preceding the commi~sion of the 1~ current viola~ion, a~ine o~ $500. ~~ (b) Each Day a Separate Offense. 12 Each and every day or portion thereo~ that a person 13 violates or conti~ues to ~iolate any such provision of any of said Z~ Chapters consti~u~~s a separ~te of~ense and may be charged and 15 punished separate~y without awaiting conv~iction o~ any prior 16 viola~ion. ~~ {~) Misdemeanors. ig Any violation which may otherwise be charged and 19 punishable as an in~rac~ian pursuant to subsectian (a) abov~, may be 2~ charged and punishable as a misdemeanor if the defendant has been 21 ~convicted o~ three or more viola~ions of the same Chap~er of this Code 2~ within the ~2 month period immediately preceding the commission of the 23 current v~olation. For purposes of this sect~on a bail forfeit~re or ~~ a plea o~ nalo contendere shall b~ deemed ta be a canvie~ion:r ~5 Section 6. Subsection b of Section 1-7 of the Butte County Cod~ 2~ entitled "General Penalty; Continuing Violations" is hereby amended to 2~ read as follows : 2$ "Section 1w7{b). Notwiths~anding any provision of thi5 Code -4-- . ~ I ~ to the contrary in subsection i~1 above or in Chapters 10, 11, ].3, 14, 2 19 23B 2~4 26 26A 2{B 27 28 28A 28B 31 32 33 or 37 r ~ ~ ~ r > > ~ - ~ r r + 3 whenever any provision in any of said Chapters provides that any act 4 is prahibited or made or declared to be un~awf~1 or a misdemeanor or 5 an i.nfraction, or requires the doing of any act or dec~.ares the 6 failure to do any act unZawful or a misdemeanor or an infraction, the ~ vialation of such provzsion may be chaxged as an infraction and ~ punishable as specified in Section 41-5. This subsection (b} shall ~ agply to the violation o£ any prov~.sion described herein, ~ncZuding l~ but not limi~ed to the ~ollowing sections of this Code: IO-1, 10--2, ~i 10-8, 10-22, 1.i-2, 11-4, 17.-5, I1-6, 11--7, 11-8, 11.-10, 11-11, ].l-~8, ~~ 13-3~ 13-].04(a)i 14-1r 14-4, 14-5, 14-12~ 1~-15f 14-2~~ 14-28~ 14-30~ 13 14-47r 14-~8~ 14-b1~ 14-80~ 1.4-9].~ 19-3~ 19-4~ 19-5~ 19-7~ 19-18~ 23B- 1`~ 3, 23B-10, 2~-4, 24-5, 24-6, 24-36.2, 24-63.1, 24-68, 26-6, 25A-~, 15 2&A-12, 26B-5, 27-5, 28-~4, 2$A-2, 28B-2, 31-I, 31-~, 31-7.5, 31.-8, 31- ~6 8.5, 31-13., 32-14, 33-3, 33-4, 37-7, 37-8, 37~-9, 37-16, 37-22 and 37- 17 23.f, 18 Section 7. Sev~rabil~t .
