THE BOARD ~F SUPERVISORS OF THE COUNTY OF BUTTE, STATE OF
CALIFQRNIA, ORDAINS AS FOLLOWS:
Sect~.on I.: Section 24-3~.1. i~ hereby added to the Butte County
Code to read as ~ollows:
SECTYON 24-~35.1 Animal Maintenance; Pu~ ose and Inten~.
Tt is the intent of the fal3.owing animal ~naintenance reg~lations
(Sections 24-35.2 through 2~4-35.3, i.nclusive} to aZlow persons to
keep and maintain livestock at their private residences zn a manner
which wi3.1 be consi.stent with the provisions of Article ~V, Section
4-21 of this Gode (Anamals at Large Prohibited) and which will
protec~ the health, safety and wel.fare o~ nearby residents. If anY
person within th~ County main.tair~s an anima~ in violation o~ these
regu~ations, he or she shail b~ subjec~ to nua.sance abatement
procedures and/or zon~ng violation procedures of the County of
Butte.
Sec~.ion 2: Saction 24-35.2 is hereby added to th~ Butte County
~ Code to read as ~ollows:
SECT~ON 2~-35.2 Anima7. Maintenance Re uir~nents.
{A) Area Re u~.rements.
On all. parcels of property which are five (5) acres ar 3.arger and
are within zoning districts that a1.1ow Zzvestack there shal~ be no
area requirements ~or an.imals. However, on aI.1 parcels o~ property
which are less than five (5) acres ~n size and are withxn zoning
di~tricts that allow Iivestock, the tollowing area, a3.lotted
_~_
exc~usively to each typa of animal, sha~1 be required ~or each
animal kept on the premisess
(~} E uine, Bov~ne and Sw~n~ Area Re uirements.
For each equine, bovine ar swina over one {1) year of
age, ten thousa~d {Z0,400) square feet; provided,
howaver, that i~ there is a r~sidentia~ use established
vn the parcel, eight thousand one hundred twe~ty five
(g125) square feet shall be required ~or s~ch residentiai
use and ten thousand (10,040} add~tional square feet
shall be required for each such animal.
(2) Sheep and Goat Area Re uirements.
' For ~ach sheep or goat over one {1) year of age, three
thousand (3,OD0) square feet; provided, however, that if
th~re ~s a residential use established on the parcel,
eight thousand one hundred twenty-five {gI25j square feet
shal~ be required ~or such residential use and three
thousand (3,000) addztional squar~ feet sha~l be required
for each such anima~.
{3} Area Requirement for Eaah An~mal.
The square foot requirements of subsections {1) and (2)
above are ~or each anima~. When two o~ more animals are
loeated on the sa~ne parcel, the sum of th~ required
square footage per an~mal shall be required.
(4) Exotic Animal Requi_rements.
Exotic animals, including, but not liznited to, 1~amas and
camels, sha11 be regulated u.nder Subs~ction {1) above.
(5) Educatianal Pro'ect Exem tion.
Temporary educational p~ojects, inc~udin.g, but not

~ Lim~t~d to, FFA, 4-H and school projects, conducted by
2 students through the ~2th grade and under the direct
~ supervision of a qualified, responsible adult adv~sor or
~ instruator, shall be eXempt f~om the requirements of
5 subsections (1? ,(2) ,{3) , and (4) above. However, no
~ more than a total of £our (4) equine, bovine, swine,
7 sheep, gaats and exotic animals ove~ one year of ag~
$ shal.l be kept pursuant to this s~zbsectian { 5) .
9(B) Use Permits Re ui.red for More Intense or Commercia~ Uses.
1a On a~l parcels o~ property within tioning ~istricts that al~.ow
1~ livestock and are 1.ess than five (5} acres, a conditional. use
~2 permit sha].1 be required for :
13 (1} The keeping of such animals {horses, cattle, swine,
14 sheep, and goats) at greater densities than allowed
15 pursuant to subsections (~) arzd (2) above.
Ifi (2) The keeping of such animals, poultry and rabbits,
17 fo~ the purpose of sal~ o~ said anima~s or ~he~.r
18 products on a continuing basis.
19 {3) Feed yards and hog farms.
20 {4) Boarding or r~.ding stables.

23 SECTION 24-35.3 Hea3.th and Safet .
~4 Animals shall be kept in a cl.ean and sanitary condition and in
25 a manner that does not become a public nuisance. Upon wi.tnessing
~~ any va,oiata.on o~ this Section, Butte County Code Enforcement
27 Officers sha~l coordanate with the appropriate responsible
~8 agency.

1 Section 4: Subsection A of Section 24-72 of the Butte County
2 Code is hereby amended ~v read as ~ollows:
3 SEGTION 24-72. A-5 (Agricultural) Zone._
4 (A) Uses Permitted:
5 (1) On~ (1) single-family dwelling per parce~;
~ (2} Agricu~tural u~es, incl.uding the keeping vf an~mals,
7 subject to the animal maa.ntenance requirements of Sections 24-
8 35.1 through 24-35.3, inclusive, o~ this Code;
9 (3) Acaessory buildings and uses perti~nent to the
10 permitted uses, including agricultural procassing plants;
I1 (r~) Housing ~'acilities (includ~ng mobi~.e hontes) to
12 acco~modate only agricult~ral employees and theix fami~ies
13 empZoyed by the owner o~ operator o~ the premi~es; and, provided
14 ~urther, that such housing facility shall be considered ace~ssory
15 to the main building and shaZ1. con~or~n to the provisions
16 pertai.n~ng to required yard and open spaces for dwel.li.ngs.
17 {~) Mobile homes to house ane ~ami~.y when such mobile
~8 home as the only housing faci3.~ty located on the premises,
19 provided the following conditions are conformed to:
20 {a) The floor area within the mobile home shall not
21 be ~ess than ~ive hundred {500} square feet.
22 (b} The parcel of land conforms to s~xbsection 2~4-
23 72 (C) (min~.muin 1ot area of five {5) acres) , or a smaller parce7.
