Section 1 that an amendment to the contract between the
Board of Supervisors af the County of Butt~ and the Board of
Ad~ninistration, California Pub~ic Employee's Retire~nent System
~s hereby authorized, a aopy of said amendment being attached
hereto, marked "Exhi.bit A", and by such reference made a pa~t
hereof as though herein set out in fu11.
Section 2 The Cha~r of' the Baard o~ Supervisors is hereby
authorized, empowered, and directed to execute said amendment
~or and on behalf of said Agency.
Section 3 This ordinance shall take effect on August 21,
1990 pursuant to Section 25123(e) of the Government Code of the
State o£ California; and before the expiration of f'i~teen (15)
days a~ter i.ts passage it sha1Z be published in a newspaper in
the County of B~tte, State of California.
PASSED AND ADOPTED by the Board of Supervisors of the

The Board of Administzation, Public Emplayees' Reti.rement System, hereinafter
referred to as Board, and the governing body o~ above public agency,
hereinafter referred to as Public Agency, havin,g entered inta a contract
effective Apzi1 i, 1945, and witnessed Febzuary 26, i945, and as amended
effective Octpber 1, 1947, December 1, 1951, July i, 1456, November 1, 1956,
Novembez l, 1959, September B, 196Q, October ]., 1960, Octobez 1, ~.96].,
5eptember 16, Z964, Octaber 1, 1968, August 25, 1973, October 1, 1973, ~ovembez
~, 1979, January 24, 1976, April 17, 1976, October 30, 1976, Jan~ary 1, 1980,
November 22, ~.980, December 14, 1985 and August 22, 1987, which pxovides £or
participa~ion a£ Public Agency in said 5ystem, Board and Public Agency hereby
agzee as foll.ows:
A. Paragraphs 1 through 11 are hereby strzcken fzom said contract as executed
effective AUgust 22, 1987, and h~reby replaced by the following paragraphs
numbered 1 through 12 inclusive:
1. A11 w~rds and terms used hezein which are defined in the Public
Employees' Retirement~Law shall have the meaning as defined therein
unless otherwise specifically pzovided. "Normal retirement age"
sha1~ mean age 60 fox Iocal misceJ.laneaus members and age 50 for IocaZ
safety members.
2. Puhlic Agency shall particigate a,n ~he Public Employees' Retirement
System from and aftez April ~, 1945 making its emp].oyees as
hereinafter provided, members of said System subject to all provi.sions
of the Public Employees' Retirement Law except such as apply only on
e~ecti.on of a contracting agency and are not provided for herein and
to a1Z amendments to said Law hereafter enac~ed except thase, which bX
express pronisi.ons thereof, apply pn],y on the election of a
contracting agency.
3. Employees af Public Agency in the following classes shall become
members of said Reti=ement System except such in each such class as
are excluded by 1aw or this agreement:
a. E~ocal Fire Fighters (herein referred to as loca~ safe~y members);
b. County PeacE Of~icers (included as local safety members};
c. Emp~oyees other than 1oca1 safety members (her~in xeferred to as
locaZ rt~i,sce~laneous members}. .
4. In addition to the classes of emplayees excluded from membership by
said Retirement Law, the fol~awing classes bf employees shall not
become members of said Retirement System:
a. ALT, HOURLY RATED pR HOURLY BASIS ~IAYEES
HIRED ON OR AFTEl2 pC'PpSgR 1, 1968.
5. The percentage of finai compensation to be provided for ].ocal miscel-
laneous members for each year of credited prior and current service
shall be determined in accordance wi~h Section 2125]..13 of said
Retirement Law, subject to the reduction provi.cied thezein for service
on and a€ter ~3anuary 3., 1956, the effective date of Sqcial Security
coverage for members whose service has been included in Federal Social
Security (28 at age 6D Fu~l and t~odi£ied).
6. ~'he percentage of final compensation to be provided for each year of .
credited prior and current service as a loca~. safety member skzal~ be
d~termined in accardance with 5ection 21252.01. o~ said Retirement Law
subject to the zeduction provi~ed therein for Fede~al Soc9.a1 Secuxity
(2$ at age 5D Modifieds.
7. Pub.lic Agency elected ta be subject to the following optiona~
provisions:
a. Section 2QQ21..6 ('FCountX peace Officez" shall i.nc~.ude
canstables, deputy constables, marshals and dep~aty marshals as
•~ Ga.P~+s~~"'~s ~'~'c~ descr ihed in Government Code Section 20021. 6).

jail, detention or carrectional tacility employees as described
in Goveznment Cade 5ection 2~D21.9}.
f. Section 20p2]..10 {'~Cotanty Peace Officer" sha~l include bailiffs
as described in Government Cade 5ection 2Q021.1b).
g. Section 21222,6 (Specs.al 15$ Increase fo= Loca1 Miscell.aneous
M2mbers}.
h. Section 2D021.5 ("County Peace Off~cer" sha11 include employees
of a sheriff's of€ice who were emplayed to perform identification
or communication dvties on August 4, ~972 and who elected to be
local safety rt~embezs).
i. Section 21222.$5 (Special 3$ -~5$ IncreasE) for oz on behalf of
those local miscellaneous memb~rs who retired or died pzior to
January 1, 1974.
j. Section 21222.86 (5pecial 1$ - 7$ Incraase) far or on behalf of
those ~ocal miscellaneous members who retired o= died prior to
~uly 1, 147~.
k. Section 2Q024.2 (One-Year Final Compensation).
Z. 5ection 20$b2.8 (Credit for Unused Sick Leave}.
8. Public Agency, ~n accordance with Goveznment Cade 5ec~ion 20740,
ceased to be an "employ~r" for purposes a£ 5ec~ion 20759 effective on
3anuary 24, 1976. Accumulated contributipns of Public Agency shall be
fixed and determined as provided in Government Cade Section 20759, and
accumulated conkributions thereafter shal~ be held by the Hoard as
provided in Goveznment Coda Section 2a759.
9. ~ubZzc Agency sha~l contribute to said Retirement 5ys~em the
c~ntributions determined by actuarial valuations of pzior and tuture
service ~iability with respect to lacal misce~laneous members and
local safety members of said Retirement System.
10. Pu~~ic Agency shall also contribute to said Retirement System as
£ollows:
a. A reasonable am~unt, as fixed by the Board, payable in one in-
stal~ment within 60 days of date of cnntract to cov~r the costs
pf administ.ering said System as it affects the employees of
Public Agency, not including the costs of special valuatiians or
of the periodic investigation and valuations required by law.
b. A reasonable amount, as ~ixed by the Board, payab~e in ane in-
stallmant as the occasions arise, to cover t~e costs pf special
valuations on account pf emgloyees of Publzc Agency, and costs of
the periodic investigation and valuations =equired by law.
11. Contributions zequired of Public Agency and i~s employees sha~l be
subject to adjustment by Board on account of a~endments to the Publxc
Employees' Retirement Law, and on account of the expezience under th~
Retirement System as determined by the periodic investigation and
valuation required by said Retizement Law.

~2. Contzibutions required of Public Agency and its employees shall he
paid by Public Agency ta the Retirement 5ystem within fiftEen days
after the end of the period to which said contributions reEer or as
may be presczibed by Board regulation. If more or less than the
correc~ amount b€ contributians is paid for any peripd, proper
adjustment shall ~e made in connection with subseq~ent remittances.
Adjustments on account of errors in cantributions required of any
employee may be made by direct payments between the employee and the
Board.
B. This amendment shall be effecti~e on the F1r5t day of
