Section No. 65 0~ Ordinance No. 2843 0~ the County ~ of Butte entit7.ed "PAYMENT OF SALAR~ES AND WAGES" i.s hereby amended to ~Ilread as fallows: g "SECTION NO. fi5, PAYMENT OF SALARIES AND WAGES: 14 Salary and wage policy sha11 be in accordance w~.th the provisions 1~ o~ the Merit System Ordinance and Resaluta.on. 12 Payment of salaries shall b~ made on the Friday next succeedi.ng 13 the end af any pay period or at such earli.er time as may be determined 14 necessary by the Coun~y Auditor. I~ the sa~ary payment date ~all.s on 15 a regularly sch~d~~ed County holiday, payment shal.l be made the l~ preceding regul.arly scheduled wa~k day." 17 Section 2. Severabil.it r. 18 If any part of this ordinance shall be he~.d vo~d such part shall ~~ be deamed severable, and the invalidity thereof sha~l not affect the w~ r~maining parts of this ordinance. 21 Secti.on 3. ~2 A. This ardinance is an urgency ordinanc~ for the immediate 9~ preservat~.on of the public peac~, heal.th, or sa~ety, and sha1.1 taka °-'~ effect immediatel.y pu~suan~ to Section 25123 {d} and (f) af the 9~ Government Cade of the State of Cali.fornia. The facts constituting 9~ ~~the urgency are as ~ollows: ~7 ~ ~ ~~I 1. Section No. 65 of the Sa~ary Ordinance has heretofore provided that ~.he payment a~ salaries shall be made on the Eriday next , ~ succeeding th~ end of any pay period. 2 2. The County of Butte is involved in a fiscal crisis which may ~ require the imminent fi~ing of a bankruptcy peti~ion pursuant ta ~ hapter 9 ot ~he Federal Bankruptcy Law. ~ 3. The ~iling o~ such bankrup~cy petition could result in 6 e~ployees o~ the County being put in the position of pre-petition ~ reditors in the bankruptcy proceedings an~ could substantially delay R uch employees in receiv~ng the comp~nsation to which they would be 9 ntit~ed~ ~f they are paid on the schedule heretofore provided ~or in ~~ he Salary 4rdinance. Such a result could work substantial hardship ~~ on such employees and have a r~su~ting disrup~ive ~ffect upon the X2 oun~y work force. 13 4. In vi~w of the above it is necessary for the Bu~~e County ~4 ala~y Ordinance to be amended so that the County Auditor can pay 15 Q~nty emplayees on a schedule mo~e flexib~e than presen~~y p~ovided ls 'n the Salary Ord~nanc~ and the~eby avoid ar minimize th~ potential 37 isruptiv~ effects on County employees of ~he f~ling o~ a bankruptcy ~~ etition. 19 B.
