The Board af Supervisors of th~ County of Butt~ ordains as follaws: Section 1. Sect~on 16-27 0€ Article ~V of Chapter 15 of the Butte County Code is ainended to read as fallaw5: SECT~ON 16-27. _ Findinc.~s. The Board of Supervisors makes the faliowing findings and determinati.ans r~quired by Section 6600I of the Californ~.a Government Code in regard to the park faci3.ity fees assessed and levied pursuant to the provisions of this Arti.cle. 13 A. Importance_of parks; increased need resulting ~rom new ~4 residentia]. deve~.o ment. The presence a~ park facil.i~ies within the ~~ Chico Urban A~ea contributes s~.gnificantly to ~.he beauty and ambience X~ of said area together wa.th the physical heal.th and emational we11 17 being of its residents. New residential development occurring within 1~ saa.d a~ea W~1i c~eate a n~ed for the acquisition and dev'elopmen~ af ~9 addi~.ional park facilities withi.n said area in that the existing park `'~ facilitias, includa.ng Bidwell Park, are insufficient in number, size, 21 location, and the kinds a~ rec~eational. oppartunities which they 42 resent, to meet the park and recreational ne~ds of both the existing `-'~ residents o~' said ar~a plus those additi.onaZ residents who wi11 9~ ventual.l.y i.nhabit such new residential d~vel.opment. Based on the `~5 en.~ral plans of the City o~ Chico and the County af Bu~te as wel.l as 9~ he Park and Recreation P1an prepared ~or the Chico Area Recreation `'~ nd Park District, new residential develapment occurring within said 2~ rea will create the need for at least fi.ve (5} acres of nei.ghborhaod 1 2 3 4 5 fi 7 8 9 10 11 12 13 14 15 16 li 18 19 i l' 21 02 4 ~~ `?4 25 2fi `?7 2F and community park faci~i~ies, deve~oped primarily for active recreationa~ puxsuits, for every one thousand (1,400) new residents who eve~t~al~y inhabit such new residential development. By reason of the foregoing, the Board o£ Supervisors detexmines ~hat there is a reasonabl~ relationship between ~he need £or the park facilaties to be ~unded with the park ~acility fees provided for by this Article and the residential development upan which such fees are imposed. S, Use of revenues from fe~s to meet park needs. A11 revenues ~rom the park facil~ty fees assessed and levied on new resid~n~ial deve~opm~nt pursuant to the p~ovisions o~ ~his Article will be used for the acquisition and development of addi~ional park ~aci~ities within the Chico Urban Area which wi11 meet the need fo~ such ~~acilities caused by such new residential deve~opment. In accordance with the provisions of ~his Article, all such revenues must be deposited in a park fund and therea~t~r appropriat~d by the Board of Directors o~ Chico Area Recreat~on and Park Dist~ict for ~he acquisition and dev~lopment o£ park faci~itias of ben~fit to th~ persons residing in the residential deve~opment upon which the fees are imposed. By reason o~ the ~oregoing, the Board of Supe~visors determines ~hat ~here is a reasonable relationship between the use af the park facility ~ees pro~crid~d for by this Ar~icle and the resid~n~ial~ developmen.t upon which such fees are ir~posed. C. FEES do not ~xceed lev~1 necessar to meet need. The park facility ~~es assessed and levied on new ~esidenti.al developFnent pursuant to th~ provisions of this Article will not exceed that which is necessary ta fund ~he park fac.~I~ties attrib~ztable to the residential d~velopment upon which such ~ees are imposed. By reasan af ~he foregoing, the Board of Supervisors d~~ermines that there is a reasonab~e re~ationship between the amaunt of the pa~k facility fees provided for by this Article and the cost af the park facilities attributable to the new residential development upon which the ~aes are imposed. Section 2. Subsec'~ion B of Saction 16-28 ie~titiea "Definitions") of Arti.cle IV o~ Chapter 16 of the Butte Coun~y Code is amended ~.o r~ad I as f~ollows: B. Chico U~ban Area. The term "Chi.co Urban Area" shall. mean the larea described on Fi~st Amended Exhibi~. A which is attached hereto and incorparated herein by this reference. Said area is substantia~ly the same as but not identical with that area depicted wi~hin, the "Urban Grawth Bounda~y" on the map of the Chico Area Recreation and Park District Compr~hensi.ve Park and Recreati.on P~an. Section 3. Section 16-30 of Art~cle TV o~ Chapt~r 16 of the Butte County Code is amended to read as follaws: ~ SECTION 16-30. Amount o~ park fac~li~~s. The aknaun~ of the basa.c park facility fee assessed and leva.ed pursuant ~o ~he provisions of this Axticle shall. be equal to the tota~ number of dwelZing units being added ta the property multiplied by the park facili.ty ~ee per dwell.ing unit ~stablished by resolu~ion o~ the Board of Supervisors based on th~ following: 1. The estimated cost per person o~ develop~.ng a~ive (5) acre I~park facility for every one thousand (1,000) new residents in the 1 Chico Urban Area, as determined, whanever possible, from th~ most 2 recent park facilities acquired and deve~oped in the Chico Urban Area 3 either by ~he County of Butte, the City of Chico or the Chico Area ~ Recreation and Pa~k District, mu~tiplied by; ~ 2. The average number of ~esidents per dwelling unit within the ~ Chico Urban Area, as determined by the mast recent fede~al census or a ~ census taken by the City of Chico pursuant to the provisions of Tit~e ~ 4, Division 3, Part 2, Chapter 17, of the Ca~iforn~a Government Code ~ ( cor~u~encing with Section ~ 020 0). X~ Sectian 4. Severabilit . If any par~ of this ordinance shall be held il voa.d by a court of competent ju~isdiction, such part sha1.1 be deemed 12 severable, and ~he invalidity thereof shal~ not af~ect the remain~ng 1~ par~s af this ordinance. 14 Section ~.
